PAS urges govt to review Peaceful Assembly Act
PETALING JAYA : PAS has called on the government to review the Peaceful Assembly Act 2012 after the Federal Court's ruling yesterday that it is unconstitutional to criminalise the failure to notify the police five days in advance of holding a peaceful assembly.
In a statement, PAS secretary-general Takiyuddin Hassan said the ruling by a five-member Federal Court panel chaired by outgoing Chief Justice Tengku Maimun Tuan Mat would give Malaysians more confidence that their voices can be heard without the threat of prosecution.
'PAS also believes that this decision will further strengthen public confidence in the freedom of expression and assembly as key hallmarks of a mature and civilised democratic nation,' said Takiyuddin.
'PAS urges the government to comprehensively review the Peaceful Assembly Act so that it truly reflects the spirit of the Federal Constitution and the universal principles of human rights, especially in light of this historic decision.'
Takiyuddin also urged the government to review or abolish legal provisions that could be misused to suppress freedom of expression, including the Sedition Act 1948, the Communications and Multimedia Act 1998, and the Printing Presses and Publications Act 1984.
The Kota Bharu MP said this was consistent with Pakatan Harapan's election promises outlined in its 15th general election manifesto.
Yesterday, Tengku Maimun said Section 9(5) of the Peaceful Assembly Act imposes a punishment that exceeds the limits permitted under Article 10(1)(b) of the Federal Constitution, which guarantees the freedom of speech, assembly, and association.
Tengku Maimun, who delivered the unanimous decision of the five-member Federal Court panel, also said the section was 'a disproportionate intervention'.
The decision stemmed from a constitutional challenge brought by former Muda secretary-general Amir Hadi, who was charged in 2022 with failing to give the police five days' notice before organising a protest outside the Sogo shopping complex in Kuala Lumpur.
Home minister Saifuddin Nasution Ismail said the government would table an amendment to Section 11 of the Peaceful Assembly Act in the upcoming parliamentary sitting following the Federal Court's ruling.
Section 11 of the Peaceful Assembly Act requires organisers of assemblies to obtain the consent of the location's owner or occupier.

PM Anwar calls on Brics to boost intra-trade, champion fair and just global order
KUALA LUMPUR, July 6 — Prime Minister Datuk Seri Anwar Ibrahim has called for an increase in intra-Brics trade and for the grouping to emerge as a strong and principled force, grounded in equity, mutual respect, and a shared commitment to shaping a more balanced and just international order. Lamenting unilateral tariff measures and protectionist policies, Anwar expressed confidence that Brics, which today accounts for nearly 40 per cent of the global economy, holds vast potential to boost trade within the informal grouping. 'With that collective strength, we can engage the world safely, fairly, and justly, negotiating on equal terms with all partners in the multilateral system,' he said. He further emphasised the need for reform of key international institutions. 'We must demand the transformation of global governance structures, from the United Nations to the World Trade Organisation, the International Monetary Fund (IMF) and the World Bank towards a more democratic and just multilateral order,' he said at the Brics Business Forum entitled: 'Bridging Continents, Building Future: A Shared Agenda for Sustainable Progress' in Rio De Janeiro, Brazil today. Also present were President of Brazil Luiz Inácio Lula da Silva, Vice President of Brazil Geraldo Alckmin and President of the Brazilian Confederation of National Industry (CNI) Ricardo Alban. Bangladesh to cooperate fully with Malaysia in GMRB militant group investigation
KUALA LUMPUR, July 6 — Bangladesh has pledged full cooperation to Malaysian authorities following the arrest of 36 Bangladeshi nationals in a recent security operation targeting alleged involvement in the Bangladeshi Radical Militant Group (GMRB). The Bangladesh Foreign Affairs Ministry said that the Bangladesh High Commission in Kuala Lumpur promptly engaged with the relevant Malaysian authorities and formally requested the identities of the individuals as well as information regarding the allegations brought against them. Five of the individuals have been formally charged in Malaysian courts, while the rest are undergoing further investigation or deportation processes, the ministry said in a statement yesterday. "The Bangladesh government is closely monitoring the developments, and the Bangladesh High Commission in Kuala Lumpur is in close communication with the relevant Malaysian authorities and will extend necessary support to the expatriate Bangladeshis wherever needed,' it said. The ministry also reiterated Bangladesh's firm stance against all forms of terrorism, violent extremism, and militancy, reaffirming its commitment to cooperate fully with Malaysian authorities in this regard. Yesterday, Inspector-General of Police Datuk Seri Mohd Khalid Ismail reportedly said that police initially detected the group's activities through social media accounts operated by Bangladeshi nationals using Malaysian IP addresses to spread IS ideology. He said a three-phase operation between April and June led to the arrest of 36 Bangladeshi Radical Militant Group (GMRB) members, including their leader, dismantling the group's Johor-based network. — Bernama
