A Dubai court has prohibited Islamic banks and Takaful insurance companies from claiming delayed interest, even if it is in the form of compensation, in cases where the debtor delays payment. This ruling, announced by the General Authority of the Dubai Court of Cassation in Appeal No. 595 of 2025 (Commercial), is based on the newly introduced Article 473 of the Federal Commercial Transactions Law, considering it a matter of public order. Dr Habib Al Mulla, founder of Habib Al Mulla & Partners, said this ruling differs from what was previously announced when the Federal Supreme Court in the 1990s deemed it permissible for them to claim legal interest as compensation for payment delays. Al Mulla said Federal Decree-Law No. (50) of 2022 regarding commercial transactions had prohibited Islamic financial institutions from borrowing or lending with interest or benefit in any form, or from imposing or collecting interest or benefit on any delayed debt, including delay interest, even if it is in the form of compensation. However, the text did not address legal interest, so the Court of Cassation, in its ruling, interpreted the text broadly and considered that interest, regardless of its nature, is prohibited, the renowned lawyer said on social media platform X. He added that this text regarding legal interest is 'open to interpretation in more than one way and depends on whether such interest is considered a form of compensation or falls under the category of prohibited usury (riba) under Sharia law.' Based on this, he elaborated, it is determined whether the interest referred to in the text is delay interest or a contractually stipulated penalty for late payment, which is considered a form of prohibited usury under Sharia, or whether the text also includes legal interest claimed in court, acknowledging the difference in concept and provisions between the two. 'The conclusion reached by the Federal Supreme Court in its famous aforementioned ruling, which considered legal interest a form of compensation, is more precise, especially since it places all litigants on an equal footing and serves as a deterrent to those who seek to procrastinate in fulfilling their obligations. We may see differing rulings from other courts in interpreting this text, which would necessitate referring the matter to the Authority for Unifying Principles,' he said. At the end of the second quarter of 2025, according to the Central Bank of the UAE, the number of licensed insurance companies in the UAE stood at 59, comprising 23 traditional national and 10 takaful national companies, and 25 branches of foreign insurance companies and one branch of a foreign reinsurance company operating in the UAE. The number of insurance-related professions increased to 504. There were 24 local and 38 foreign banks operating in the UAE at the end of last year.

The report estimates that the world's two billion Muslims spent US$ 2.4 trillion in 2023 across halal food, pharmaceuticals, cosmetics, modest fashion, travel and media. Despite geopolitical and supply-chain headwinds, that figure represents 5.5% year-on-year growth and is projected to reach US$ 3.4 trillion by 2028. Islamic-finance assets grew to US$ 4.9 trillion in 2023 and are on course for US$ 7.5 trillion by 2028, an 8.9 % CAGR. Malaysia retains the overall #1 position for the 11th consecutive year, topping every sector except modest fashion. Saudi Arabia consolidated second place, Indonesia held third, and the UAE and Bahrain rounded out the top five, while Pakistan and Senegal were the notable movers. The UAE places #4 overall in the 2024/25 GIEI—behind Malaysia, Saudi Arabia and Indonesia—and lands within the top five in every pillar except modest fashion (#7). Performance is propelled by world‑class trade connectivity, diversified export capacity and a high innovation score. One of only three OIC member states ranked among the top exporters to OIC markets, the UAE has extended its reach through a network of Comprehensive Economic Partnership Agreements (CEPAs). CEPAs with Indonesia and Türkiye entered into force in September 2023—the Türkiye agreement includes a dedicated halal‑cooperation clause to advance mutual recognition—while negotiations concluded with Morocco and Malaysia and a new agreement was signed with Jordan in 2024. The UAE also officially joined the BRICS economic partnership at the start of 2024. Investments in Islamic economy-relevant companies in 2023/24 reached US$ 5.8 billion with investors completing 225 M&A, PE and VC transactions. Media & Recreation registered 87 deals, reflecting demand for culturally aligned digital content. Islamic Finance recorded the largest deal value at US$ 1.98 billion across 59 transactions. Indonesia (40 deals; US$ 1.60 billion) leads with total deal value, followed by the UAE (50 deals; US$ 1.53 billion), and Saudi Arabia (34 deals; US$ 1.08 billion). The report spotlights more than 30 important signals of opportunity, including blockchain-backed halal supply-chain traceability, Islamic DeFi platforms, AI-driven tourism services, social-commerce-powered modest fashion, and soaring ethical-consumer activism that is accelerating local halal-brand growth. Total OIC imports of halal-related products amounted to U$ 407.8 billion in 2023, with 72% of it being food imports. This is set to grow at 8.3% CAGR to US$ 608.4 billion by 2028. The Middle East is fast becoming one of the world's most exciting fintech frontiers. Digital banking adoption in the UAE is soaring, 89 per cent of consumers now use digital-first bank accounts, and digital payments now account for just 17 per cent cash usage in everyday transactions. Real-time payments are also growing rapidly, with the region expected to exceed 3 billion transactions by 2028. Across Mena, over 1,000 fintechs are now operating, with the sector expected to grow 35 per cent annually through 2028, more than double the global average. 'We're seeing a profound shift in how financial services are being built, delivered, and adopted in the UAE. Over the past few years, fintech adoption has widened beyond early movers into a broad, vibrant ecosystem, now home to over 300 active fintech firms. Crucially, we're seeing fintech's role expanding. While payments remains a key entry point, the growth of virtual cards, cross-border capabilities, and smarter credit solutions is opening up new opportunities across sectors, from SME lending to wealthtech,' Nauman Hassan, Regional Director Mena, Paymentology, leading global issuer-processor, told Khaleej Times. 'High smartphone penetration at 96 per cent, growing comfort with digital payments, and the rise of digital-native banks like Wio and Zand are accelerating this momentum,' Hassan said. The UAE's push toward a cashless society is well underway. Dubai, for example, has digitised over 97 per cent of government payments, and in 2025, DIFC and Dubai Finance launched workshops to help businesses make the switch. 'We're proud to play a foundational role in this shift. Our cloud-first platform enables banks and fintechs to launch digital-first card programmes at speed, whether physical, virtual or tokenised. Our work with partners like Mamo in the UAE illustrates this impact clearly: together, we're helping small businesses access fast, secure, multi-currency payment options - moving them away from cash-based transactions toward streamlined digital flows. And because we support real-time data and multi-currency settlement, we empower fintechs to launch smarter, more accessible financial products from day one. To support this momentum on the ground, Paymentology recently expanded its regional presence with a new office in Dubai. 'This hub strengthens our ability to serve clients across Mena with specialised support, faster implementation, and deep local expertise, accelerating the shift to digital payments across the region,' Hassan said. In a country as digitally advanced as the UAE, trust in payment systems is the currency of continued innovation. Every day, over Dh11 million is lost to fraud, studies show. And as adoption of digital payments accelerates, the potential attack surface for cyber threats expands with it. 'We believe security must evolve just as quickly as the technologies it's designed to protect. Tokenisation is one of the most powerful tools in our arsenal. By replacing card numbers with unique digital tokens, we remove sensitive data from the threat landscape entirely, a move that can reduce fraud by up to 60 per cent. We've invested heavily in tokenisation because we believe cards are just one way to pay; the mechanism behind the card will remain, but we'll increasingly see payments shift to mobile devices and digital wallets, whether through global platforms like Apple Pay or proprietary solutions from banks, fintechs, and super apps,' Hassan said. AI is fast becoming the engine driving the industry forward. From real-time fraud detection to intelligent credit scoring, AI is transforming how financial services are delivered, and who can access them. A few years ago the UAE government partnered with Mastercard to accelerate the adoption or AI. More recently we had the announcement granting nationwide access to ChatGPT Plus, giving every student, entrepreneur, and professional free use of GPT-4o is a world first. As well as development of 'Stargate', one of the world's largest AI supercomputing clusters. 'At Paymentology, we're seeing the value of AI unfold across our organisation. Our teams are increasingly leveraging AI in their day-to-day operations from improving internal workflows to enhancing client support. Our API sandbox already incorporates AI to help fintechs experiment and innovate more efficiently, and we're actively exploring new opportunities to integrate AI across our platform.
