Consumer watchdog calls for new laws compelling home sellers to disclose more information

The consumer watchdog has called on
the Government
to introduce new laws that would require home sellers to provide additional pre-sale information to buyers to avoid delays and possible sales falling through.
The call is contained within a new report from the
Competition and Consumer Protection Commission
(CCPC), which highlights significant information gaps for home buyers.
The watchdog said there are two critical stages where consumers are at risk due to inadequate information: the presale agreed stage and the conveyancing stage.
'In the early stage,
buyers
can waste time on unnecessary viewings and researching unsuitable properties due to unclear or exaggerated advertisements,' the report said.

'A lack of accurate information can also lead to consumers overestimating property values.
'During the conveyancing stage, delays are the most significant issue. These can often stem from issues that could have been identified or disclosed earlier, such as problems with deeds or ongoing probate.'

In the Republic, the sale of residential properties by a consumer follows the principle of 'buyer beware', meaning it is the buyer's responsibility to investigate a property's condition and legal status before making the purchase.
The CCPC said this has led to 'widespread consumer detriment', including financial loss, stress, and time wastage, particularly during the early and conveyancing stages of property transactions.
The new laws it has called for would mean no property would be permitted to go to market without certain details being confirmed, such as whether the property is tax compliant, whether the seller has the title deeds, and if the property is undergoing probate.
'In addition, the seller or estate agent should make readily available any public information on environmental risks which could be associated with the property, such as flood, noise and radiation maps,' the CCPC said.
The report also calls on the Government to create a new conveyancing profession to enhance the efficiency of the legal process.
'The role of conveyancing is set to become even more crucial as the volume of property transactions continue to rise,' it said.
'With the increasing demand for transparency and efficiency in the homebuying process, the need for skilled conveyancers who can navigate the legal intricacies and ensure smooth transactions is more urgent than ever.'
As part of its research, the CCPC established that just 16 per cent of consumers believe the current system is transparent for buyers.
Almost 80 per cent believe that if one potential buyer asks a question about a property, the estate agent should be obliged to identify and disclose the information to other buyers.
Despite going through an in-depth conveyancing process, almost 30 per cent of homeowners discovered something after the sale that they wished they had known about the property, its contents, or the surrounding area before buying their home.
More than half (57 per cent) of those who made such a discovery said they would have lowered their offer or withdrawn completely if they had known about the issue before the sale closed.

As August begins, we have already seen so many budgetary kites take flight to tell us the making of the next year's budget starts earlier each year. Right now, Ireland is a rich nation and its people have expectations that accord with that. But in a Trumpian discordant world, that situation could change rapidly, as we found to our cost in 2008 when we entered what former finance minister Michael Noonan later called 'a lost decade'. Ireland's small, open economic model leaves us susceptible to swift boom-and-bust switches. In early October, we will learn the 2026 financial plans of 'Mr Prudence' himself, Finance Minister Paschal Donohoe. Many of us believe we deserve more goodies, but this is more a time for caution. If tough global economic times hit soon, we will be in a better position than we were in 2008, but the atypical budget surplus, which contrasts with our European neighbours, can only cushion so much. Ireland cannot be an economic outlier forever. We are reminded that the days of the early 2000s, when taoiseach Bertie Ahern declaimed that the 'boom just got boomier', presaged tough economic times. The impact of Donald Trump's tariffs may diminish the resources available for such largesse Mr Donohoe and his colleagues insist that one-off budget payments, like electricity bill grants, are not going to happen next year, but closer analysis suggests the Government's dilemma is that voters will notice the difference if they do not happen again. This is particularly true for households with children, who benefited from two double welfare payments. For a single worker on €50,000 last year, the budget measures delivered about €860 extra per year. When you add the two energy credits amounting to €250, you find it was a nice bonus that will be missed. PART OF THE fallout from The 42′s story a week ago that one of the core aims of the FAI's Football Pathway Plan was effectively 'dead in the water' was a willingness from some in Abbotstown to open up about morale. And with the independent auditors appointed on track with their report on the League of Ireland academies, there is at least positivity that the timeframe that was set out by LOI academy manager Will Clarke to present their funding proposal to Government will be met in mid August, with clarity expected in time for October's Budget. An ask of an 11-year commitment with a top end figure of €8m phased in and then tapering off is what the FAI are looking for. Getting this over the line is crucial to provide an element of hope for the future, and that's before you consider that next week will see the FAI continue their search for Marc Canham's permanent replacement as Chief Football Officer. At least two internal candidates are understood to be in the frame, as well as three from outside including one former senior men's international. All will be tasked with presenting their vision on how they intend on delivering the Football Pathways Plan. With so much happening in the background the FAI top brass will soon be back in front of an Oireachtas sport committee after they requested a four-week deferment on a scheduled appearance just after the start of July. The FAI asked for more preparation time for the session, citing 'the complexity introduced by the committee seeking material that relates directly to an ongoing Garda investigation.' A Garda investigation is ongoing after RTÉ and the Sunday Independent detailed in their own joint investigation allegations from the 1990s against former male coaches relating to unwanted sexual advances. Company CEO Billy Hann made the comments in light of Minister for Transport Darragh O'Brien's announcement on Wednesday that planned recruitment for a transport police force with powers to detain could begin by the end of 2026. "I would like to see a transport-wide solution to the security concerns around anti-social behavior', Mr Hann told RTÉ's Today With Claire Byrne. At present, security on Dublin Bus, Irish Rail and the capital's Luas tram are operated by separate private security firms such as One Complete Solution (OCS) and STT Risk Management. However, Mr Hann would like to see a merged state transport security force, as set out in the government's National Development Plan for 2025. "If you join up those services and have the one company providing those services, they're working off the one set of data. They can sort of move across the various different modes of transport and address the behavior. He added: 'They [troublemakers] don't just stop on the bus. They jump off the bus and they go on the Luas. They get off the Luas, they get on the Dart and so on.' Comparing the effectiveness of current security firms in combatting anti-social behaviour on the country's transport links, Mr Hann highlighted the disjointed nature of the current security infrastructure. "We can remove people from buses. The private security firms do have, under the citizen's arrest, the ability to detain, but they can't arrest.' He added: 'We're not just on one campus like the airport police. We're working across a network.' Mr Hann concedes that introducing the new transport police force is not a 'silver bullet' to fix all problems of anti-social behaviour. Dublin Bus introduced its Safer Journeys Team last October with six operatives working seven days a week to prevent and respond to incidents of anti-social behaviour across its routes in areas specified as problem hot spots.
