
ONOE: Ex-CJIs say bill ‘may not' violate basic structure of Constitution, but question powers to EC
Members of the JPC examining the Constitution (One Hundred and Twenty-Ninth Amendment) Bill, 2024, widely known as the One Nation, One Election (ONOE) Bill, told ThePrint that Khehar appeared more doubtful about the legality and constitutionality of the concept than Chandrachud.
New Delhi: Former Chief Justices of India D.Y.Chandrachud and J.S.Khehar told a Joint Parliamentary Committee (JPC) Friday that while simultaneous elections to Lok Sabha and the state assemblies 'may not' violate the basic structure of the Constitution, authorising the Election Commission (EC) to decide the poll schedule without checks would fall short of legality.
The MP said that Justice Khehar said that the text in the Bill needed to be revised and made more precise as several clauses are 'vaguely worded'. Justice Chandrachud is also learnt to have said that giving more powers to the EC could disturb constitutional balance.
Previously, in his written submission to the JPC, Chandrachud had raised concern over the 'sweeping powers' granted to the EC in the proposed constitutional amendment law 'without laying down any guidelines for the exercise of the discretion'.
However, he added that staggered elections were not an immutable feature of the Constitution, a view he shared during the meeting of the committee Friday as well.
'The argument that staggered elections are a part of the Constitution's basic structure (or form part of the principles of federalism or democracy) does not hold. Staggered timing of elections cannot be considered as a feature of the original Constitution, let alone an immutable feature,' the former CJI stated in his written submission.
The Bill proposes an amendment in Article 172 of the Constitution (which lays down the duration and dissolution of state legislative assemblies) to allow the curtailment or extension of state assemblies for alignment of state polls with the general elections. Both the former CJIs are learnt to have recommended the need to have parliamentary oversight to prevent misuse of the provision by the EC.
'In fact, Justice Khehar said these questions and doubts assume more significance in light of the ongoing conversation about the supposed biased nature of the EC,' another MP said.
Previously, two more CJIs—Justices U.U.Lalit and Ranjan Gogoi—have appeared before the committee. Appearing before the 39-member committee, former CJI Gogoi had also raised questions on the Constitutional validity of certain provisions in the Bill.
Similarly, former CJI Lalit had also cautioned, in his submission before the panel, that curtailing the terms of the state assemblies to make the ONOE possible may not stand legal scrutiny.

Tejashwi seeks support from Opposition and ruling parties over SIR in Bihar
Leader of the Opposition Tejashwi Yadav on Sunday (July 20, 2025) shared letters he had written to 35 leaders seeking their support in the fight against the ongoing Special Intensive Revision (SIR) exercise in Bihar, alleging large-scale disenfranchisement. The Rashtriya Janata Dal leader has posted the letter on X. Along with Opposition leaders at the national level, Mr. Yadav has also written letters to ruling coalition leaders at the Centre and the State, including Bihar Chief Minister Nitish Kumar, Lok Janshakti Party (RV) national president Chirag Paswan, Hindustani Awam Morcha (Secular) founder Jitan Ram Manjhi, Telugu Desam Party national president N. Chandrababu Naidu, All Jharkhand Students Union (AJSU) president Sudhesh Mahto, and Apna Dal (Soneylal) party president Anupriya Patel. Congress leaders Rahul Gandhi and CPI-(ML) general secretary Dipankar Bhattacharya were also among those who received the letters. In the letter, Mr. Yadav said that he was writing the letter with a deep sense of anguish and urgency. 'The farce and tragedy of the Special Intensive Revision (SIR) going on in Bihar has shaken the very foundation of democracy through large-scale disenfranchisement. It is a clear indication of how the independent institution of the Election Commission is adamant on eroding public trust in the integrity of our electoral process,' Mr. Yadav said in the letter. He further wrote that every person in the country, irrespective of their background or status, is proud of their vote and the ability to participate in the governance of the country is deeply empowering. Expressing apprehension, Mr. Yadav said that lakhs of voters, for no fault of their own, are being disempowered and humiliated. 'According to the EC press note dated July 16, 2025, around 4.5% of the population has already been left out because they were not 'not found at their addresses'. This is in addition to the 4% who 'probably' passed away or have permanently shifted. Going by these numbers, journalists on the ground and political scientists closely observing the exercise put the disenfranchisement figure at a whopping 12% to 15%. This is unprecedented in the history of our country,' Mr. Yadav said. Raising questions on the timing of revision, Mr. Yadav pointed out that even the Supreme Court had hinted at suspicion. He added that the EC had not done itself any favours by announcing and carrying out the exercise in a haphazard and high-handed manner. Mr. Yadav alleged that the poll body has not been transparent and it is making and breaking its own rules on the fly. 'Worse, they are targeting anyone and everyone who demands transparency and accountability,' Mr. Yadav said. The former Deputy Chief Minister said the experience of the Maharashtra Assembly elections are still fresh in the memory, and he was still waiting for a proper response from the EC. 'Now it is Bihar's turn. This needs to be resisted in the strongest terms possible. Because, if we do not raise our voices and register our strong protest, the same will be carried out in other States as well. The Constitution demands that we defend the republic. We should not be found wanting at this historical juncture,' Mr. Yadav said.

15-day Goa assembly's monsoon session to see 4,000 questions, 16 bills
Panaji: The 15-day monsoon session of the state assembly, beginning on Monday, is likely to be hectic and acrimonious, with govt facing over 4,000 questions. The opposition is all set to corner govt over various issues, including unemployment, Mhadei, deteriorating law and order, and land conversions, among other issues. Govt will introduce 16 bills in the assembly, and 15 private member resolutions will be discussed. The general discussion on the budget will take place from Monday to Wednesday. Demand for grants will be taken from Thursday to Aug 8. State govt is likely to introduce bills to regularise illegal structures on comunidade land and govt land. Govt, through the bill, will empower the administrator of the comunidade to decide on the application — bypassing the comunidade — to regularise the illegal structures on the respective comunidade, not exceeding an area of 300sqm. With a rise in dog attacks on people, often resulting in serious injuries, state govt will introduce the Goa Animal Breeding and Domestication (Regulation and Compensation) Bill, 2025, to prohibit the domestication and breeding of ferocious animals and ban the import of such breeds. Govt will also introduce the Factories (Goa Amendment) Bill, 2025, seeking to increase working hours in factories from the existing 9 to 10 hours. The opposition said that govt 'declared an undeclared 'emergency' in the assembly' after speaker Ramesh Tawadkar did not allow the opposition's demand to put more questions for the question hour and have more calling-attention periods during the monsoon session. The opposition alleged that Tawadkar is in a hurry to become a minister. It had walked out of the business advisory committee (BAC) meeting to finalise the business for the monsoon session of the House.
