A retired boxer, said to have suffered multiple rib fractures in the ring, has been awarded €29,000 damages against the gardai who crashed into him after the State-owned car had broken a red light.
Judge John Martin said he accepted Derek McGee must have been hit at 'some speed and force' for the Garda vehicle to have written off his commercial Range Rover.
Barrister Conor Kearney, who appeared with Chris Horrigan of Blake Horrigan solicitors for Mr McGee, told Judge Martin that liability had been accepted by the State Claims Agency and the court was being asked to assess compensation for his client.

McGee, (40) of Landen road, Ballyfermot, Dublin, said that on 9th December 2022, he had been driving at Temple Street, West Dublin, when he had been struck by a garda car that had been driving along the Luas line and had struck his vehicle after having passed through a red light.
He said he had the benefit of a green light at the time and his Range Rover, which had been struck on the driver's side, had afterwards been assessed and had been considered no longer roadworthy following the crash. All airbags had deployed in the accident.
Mr McGee said he had suffered injuries to his back and neck and, in cross-examination by counsel for the Ministers for Justice and Finance and the Commissioner of An Garda Siochana, denied that a lot of his pain had arisen from multiple fractures to his ribs which he admitted he had suffered while boxing.
Judge Martin said the court accepted Mr McGee had been involved in a heavy accident and had suffered pain in his neck and back, some of which persisted and which were entirely consistent with the incident.
'Mr McGee was not in the best of financial positions and I accept he could not afford physiotherapy and the cost of being in and out of doctors' clinics,' Judge Martin said.
The judge said that in line with official guidelines for compensation he considered an award of €20,000 as appropriate for Mr McGee's back injury which he uplifted by €9,000 for the injury to his neck. He awarded Mr McGee his legal costs against the defendants.

A man who was killed after being hit by a truck while walking to work in Dublin last week was a Brazilian national 'in search of a better life' in Ireland. The victim, named locally as Romulo Cerasuolo, 34, was heading to work when the fatal collision took place on Ballyboden Way last Friday morning. He was tragically pronounced dead at the scene just after 8.30am. Now, a fundraiser has been set up on GoFundMe by pals of Mr Cerasuolo to help return his remains back to his family in Brazil, called 'Romulo Cerasuolo -Help us get him back home.' So far €12,245 has been raised by 648 donors. The Brazilian community in Dublin are pleading for funding support in a bid to help Mr Cerasuolo's family to cover the cost to "transfer of his body to his homeland". They wrote: "Romulo was hit by a lorry on Ballyboden Way, Dublin 16, and sadly died on the spot. "The news shocked the entire community, especially those who lived with him and knew his dedication, discretion and generous heart. Romulo came to Ireland in search of a better life, like so many of us. "He worked hard, lived simply and always remained firm in his commitment to his family in Brazil, who are now facing not only the immense pain of his loss, but also the difficulty of paying for the transfer of his body to his homeland." "That's why we've set up this fundraiser. Our aim is to help his family take Romulo back home, so that he can have a dignified burial, surrounded by the love of those who saw him born," they continued. "The amount needed for the transfer is high - so every donation, no matter how small, will make a big difference." Mr Cerasuolo's local community is now coming together in an effort to cover the cost of his repatriation. For more information or to donate to the fundraiser, click here. Gardai continue to appeal for witnesses to the fatal collision and have asked anyone who may have witnessed the collision or who may have relevant footage of the area at the time to come forward. In a statement, a Garda spokesperson said: "Gardai are appealing to anyone who may have witnessed this collision to contact them. "Any road users who may have camera footage (including dash-cam) and were travelling in the area between 8:00am and 9:00am this morning are asked to make this footage available to investigating Gardai. More info Gardai have renewed their appeal for information over the death of a 20-year-old man who was last seen 16 years ago today. Paul 'Frank' Byrne was last seen at Kilmartin Green in Tallaght on July 15, 2009. The remains of the 20-year-old were later discovered in a wooded area by a forestry worker near Blessington, Co Wicklow on the July 29, 2010. On the day he was last seen, it was reported that Paul left Kilmartin Green in a 2000 registered wine-coloured Mitsubishi Carisma accompanied by a number of other men. His mother reported him missing at Tallaght Garda Station the following day. Five people have been arrested in connection with the investigation into Mr Byrne's murder but to date, no one has been brought to justice for his murder. Gardai at Blessington Garda Station are renewing their appeal for information on the 16th anniversary of Paul's disappearance and say his family are anxious for the investigation to progress to bring them closure. A Garda spokesperson said: "Gardaí are appealing to those who may have information since 2009, or who may have come into possession of information in the intervening years, to come forward. Gardaí are urging individuals, who sixteen years on may want to come forward to do so, especially if relationships or associations have changed over the years. "With the passage of time, people may now feel more comfortable sharing information with Gardaí. Gardaí would like to assure the public that they will treat anyone assisting the investigation in a sensitive manner." More info A man has been raced to hospital with serious injuries following an alleged stabbing incident in Dublin city centre this evening. The incident took place at around 8:30pm on James Joyce Street, Dublin 1. Footage of the aftermath seen by Dublin Live shows a man lying on the ground while a number of people try to assist him. The injured man was treated at the scene before being taken to the nearby Mater Hospital where his condition is described as serious but not life-threatening. The scene of the incident has since been sealed off with a large Garda presence in the area while a technical examination is carried out. A Garda spokesman told Dublin Live: "Shortly after 8:30pm on Monday, 14th July 2025, Gardaí and emergency services responded to an incident on James Joyce Street, Dublin 1. An adult male sustained injuries during the course of the incident. "He received treatment at the scene and was subsequently transported by ambulance to the Mater Hospital. His injuries are understood to be serious but not life-threatening. The scene has been preserved for forensic examination and investigations are currently ongoing."
