Legal challenge to ‘super junior' ministers seeks judges' intervention in inner workings of Government, AG tells court

action challenging the constitutionality of super junior minister appointments seeks the judiciary's 'unprecedented' intervention in the inner workings of the Government's executive branch, the Attorney General has said.
Rossa Fanning made the argument in presenting the State's defence to Pa Daly's case, which opened before a three-judge divisional court on Monday.
Mr Fanning said the court should resist the Kerry TD's attempt to have the judiciary involve itself in a 'political contest being played as an away fixture down at the Four Courts'.
Mr Daly's case claims the appointment of super-junior ministers is 'completely anti-democratic', and is a breach of various provisions of Bunreacht na hÉireann.

'Ministers of State attending Cabinet', or super junior ministers, are appointed by the Government on the nomination of the Taoiseach. They participate at Government meetings but do not vote.
Senior government ministers are appointed by the President of Ireland on the advice of the Taoiseach and with the prior approval of Dáil Éireann.
At present, there are four super-junior ministers attending Cabinet: Fianna Fáil's Mary Butler, Hildegarde Naughton of Fine Gael, and Noel Grealish and Seán Canney of the Regional Independent Group. They are not parties to the case.
Opening Mr Daly's case on Monday, Feichín McDonagh SC said super junior ministers meet and act as a 'collective authority' with other senior government members, in breach of the constitution.
Counsel opened to the court Article 28 of the Constitution, which limits the number of government members to 15, including the Taoiseach, and provides that they meet and act as a collective authority.
Under the current scenario, there are 'extra individuals' – super junior ministers – who are present in the Cabinet room taking a full role in the formulation of Government policy, Mr McDonagh said.
Every decision taken by the Government with these extra individuals in attendance has been formulated in breach of Article 28 of the Constitution, Mr McDonagh said.
He said their case is not challenging a particular Government decision based on the legal points raised – but some other litigant could, which is a danger and possible problem, Mr McDonagh said.

Counsel said the Attorney General attends Cabinet meetings to provide legal advice, and the secretary general takes meeting minutes, but they do not act collectively with the members of Government.
Rossa Fanning, representing the State respondents in the case, said the court should resist Mr Daly's case to conscript the judiciary to involve itself in a 'political contest being played as an away fixture down at the Four Courts'.
Mr Fanning said the case's key question was whether the Constitution forbids the regular attendance by ministers of state at Government meetings, whilst simultaneously allowing the attendance of the secretary general, attorney general, and limited attendance of other ministers.
'Plainly, the answer to that question is the Constitution does nothing of the kind,' he said.
Mr Fanning said their case is because there is no Constitutional regulation of who attends Cabinet meetings, who attends is matter exclusively for the Government itself.
Mr Fanning submitted this even if the court disagrees with this, for Mr Daly's case to succeed, he must prove the Government's 'clear disregard' of the Constitution.
Mr Fanning said the practice of ministers of state attending Cabinet meetings has been ratified and recognised multiple times by members of the Oireachtas.
This arises from legislation passed, initially in 2001, providing for allowances to be paid to those ministers.
Earlier, Mr McDonagh said this allowance 'is neither here nor there' when addressing the legal issues raised by their case.
Mr Fanning submitted that Cabinet meetings are only one element of Government decision-making, and cannot be looked at artificially in isolation of the other parts of that process. He noted the role of Cabinet Committees in the process, and other people and organisations that can influence a decision.
The idea that ministers of state must be hermetically sealed away from the formation of policy is completely unreal, he said.
Mr Fanning said Mr McDonagh was advancing an 'unprecedented' argument, by positing that the attendance of additional people at a Cabinet meeting invalidates a consensus decision of the 15 senior government ministers.
Mr Fanning said Mr Daly's side were seeking to reverse engineer an interpretation of the Constitution to suit their case.
The case continues, and expected to run until Wednesday at the latest.

Anti-immigrant protesters block entrance to Leinster House
Additional gardaí had to be called to Kildare Street on Tuesday afternoon after anti-migrant protesters blocked the main entrance to Leinster House. The protesters, may of them carrying tricolour flags, had earlier been part of a rally and march on O'Connell Street under the banner Dissolve the Dáil. Some 150 protesters then marched to Kildare Street where they congregated around the main gates of the complex and would not move back when requested to by gardaí and Leinster House security staff. Extra gardaí were drafted into the area and Kildare Street and surrounding streets were blocked off to traffic. The crowd chanted anti-migrant and anti-politics statements, with some shouting 'traitors' and 'collaborators' to staff and visitors entering and leaving the complex. READ MORE The rally was organised by Kerry businesswoman Michelle Keane, who was an unsuccessful candidate in the general election in November. She has taken a High Court action against the State claiming that votes were 'torn' out of ballot boxes in Kerry. Those who attended the rally began congregating outside the Dáil at 2pm and were still blocking the entrance two hours later. Gardaí at the scene have not yet attempted to move protesters away from the gate. The main concern from a security perspective is that a student protest is scheduled to take place on Kildare Street at 6pm, which could lead to confrontation if the protesters there at the moment have not dispersed by then.

Anti-immigration protest gathers at Leinster House 'demanding' access
A large anti-immigration protest has gathered outside Leinster House and are demanding to be allowed to address the chamber. The protest, organised by failed Kerry election candidate Michelle Keane, marched from the GPO. The front gates to Leinster House have been closed, with protesters gathering right up to where the vehicular entrance is. Workers in Leinster House were encouraged to remove their access badges when leaving the building and advised not to exit via the Kildare Street entrance. Ms Keane wrote to all TDs and Senators on Monday evening advising them of the protest and demanding that it be allowed into Leinster House. The letter, seen by the Irish Mirror, called for 100 people to be let into Leinster House to address politicians. The letter read: 'On Tuesday, July 8 2025, over 100 Irish citizens will march peacefully from the GPO to Leinster House under the banner 'The People's Right to Dissolve the Dail'. 'We are writing to formally demand that you facilitate our entry into Dáil Éireann to allow representatives of the Irish people to speak directly before parliament. 'This is not a symbolic gesture - it is a democratic action grounded in the principle that: 'The Irish Government was established by the Irish people, and it can only be 'disestablished or reformed by the Irish people. "As elected members of the Oireachtas, you have the power and duty to request access through the Superintendent of the Houses of the Oireachtas, and to stand with the people you were elected to serve. We ask that you do so without delay. 'If the Dail is truly the house of the people, it must not be locked against them in their hour of national concern 'A refusal to allow a peaceful, constitutional address by citizens would be a direct violation of the spirit of the Republic, and an abdication of democratic responsibility. 'Let history record where each member of the Oireachtas stood on this day. "We respectfully demand your immediate action to ensure we may enter Leinster House and speak peacefully as citizens of Ireland — united across 32 counties, regardless of background or tradition, in one common goal: national renewal.' On a livestream of the protest, Ms Keane told the crowd that they wanted 'to do this peacefully'. She added: 'We are Irish citizens and we are not going to let ourselves down here today.' She also suggested that a Garda had gone into Leinster House to ask the Superintendent to come out and speak to the crowd. A man could be heard on the video saying, 'There are people ready to go through these gates.' Barriers are usually set up around Leinster House when protests take place to push groups back onto Molesworth Street. However, no barriers were constructed on this occasion.

Pope Leo appoints Bishop of Limerick to key Vatican department
Pope Leo XIV has appointed the Bishop of Limerick as a member of a key Vatican department. Bishop Brendan Leahy has been selected by the pontiff into the Dicastery for Interreligious Dialogue. The 65-year-old has been serving as Bishop of Limerick since 2013 and was previously appointed to the Vatican's Dicastery of Culture and Education as well as the Dicastery for Clergy. Bishop Leahy has also been involved in inter-faith dialogues in Ireland and abroad, as well as with the Mid-West Interfaith network, which includes visiting Dooradoyle mosque on several occasions. The Dicastery, which is one of many that supports the Pope in both his pastoral and administrative duties, looks after relations between the Catholic Church and other religions across the world. The department is described as being 'one of the most strategically important bodies in the Vatican', which focuses on peacebuilding, cultural understanding, as well as global religious cooperation. In a statement, Bishop Leahy said he was 'deeply honoured to receive this appointment.' 'Peace is something very precious, that we all yearn for, and we all hurt and pain when it is absent,' he said. 'It is in the soul of all Christians, and this appointment is, therefore, a responsibility that I take very seriously and am truly privileged to have. 'I am really looking forward to working closely with the members of the Dicastery in Rome in promoting the Catholic Church's outreach to members of other faith communities. 'With so many dark clouds in our world today, it is important to recognise that religions are part of the solution.
