Repeat offender in Kuching sentenced to over five years' jail, caning for drug abuse

KUCHING (July 21): The Sessions Court here today sentenced a 40-year-old mechanic to five years and three months' imprisonment and one stroke of the cane for abusing amphetamine and methamphetamine.
Judge Iris Awen Jon meted out the sentence against Lai Muk Loi after he pleaded guilty to a charge under Section 15(1)(a) of the Dangerous Drugs Act (DDA) 1952, punishable under Section 39C(1)(b) of the same Act.
The Section provides for a prison sentence of between five and seven years, as well as up to three strokes of the cane, upon conviction.
In addition to custodial sentence, Iris also ordered Lai to undergo police supervision for two years following the completion of his prison term.
Lai committed the offence at the Narcotics Crime Investigation Department of the Bau District Police Headquarters at about 1.05pm on Jan 25, 2025 .
He has three previous convictions for the same offence in April 2015, June 2016, November 2019.

IPOH: A former manager of a private university's student admission, marketing, and records division was fined RM35,000 by the Sessions Court here after pleading guilty to forging student recruitment agreement documents six years ago. Judge Meor Sulaiman Ahmad Tarmizi handed down the sentence to Mohd Khalid Ka'ab, 42, on Tuesday (July 30), and ordered him to serve four months in jail if he failed to pay the fine. According to the charge sheet, in June 2019 at Universiti Teknologi Petronas (UTP) in Seri Iskandar, the accused had dishonestly used a document as genuine, namely a student recruitment agreement between Institute of Technology Petronas Sdn Bhd and Profedge Sdn Bhd, dated Aug 1, 2019. As an agency company appointed to provide promotional services for UTP programmes and to recruit students from the Federal Territory, Selangor, and other locations for admission into UTP, the accused had a reason to believe that the document was false. The accused committed an offence under Section 471 of the Penal Code, which is punishable under Section 465 of the same Code. During mitigation, the accused's counsel, Mohamad Izwan Abd Rahman, requested a lenient sentence as his client had pleaded guilty and saved the court's time. However, Malaysian Anti-Corruption Commission's (MACC) prosecuting officer Shahrul Azuan Ghazali requested that the court impose an appropriate sentence as a deterrent to the accused.

SEREMBAN: A woman claimed trial in the Sessions Court here to a charge of criminal breach of trust involving RM199,491 belonging to a cooperative where she was previously employed as a clerk. Noorazwin Zullkifli, 36, pleaded not guilty after the charge was read to her before judge Mohamad Kamil Nizam. The mother of three young children was charged with committing the offence between Feb 2, 2023 and March 22, 2024 at the Kg LBJ Johnson Cooperative office in Bandar Enstek, Nilai. She had allegedly transferred the cash into her account online using a point of sale terminal belonging to the cooperative. The accused was charged under Section 408 of the Penal Code, which carries a jail term of between one and 14 years upon conviction. Deputy public prosecutor Syamimi Farhana Muhammad A. Aziz told the court that her team was proposing bail of RM30,000 in one surety pending remention. Noorazwin's lawyer Ahmad Muzhaffar Abdul Razak pleaded for a lower bail as the accused had to provide for her children with a monthly salary of RM1,800 from her job at a convenience store. Mohamad Kamil set bail at RM12,000 in one surety and ordered the accused to surrender her passport to the court, report at the nearest police station once a month until her case is disposed of, and stay away from the witnesses. He also fixed Sept 9 for remention.

Kota Kinabalu: The court fixed Aug 28 for mention of the case involving a 42-year-old jobless charged with committing mischief and causing injury to his niece. Sessions Court Judge Amir Shah Amir Hassan set the date for Musa Matsalleh whose case was brought up for mention and fixed the date for the prosecution to serve all relevant documents to Musa. The court also granted the prosecution's application for both Musa's cases to be heard and consolidated as it involved same witnesses. On the first count, Musa is accused of committing mischief by burning the mattress and bed at 1pm on June 15 this year at a house in Kg Bambangan, Papar. The offence under Section 435 of the Penal Code carries a jail term of up to 14 years, and liable to a fine, on conviction. On the second count, he allegedly voluntarily caused hurt to his 14-year-old niece at the same place and time. Pending the date, Musa was ordered remanded further. Deputy Public Prosecutor Bryan Francis appeared for the prosecution while Musa was not represented. Meanwhile, eight illegal immigrants were jailed four months each for entering the State illegally. All the illegal immigrants aged 19 and 56, comprising Filipinos, pleaded guilty separately before Sessions Court Judge Hurman Hussain, to entering the State without their valid documents. The offence under Section 6(1)(c) of the Immigration Act 1959/1963 provides for a jail term of up to five years, or a fine of up to RM10,000, and whipping, on conviction. The illegal immigrants were arrested by the Immigration team who carried out operation in the city area this month (July). During the operation, they failed to produce their identification documents to the Immigration personnel. The illegal foreigners asked to be deported to their respective hometowns as soon as possible. The court ordered the illegal immigrants to serve the jail sentence from the date of their arrests.
