New Mexico Taxation and Revenue Department ordered to pay more than $30,000 in IPRA case

May 11—A research institute in New Mexico has won a lawsuit against the New Mexico Taxation and Revenue Department over violations of the Inspection of Public Records Act.
The Southwest Public Policy Institute (SPPI) — a think tank headquartered in New Mexico that examines data-driven policies and advocates for limited government and personal freedom — sued the NMTRD after the department refused to give SPPI access to the Motor Vehicle Division database, a division of the NMTRD, for research purposes.
The institute requested records under the Inspection of Public Records Act, a New Mexico state law that guarantees the public has access to public records held by government entities.
The institute planned to study the effects of Gov. Michelle Lujan Grisham's electric vehicle mandate, which requires manufacturers deliver an increasing number of zero- and low-emission vehicles to the state beginning with 43% of model year 2027 cars. Specifically, the study would analyze how the mandate would affect lower income and minority residents.
Patrick Brenner, president of SPPI, said the policy did not take New Mexican residents and their needs into perspective, something the institute wanted to highlight in its research.
The NMTRD declined to comment.
After SPPI filed a complaint to enforce IPRA in state district court, the two parties failed to come to an agreement during mediation.
After a one-day trial in January, 1st Judicial District Court Judge Bryan Biedscheid ruled in favor of SPPI, and NMTRD was required to allow the institute access to MVD databases, and pay $30,796.93 to cover SPPI's attorneys' fees and litigation costs.
"I think what really happened was just a fundamental misunderstanding of their obligations under the Inspection of Public Records Act," Brenner said. "It was not necessarily a malicious attempt to hide data."
Brenner said that while the court ruled in SPPI's favor, he was not necessarily pleased with the results, stating that SPPI could have been awarded more money to discourage the state from inadequately responding to public records requests in the future.
"Unfortunately, Judge Biedscheid split the baby," Brenner said. "He did it in a way where he strategically eliminated any possibility for the institute to appeal because he ruled in our favor, but he removed our ability to collect additional damages by not awarding any of the statutory damages outlined in IPRA."
With the information acquired after the lawsuit, SPPI plans to produce a consumer-facing report that will show the demographics of people who own electric vehicles and the demographics of those who would be negatively affected by the mandate.

The news comes as Blink Charging's stock has faced significant headwinds, plunging over 19% year-to-date. This decline is largely attributed to the company missing analyst revenue estimates for the past four consecutive quarters and EPS estimates for at least two quarters. The stock performance has also been impacted by the Trump administration's recent reversal of EV tax credits. The U.S. House of Representatives approved President Donald Trump's 'Big Beautiful Bill,' which terminates the $7,500 tax credit for new U.S.-made EVs, effective September 30, 2025. This policy change is expected to negatively affect the EV industry and its ecosystem, including companies like Blink Charging, with some automakers already increasing EV prices in response. Despite these challenges, Blink Charging has remained committed to unlocking value through strategic partnerships, acquisitions, and geographical expansions. Last Monday, Blink Charging expanded its partnership with Belgian real estate firm Group Bernaerts to boost EV charging infrastructure across Belgium. By the end of 2025, it plans to install at least 176 active chargers at Bernaerts-owned properties. The stock gained close to 13% after the update. Since the partnership was launched in 2022, the two companies have deployed 88 charging stations in Antwerp and Mechelen. As they accelerate their sustainability goals, they expect to double that number by the end of this year. On July 16, Blink Charging expanded its EV network in South Florida by installing Series 7 chargers at two Accesso-managed commercial properties. The move strengthens Blink's regional presence, bringing clean energy charging to high-traffic sites in Sunrise and West Boca Raton. On July 14, Blink Charging expanded its EV charging footprint by acquiring Zemetric, a Silicon Valley-based fleet-focused infrastructure firm. The deal brings Zemetric's leadership team, now filling key executive roles at Blink, together to accelerate innovation and global growth in smart fleet charging. On July 10, Blink Charging advanced its U.K. expansion by partnering with Axxeltrova to launch a £100 million fund for EV infrastructure growth. Under the deal, Axxeltrova will fund and own the chargers, while Blink installs, operates, and maintains them through its Blink Network. Celcuity Stock Triples on Positive Breast Cancer Treatment Study

Shares of Celcuity (CELC) tripled to an all-time high after the biotech firm announced positive results in a late-stage study of its experimental treatment for adults with two kinds of breast cancer. The company reported primary endpoints were reached in the Phase 3 trial of gedatolisib, combined with two other drugs, palbociclib and fulvestrant, which it calls the "gedatolisib triple." It said the three together reduced the risk of disease progression or death by 76% compared to fulvestrant alone. A "gedatolisib double" combination of gedatolisib and fulvestrant cut risk of disease progression or death by 67% versus fulvestrant alone, also exceeding endpoints. The patients tested suffered from "hormone receptor (HR)-positive, human epidermal growth factor receptor 2 (HER2)-negative, PIK3CA wild-type, locally advanced or metastatic breast cancer, following progression on, or after, treatment with a CDK4/6 inhibitor and an aromatase inhibitor." Dr. Sara Hurvitz, co-principal investigator of the trial, said to her knowledge, "we have not seen Phase 3 results in patients with HR-positive, HER2-negative advanced breast cancer before where there was a quadrupling of the likelihood of survival without disease progression relative to the study control." Dr. Igor Gorbatchevsky, Chief Medical Officer at Celcuity, added that the results showed gedatolisib could be a "transformative new medicine" for the treatment of those breast cancers. The company plans to submit a New Drug Application to the Food and Drug Administration (FDA) for gedatolisib in the fourth quarter.
