The Delhi High Court recently upheld Lata Goel's claim for a ₹90 crore exemption under Section 54F of the Income Tax Act for assessment year 2011–12. The exemption was against capital gains from the sale of FIITJEE Ltd shares, which she reinvested in purchasing a new residential house. The assessing officer (AO) opposed the claim, citing ownership of more than one residential property.
The AO relied on South Delhi Municipal Corporation records indicating Goel co-owned the basement and second floor of a property in Vasant Vihar, New Delhi, to argue that this disqualified her from being eligible for Section 54F.

Court's Observations The court was unimpressed with Gupta's tactics, noting that his senior advocate's conduct was 'unbecoming" and that the strategy of securing repeated adjournments was intended to stall proceedings. Justice Neena Bansal observed that both parties had already argued the matter on two previous occasions, and Gupta's legal team had sought more time to 'take instructions". Allegations Against Gupta The Enforcement Directorate (ED) alleges that Gupta played a pivotal role in designing and operating a sophisticated web of offshore companies to move illicit funds linked to the chopper deal. Gupta, former managing director and executive vice chairman of Emaar MGF Land Limited, allegedly used shell companies to launder Rs 28.7 crore in proceeds of crime. Investigation and Attachment of Assets The ED's investigation has revealed that Gupta established offshore shell companies in tax havens, through which proceeds of crime were routed. The agency has attached properties worth Rs 21 crore belonging to Gupta and is focusing on the final destination and use of the laundered money. The Delhi High Court's judgment is expected to pave the way for further action against Gupta, who has been evading the law since 2019. The Delhi High Court on Wednesday asked the Centre, Delhi government and Delhi Police to respond to a plea alleging traffic violations by e-commerce delivery riders. A Bench of Chief Justice D.K. Upadhyaya and Justice Tushar Rao Gedela ordered the Ministry of Road Transport and Highways, Delhi Transport Department and Commissioner of Delhi Police to file their replies and posted the matter for hearing on October 8. Advocate Shashank Shri Tripathi in his petition alleged 'widespread, continued and unchecked' violations of the Motor Vehicles Act and the Central Motor Vehicles Rules by delivery partners of quick commerce and e-commerce platforms in the Capital. The counsel for the Delhi government informed the court that the government had already introduced a policy for two-wheelers – the Delhi Motor Vehicle Aggregator and Delivery Service Provider Scheme, 2023 – and had notified it on November 21, 2023. The scheme aims to license and regulate aggregators operating in the Delhi region. The court then asked the Delhi government to place on record the policy and for the authorities concerned to provide detailed information about the action taken against the violators. The plea alleged that delivery workers employed or contracted by various platforms routinely use two-wheelers to transport 'oversized, bulky and excessively heavy items,' including industrial toolkits, foldable furniture, and commercial-sized delivery boxes. 'These loads often exceed the permissible dimensions and weight limits under Indian traffic regulations, compromise the stability of vehicles, obstruct the vision of riders and endanger public safety,' it said. 'The continued tolerance of these unsafe delivery practices will create a dangerous precedent that encourages other commercial entities to disregard safety regulations, thereby potentially leading to a complete breakdown of vehicular discipline and road safety standards across Delhi and other urban centers, which would result in irreparable harm to public safety and the rule of law,' the petition said. Nagpur: At least 4,000 taxpayers are under scrutiny for claiming deductions in income tax returns by fraudulently showing expenses towards treatment of terminal illnesses like cancer and kidney failure. Section 80DDB of Income Tax Act allows deductions from taxable income for money spent in treating critical disease and this covers spouse and dependents. The ongoing verification drive by the income tax department led to unearthing of largescale deductions claimed under section 80DDB. This was along with other cases in which taxpayers sought exemption under section 10(6) by claiming to be foreign citizens, said sources. However, this time artificial intelligence (AI) was smarter than tax dodgers, and these were flagged in the system. It all began with the system highlighting 50 suspicious returns filed from Gondia town in the region, which eventually led to a larger investigation and even a nationwide action. The returns were filed through a single email. Of these at least 4,000 taxpayers had claimed to be suffering from illnesses like cancer or kidney failure. This is for Nagpur zone alone — a nationwide search uncovered many more cases, said a source. Earlier, it might not have been possible to pinpoint such cases. Now, with AI tools deployed for deep analysis of data, unusual entries in returns can be flagged easily. The filers can also be traced on the basis of IP addresses, said a source privy to the probe. For example, in the Nagpur case, prompts after prompts led to more cases being thrown up by the system, the source said. Earlier, filers or even tax professionals took advantage of the system and claimed random deductions or exemptions. Most of the time, it was tough to catch as only a handful of returns were taken up for scrutiny. Now, it is easier to keep a tab on such returns with the use of AI, said a source.
