Indian parents face uncertainty over US citizenship for newborns

Time of India25-05-2025

The wait for temporary US visas for soon-to-be-born babies of expectant Indian moms has just gotten longer,
immigration lawyers
told ET.
The challenge to the Presidential executive order on
birthright citizenship
is still awaiting a decision in the Supreme Court of the US (SCOTUS).
Trump's executive order puts the US citizenship of unborn children of foreign nationals including Indians on temporary visa in limbo. This has caused much anxiety among the expecting Indian parents as they throng immigration attorney offices to seek further counsel. While some are even considering shifting to those states that do not recognize the Trump order as of now, an attorney, who did not wish to be identified, told ET.
"The scenario for Indian nationals on temporary visas expecting children in the US is quite uncertain. Depending on the jurisdiction, children born in the US may or may not automatically acquire citizenship," said Sukanya Raman, country head, Davies and Associates. "This is complicating decisions around childbirth and long-term residency planning."

According to experts, about 1.5 lakh newborns annually could be denied US citizenship if the order comes into effect.

Many foreign nationals have in the past used the US' birthright citizenship path to gain legal entry for their offsprings. This has given way to "birth tourism" which refers to the practice where foreign nationals travel to the United States on visitor visas with the primary intention of giving birth. This ensures their children automatically acquire US citizenship under the 14th Amendment.
This trend has been particularly common among women from countries like Russia, China, and Nigeria, said experts. "Recently, a growing number of Indian nationals have also pursued this route," said an attorney.
The SCOTUS deliberations, which started on May 15, primarily focused on the scope of nationwide injunctions rather than the constitutionality of executive order itself, said experts.
Despite being a smaller share, Indian families could be deeply impacted by changes to birthright citizenship laws, given the large number of Indian nationals on temporary visas, say experts. "Our firm has been receiving a continuous flow of inquiries from Indian nationals ever since
Executive Order 14160
was announced," said attorney Prachi Shah who runs her eponymous firm.
Expecting parents on H-1B, H-4, F-1 and OPT visas are queueing up at the immigration lawyers' offices. There is widespread anxiety in the Indian diaspora, said lawyers.
"The executive order is quite egregious," said Rajiv Khanna, managing attorney, Immigration.com.
"For some parents, it's devastating because to have a child in the US after decades of living here and not have them be a US citizen is ridiculous," he said.
It usually takes 10-15 years for people to get a green card in the US for people who are here legally.
"The outcome of the hearing is not clear as to what is going to happen," said Khanna.
"The US Census doesn't collect statistics on the legal status of parents, but roughly 21-25% of babies have at least one foreign citizen parent," said Jath Shao, principal attorney, Shao Law Firm.
"The Trump administration's strategy seems to be arguing technicalities and wanting to impose their changes and make all the individual states and plaintiffs fight it," said Shao.

Embrace ideas, values of Constitution from Preamble Park: Fadnavis, Gadkari

1 2 Nagpur: Bharat Ratna Dr Babasaheb Ambedkar crafted the Indian Constitution by blending global and timeless Indian values, with the Preamble being its core. If citizens embrace the values enshrined in the Preamble, 90% of the country's issues could be resolved permanently, said chief minister Devendra Fadnavis on Saturday. Fadnavis was speaking during the inauguration of the Constitution Preamble Park and a full-length statue of Dr Babasaheb Ambedkar by Chief Justice of India (CJI) Bhushan Gavai on the premises of Dr Babasaheb Ambedkar School of Law. Union minister for road transport and highways, Nitin Gadkari , said the park will spread the Constitution's fundamental ideas among students and the public. Fadnavis stated that it is a matter of great pride and satisfaction for him that the Constitution Preamble Park and Dr Babasaheb Ambedkar's statue are being unveiled at the same law college where he studied constitutional principles and put them into practice. The CM stressed that completion and public opening of this park during the Amrit Mahotsav year of the Constitution is particularly significant. "The Indian Constitution has established a robust democracy, ensuring freedom of expression, fundamental rights, equal opportunities, and a system for delivering justice. This has enabled India to become the world's fourth-largest economy. The Preamble is the essence of the Constitution, and its values need to be embraced by all citizens," he said. Fadnavis expressed confidence that the park will inspire everyone who visits it. He also announced that a new building for the School of Law would be constructed, and all necessary facilities would be provided for the park. Gadkari said Nagpur University took the initiative to establish the Constitution Preamble Park, which was realised with financial support from the state govt and public participation. He highlighted that the university has produced eminent personalities like a Prime Minister, while Dr Babasaheb Ambedkar Law College has given the country two CJIs. "The establishment of the park adds to this legacy," he said. Social justice minister Sanjay Shirsat discussed the financial and other support provided by the social justice ministry for the park's establishment. Senior social activist and chairman of the Constitution Preamble Park Committee, Girish Gandhi, provided details of the park's development stages. Nagpur University acting VC Madhavi Khode-Chaware, School of Law director Ravishankar Mor, Constitution Preamble Park Committee members and others were present on the occasion. Committee member Puran Meshram read out the Constitution's Preamble.

BJP women wing holds mock Parl on 50 years of Emergency

1 2 Kanpur: The Bharatiya Janata Party's women's wing in the Kanpur region organised a grand mock Parliament event at the Kanpur University auditorium. The programme began with the lighting of a lamp by the chief guest, Rajya Sabha MP Rekha Sharma, regional president Prakash Pal, minister Rajni Tiwari, and legislator Pratibha Shukla. On this occasion, a special exhibition based on the Emergency was also inaugurated by Rekha Sharma and Prakash Pal. Addressing the inaugural session, they said that on June 25, 1975, the then Prime Minister Indira Gandhi undermined the Constitution, crippling all major democratic institutions--the legislature, executive, judiciary, and the media. Thousands of opposition leaders were imprisoned under MISA and DIR, and censorship was forcibly imposed on the media. They emphasised the need for women to understand this history and question the moral grounds of those who cite the Constitution today. Prakash Pal questioned whether the Congress still justifies the Emergency or acknowledges it as a violation of the Constitution. As 50 years have passed, the public deserves to know whether Congress leaders will apologise if the Emergency was wrong or explain the rationale behind its imposition. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Ai probleme cu picioarele umflate vara? Cumpără acum Undo The first session of the mock parliament commenced, with legislator Pratibha Shukla, acting as the prime minister, presenting a proposal stating, "The Emergency was the darkest chapter in Indian democracy and requires serious discussion in the House. " The entire assembly supported the proposal by voice vote. In the role of the opposition leader, Women's Commission member Poonam Dwivedi argued that the Emergency was imposed under Article 352, but political motives were predominant. She questioned the decision's legitimacy and criticised the ruling party sharply. Both sessions of the mock parliament saw intense debates between the ruling and opposition sides. The ruling side included Uttar Pradesh minister Rajni Tiwari, legislators Om Mani Verma, district council president Swapnil Varun, legislators Manisha Anuragi, Poonam Sankhwar, former state vice-president of the women's wing Ranjana Upadhyay, Farrukhabad district council president Monika Yadav, block heads Vijay Ratna Tomar, and Anuradha Awasthi, among others. On the opposition side, Women's Commission members effectively presented their arguments and questioned the ruling party's policies. Throughout the sessions, there were several disruptions, which were managed with restraint and firmness by mayor Pramila Pandey, acting as the speaker in the first session, and legislator Neelima Katiyar in the second session. At one point, the proceedings were adjourned.

Markets wrestle method & madness of Trumponomics

You could say the bets are on the madness and the method of Trumponomics. There is a conviction that Trump will wield executive power to protect his image. Soon after the attack on nuclear sites in Iran, as crude oil prices spiralled to $80 per barrel, Trump warned derivative players with capital letters and exclamation marks: 'Everyone, keep oil prices down, I'm watching! Don't do it!' At the Nato summit, when Spain dissented on raising defence spending, Trump threatened higher tariffs. Trump has also repeatedly asserted (despite denials) that he used trade deals to force India and Pakistan to a ceasefire. The idea of Make America Great Again rests on Trump's belief that the heft of the US economy and military must be leveraged to make allies pay for protection and an entry fee charged from others for the privilege of participating in the $29-trillion economy's markets. However, the MAGA dream is haunted by US debt and deficits. In 2024, it ran a trade deficit of $918 billion, federal deficit of $1.83 trillion, and a total debt of $36.2 trillion or 123 percent of the GDP. It is getting worse as the new 'Big Beautiful Bill', as per the non-profit Committee for a Responsible Federal Budget, will add $3.5-4.2 trillion of debt by 2034. There is a method to the madness of Trumponomics. As a solution, Trump has invested in an assembly of disparate ideas—stranded between claims and counter claims—to lift the US economy out. DJT believes tariffs will achieve multiple objectives—it is already garnering revenue of around $30 billion a month, and will bring down trade deficits and force onshoring of output. The foundation rests on cutting taxes and regulation to spur investment, some of which is manifest in the White House's 'running list' of investment declarations by Softbank, OpenAI, Meta, Apple, Nvidia, Micron and others. Trump's trip to the West Asia was geared for geo-economics. He has claimed this has brought over $2 trillion in investments.
