SC refuses to entertain plea against Assam govt's deportation of Bangladeshis, directs petitioner to move Gauhati HC

The Supreme Court on Monday refused to entertain a plea challenging the Assam Government's move to deport Bangladeshis who have entered the country illegally.
A bench of Justices Sanjay Karol and S C Sharma asked the petitioner, All BTC Minority Students Union (ABMSU), to approach the Gauhati High Court. 'Sixty-nine people are being deported, please go to the Gauhati High Court,' the court said.
On February 4, a bench of Justices Abhay S Oka and Ujjal Bhuyan had asked the state to do the needful to deport 63 declared foreigners. The government had then said that it was awaiting confirmation of their nationality. They were subsequently confirmed to be Bangladeshi nationals.
The petition alleged that using this order as an excuse, the state 'has reportedly launched a sweeping and indiscriminate drive to detain and deport individuals suspected to be foreigners…' Citing some of the alleged deportations, the plea argued that 'these instances are not isolated, but part of an emerging pattern where individuals are detained and deported without Foreigners Tribunal declarations, nationality verification by the MEA, or even an opportunity to appeal.'
'These instances reflect a growing pattern of deportations conducted by the Assam Police and administrative machinery through informal 'push back' mechanisms, without any judicial oversight or adherence to the safeguards envisaged by the Constitution of India or this court,' ABMSU claimed.
In a related development, the court also agreed to take up next week a habeas corpus petition filed by a man who alleged that his mother had been picked up for deportation and since then, her whereabouts are not known.
Initially, the bench said it will tag it with a pending plea on illegal immigrants. Senior Advocate Kapil Sibal, however, urged the court to issue notice, so that the state can reply. 'We don't know. Son doesn't know. Let them say. If she is in Bangladesh, it's another matter.' Sibal contended that the arrest of the petitioner's mother violated norms on arrest laid down by the Supreme Court in the D K Basu case.
'Your Lordships know she has to be produced within 24 hours. She is not produced. Picked up from the house. Directly in violation of the DK Basu judgment. SP goes to the house, picks her up and throws her. How can that be?' the senior counsel submitted.
The court issued notice and fixed it for hearing early next week.

Lashing out at the state government over Majithia's arrest, the SAD chief said the case was registered only because Majithia had been 'exposing' the dispensation over various issues. Sukhbir also challenged the CM to prove the disproportionate assets case, asserting that the entire case was based on a bundle of lies. (HT Photo) The Punjab Vigilance Bureau arrested Majithia on June 25 in a disproportionate assets case allegedly involving laundering of ₹ 540 crore 'drug money'. It was Sukhbir's maiden press conference after the arrest of Majithia. Regarding Saraya Industries Limited, he said, 'The only foreign funding received by Saraya Industries was in March,2006 when it received ₹ 35 crore from United States-based Clearwater Corporation in exchange for 25% shares in the company. Majithia entered politics in 2007.' He also made it clear that all transactions of Saraya Industries were scrutinised and accepted by the Income Tax department. Sukhbir also challenged the CM to prove the disproportionate assets case, asserting that the entire case was based on a bundle of lies. Sukhbir asserted that Mann had pressurised the state DGP to register the case because 'Majithia had been constantly exposing him and his corrupt and immoral cabinet colleagues'. He termed the government action 'vendetta politics'. 'An affidavit which the government had submitted to the Supreme Court in 2023 while appealing for cancellation of Majithia's regular bail and seeking his custodial interrogation in an NDPS Act was used verbatim to register this new case against him. This was done despite the fact that the Supreme Court rejected the affidavit in April this year and refused to overturn the regular bail given to Majithia by the high court or grant the request for custodial interrogation,' Sukhbir said. The SAD chief further said that the apex court even asked the AAP government to complete the probe in two days 'following which it has now taken this new route to engage in political vendetta'. He also condemned the manner in which former DGP Siddharth Chattopadhyaya and ex-deputy director of Enforcement Directorate Niranjan Singh were called by the Vigilance Bureau to share information regarding the drug case. He claimed that his party had conclusive proof of the corrupt activities of the CM and his wife.

Ukrainian Ambassador to India, Oleksandr Polishchuk, stated that Dhaka has not responded to a confidential diplomatic communication regarding grain shipments. Ukraine will now further investigate, as its intelligence indicates that Russian entities are blending grain from occupied Ukrainian territories with Russian wheat before export. Ukrainian Ambassador Termed It A Crime 'This is a crime,' Polishchuk said in an interview at the Ukrainian embassy in New Delhi. 'We will share our investigation with our EU colleagues, and we will request them to take appropriate measures,' he said. Bangladesh Food Ministry Issued Statement A Bangladeshi food ministry official stated that Bangladesh would have prohibited Russian grain imports had they originated from occupied Ukrainian land. he said that the country does not import stolen wheat. It is to be noted that, amid the ongoing war with Russia, the agriculture sector remains one of the main sources of income for Ukraine, which supplies grain, vegetable oil and oilseeds to foreign markets. In April this year, Ukraine detained a foreign ship and alleged that the vessel was involved in illegal trade. EU Imposes Sanctions On 32 Ships The European Union has sanctioned 342 vessels involved in Russia's 'shadow fleet,' alleging these ships help Russia evade Western sanctions on oil, weapons, and grain exports. Russia maintains that these sanctions are unlawful.
