WWICS chief's conviction upheld in Forest Act case

Mohali: A local court on Monday upheld the 2009 conviction of Col Baljit Singh Sandhu (retd), owner of WorldWide Immigration Consultancy Services (WWICS), in a case under the Forest Conservation Act, 1980, but granted him probation instead of jail time.

The order was pronounced by additional sessions judge Prashant Verma.
Under the probation terms, Sandhu will now serve his sentence under the supervision of a probation officer, allowing him to remain in the community rather than face incarceration. The decision effectively offers the convict a chance to rehabilitate under legal scrutiny, in accordance with provisions of criminal law.
Advocate Amit Mandkan, counsel for Sandhu, said they plan to challenge the sentencing further.
"We will file for revision of the sentence in a higher court," he said.
The case pertains to a violation of Section 2 of the Forest Conservation Act, 1980, for which Sandhu was convicted by the chief judicial magistrate, Rupnagar, on Sept 17, 2009. The conviction was made under Section 3(A) of the Act, which deals with penalties for unauthorised use or diversion of forest land.
Sandhu filed an application seeking compounding of the offence under Section 359(5), corresponding to Section 320 of the CrPC, 1973.
He argued that the offence should be compoundable under Section 68 of the Indian Forest Act, 1927, which permits certain forest-related offences to be settled out of court.
However, the application was rejected by the Divisional Forest Officer, Mohali, and subsequently contested by the State. The prosecution maintained that the Forest Conservation Act, 1980 does not contain any provision to compound offences, and Section 68 of the 1927 Act applies only to specific offences listed under that statute.

The court concurred with the State's argument but granted probation considering the long-pending nature of the case and other mitigating factors.
The court's decision highlights the legal complexity in cases involving overlapping provisions of environmental laws and underscores the distinction between compoundable and non-compoundable offences under different forest legislations.
While the probation order spares Sandhu from immediate jail time, the legal battle appears far from over as the defence prepares to pursue further relief through appellate forums.

Sanjeev Kumar, alias Sanjeev Mukhiya, a key accused in the NEET 2024 question paper leak case, has been granted bail. The CBI special court, located within the civil court premises, has ordered his release from judicial custody. This decision was made according to Section 167 of the Code of Criminal Procedure (CrPC), which stipulates that a charge sheet must be filed within 90 days of arrest. Regarding the NEET-2024 exam question paper leak, conducted by the National Testing Agency, the special CBI court at Patna Civil Court has granted bail to Mukhiya. He had submitted an application to Judge Sunil Kumar Singh, stating that he had been in judicial custody for 90 days, but the CBI had not yet filed a charge sheet against him. After hearing arguments from both sides, the court applied Section 167 of the CrPC and ordered Mukhiya's release on bail. It is noteworthy that the NEET exam was held nationwide on May 5, 2024. Amar Kumar, the in-charge of Shastrinagar police station in Patna, arrested several individuals for tampering. The case was later transferred to the Economic Offenses Unit. When the question paper leak came to light, the central government handed the investigation over to the CBI, which registered its FIR on June 23, 2024. Since then, the investigation has been ongoing. To date, 49 individuals have been arrested in connection with the NEET question paper leak case. The CBI filed the initial charge sheet against 13 accused on July 1, 2024. Subsequently, the first charge sheet against 6 individuals was filed on September 19, 2024. The second supplementary charge sheet was filed on October 7, 2024 against 21 accused in jail, followed by a third supplementary charge sheet against one individual on November 7, 2024. The fourth supplementary charge sheet was filed against four individuals on November 22, 2024. New Delhi, Aug 2 (UNI) The Delhi High Court has upheld the conviction of three Delhi Police personnel in a 2013 sexual harassment case including a woman and her minor niece, directing the convicts to surrender before the trial court within five days. The Court ruled that no leniency will be granted given the nature of the offence and the fact that the convicts were law enforcement officers who violated the very law they were meant to uphold. The three convicts, Jaidev, Jagmal, and Suraj Bhan alias Monu were found guilty under various sections of the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act. The Court noted that the incident occurred in May 2013 and involved repeated misconduct by the convicts, who were also neighbours of the complainant. The High Court observed that the convicts, despite being public servants, had persistently engaged in inappropriate behaviour, including making vulgar gestures, sexually explicit remarks, and, in one instance, indecent exposure in the presence of the complainant and her niece. The Court rejected claims for leniency based on the age, health conditions, or family responsibilities, citing the seriousness of the offences and their prolonged nature. The judgment showcased that the case did not merit a rehabilitative approach due to the aggravating circumstances, including the convicts' positions in the police force and the repeated nature of the acts. The Court further noted that other FIRs had been registered by the complainant in subsequent years, indicating ongoing harassment and misconduct. Citing Supreme Court precedents, the High Court highlighted that sentencing must be proportionate to the gravity of the crime and serve as a deterrent, especially when the perpetrators hold positions of authority. The Court concluded that a punitive approach was necessary to restore public confidence in the justice system. Kerala nuns arrested in Chhattisgarh in ‘forceful conversion' case granted bail

An NIA court in Bilaspur Saturday granted bail to three people, including two nuns from Kerala, who were arrested recently in Chhattisgarh's Durg district in an alleged forced conversion and human trafficking case. A sessions court had earlier disposed of the bail application reasoning that the matter should be heard by the National Investigation Agency (NIA) court in Chhattisgarh's Bilaspur district. The nuns, Preeti Marry and Vandana Francis, and one more person, Sukaman Mandavi, were arrested last Friday at the Durg railway station in Chhattisgarh on allegations that they were involved in forceful conversion and human trafficking. The FIR, registered under sections of the Chhattisgarh Religious Freedom Act and the Immoral Traffic (Prevention) Act, was based on a complaint by a local Bajrang Dal worker, who alleged that the accused forcibly converted three women from Narayanpur district and were attempting to traffic them.
