‘We want to assess your fairness': Madras High Court seeks reports on probe into temple guard's custodial death

Taking a stern view of the custodial death of a temple security guard in Tamil Nadu's Sivaganga district, the Madurai Bench of the Madras High Court on Tuesday directed the state government to submit reports and summoned key witnesses, including the man who filmed the victim being thrashed.
After the hearing, the case was transferred to Tamil Nadu CB-CID and Sivaganga SP Ashish Rawat put under 'compulsory waiting'.
B Ajith Kumar, 27, was picked up on June 28, a day after a devotee filed a complaint that 10 sovereigns of gold were missing from her car, which Ajith had helped park near the Madapuram temple.
After being questioned and released, a special team later detained Ajith. Witnesses alleged that he was beaten in front of his brother, Naveen, taken to multiple locations, including the cattle shed, and collapsed before being declared dead at a hospital.
Hearing a PIL in the matter Tuesday, a Division Bench of Justices S M Subramaniam and A D Maria Clete sought the preliminary findings from the Thirupuvanam Judicial Magistrate and the post-mortem report from the Dean of the Government Rajaji Hospital in Madurai by 3 pm Tuesday. The court also directed the Executive Officer of the Badrakaliamman temple and one Shakthieeswaran, who had recorded the video, to appear before it.
The purported video shows Ajith Kumar on the floor of what appears to be a cattle shed near the temple and being assaulted with a stick by a man while two others watched. The footage, believed to have been recorded by a temple employee, has gone viral on social media, sparking fresh outrage.
Questioning the legality of his detention, petitioners submitted before the court that no written complaint was filed against Ajith Kumar. They alleged that ruling party functionaries tried to broker a settlement by offering the family Rs 50 lakh and a government job.
The High Court reminded the officials that 'police cannot be the investigators in a case against themselves'.
'This is not mere negligence,' the court observed. 'We want to assess your fairness by seeing what action is taken against higher officials,' the court said, and asked why a special team interrogated Ajith Kumar outside the police station to avoid CCTV surveillance. 'Even if the team acted independently, senior officers are still accountable,' the bench said.
After the hearing, the Tamil Nadu Police transferred the case to the CB-CID. DGP Shankar Jiwal on Tuesday put Sivaganga SP Ashish Rawat in 'compulsory waiting' at the DGP's office in Chennai. Ramanathapuram SP G Chandeesh has been given additional charge of Sivaganga. Manamadurai DSP Shanmugasundaram — the special team that detained Ajith Kumar reported to him and under whose jurisdiction the incident took place — was suspended.
Five police personnel were arrested late Monday night and booked for murder based on eyewitness statements and post-mortem findings which revealed 30–40 injury marks, including trauma to the head and lower body of Ajith Kumar. Those arrested are Head Constables Kannan (Pazhayanur police station) and Prabhu (Manamadurai police station), and Grade I Constables Raja (Poovandi police station), Anand (Sivaganga Traffic), and Sankaramanikkamthan (Thirupuvanam police station). Police driver Ramachandran was suspended.
Condemning the government's initial response, BJP state president Nainar Nagenthran alleged, 'The rapid cremation, police denial, and coercion of the family point to systemic rot', and demanded a probe by a central agency.
Tamilaga Vettri Kazhagam (TVK) president Vijay demanded that a special investigation team under the court's supervision take over the probe and accused Chief Minister M K Stalin, who also holds the Home portfolio, of failing to ensure justice. 'The government acted only after the court stepped in. People will not forget this,' he said.

The Aurangabad bench of the Bombay High Court on Friday passed an interim order directing the Maharashtra government to register FIR within one week in custodial death of Somnath Surwayanshi, a labourer picked up by the police in December, 2024 following protests in Parbhani. The HC directed that FIR be registered based on the complaint filed by Somnath's mother on December 18, 2024, making allegations against police officers and that investigation be handed over to the officer of the Deputy Superintendent of Police (DySP) rank. The court observed that there was 'prima facie material on record' to show that 'cognizable offence was made out', therefore the state should have registered the FIR. Suryawanshi (35), a labourer who was pursuing law, was among nearly 50 people arrested by the Parbhani police on December 11, 2024 following violent protests staged against December 10 vandalisation of a replica of Constitution outside Parbhani Railway station. Suryawanshi, belonging to a nomadic tribe, died in judicial custody in a local jail on December 15 last year, which police claimed was due to heart attack. A division bench of Justices Vibha V Kanknanwadi and Sanjay A Deshmukh passed an interim order on plea by Vijayabai Vyankat Suryawanshi, mother of Somnath, who alleged that he died due to custodial torture and brutality by police officers. The government had transferred the probe from local police to the state CID. Advocate Prakash Ambedkar, appearing for the mother, argued that despite the Judicial Magistrate having inquired into custodial death under section 196 of the Bhartiya Nagarik Suraksha Sanhita (BNSS), the state government was not ready for registering FIR and taking further action. The magistrial inquiry had concluded that the police officers were responsible for his death. The petitioner, among other prayers, sought from court the direction to the state government to register FIR under section 103 (punishment for murder) and other provisions of Bhartiya Nyay Sanhita (BNS) along with sections of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Justice Kankanwadi observed that in case of any medical query about death of a person, the inquiry or investigating usually approach the medical officers who conducted the autopsy. However, in the present case, 'interestingly, the Deputy Superintendent of Police, State CID, has taken his own decision to make queries and seek opinion from a team of medical experts from JJ Hospital (state run), Mumbai and the Committee appears to have given a report on April 4, 2025 to Deputy Superintendent of Police, state CID, Parbhani.' The HC said that while it would not express opinion at present, the question that required to be gone into was why he did not seek an opinion of the seven-member team from Chhatrapati Sambhajinagar that conducted the autopsy. Justice Kankanwadi for the bench perused 'entire record' and noted that there were 24 visible injuries as per postmortem report along with internal injuries. 'The question would then arise as to who has caused those injuries,' HC said. As per records, the bench said age of injuries was between few hours to four days before the death and all abrasions were between two to four days before the death and the team of seven doctors had given a probable cause of death as 'shock following multiple injuries'. 'Now, when there was prima facie material on record i.e. on the basis of inquest panchanama, postmortem report, report of Judicial Magistrate First Class under Section 196 of BNSS and the complaint application by the petitioner, a cognizable office was made out and, therefore, State ought to have registered the FIR. The guidelines in Lalita Kumari v. State of Uttar Pradesh, were prima facie made out,' the HC held. 'We are of the opinion that the material which she was placing before the police, were sufficient for registration of the FIR,' the HC held in its interim order, posting further hearing on other prayers in the plea to July 30,

Mangaluru: An alleged cattle thief, who was on the run for nearly two years, was arrested by Mangaluru CCB police on charges of selling MDMA. The accused is Abdul Kabir alias Parivala Kabir, 36, from Kasaba Bengre, Mangaluru. Police seized 12.1 grams of MDMA from his possession. Acting on a tip-off that MDMA was being brought from Bengaluru and Mumbai to Mangaluru and sold to the public and students in a white car near Mudipu Kambala Padavu KIADB Road, CCB police launched an operation on Thursday and intercepted the vehicle while the suspect was attempting to sell the drug. Police recovered MDMA worth Rs 1.2 lakh, a digital weighing scale, a mobile phone, and a car from his possession. The total value of the seized assets is estimated at Rs 4.3 lakh. A case was registered at Konaje police station. The accused, Abdul Kabir, is a habitual offender with over 15 cases of cattle theft registered against him in various police stations, including Panambur, Mangaluru South, Mangaluru North, Mangaluru East, Kankanady Town, Ullal, Bajpe, and Uppinangady in Dakshina Kannada district, as well as Madikeri Rural police station in Kodagu district. He obtained bail in many of these cases but was absconding for nearly two years.

1 2 Dibrugarh: Sivasagar police on Friday arrested a suspect and identified three others in a case where Rs 10 lakh was looted from a postal department employee in broad daylight. One of the identified suspects is a postal employee, who allegedly provided crucial information to the perpetrators. The incident occurred on Thursday around 11.45 am, when two assailants on a motorcycle attacked Bipul Dutta at Raichai in Demow, while he was transporting cash from the Head Post Office in Sivasagar to Nitaipukhuri sub-post office. The robbers snatched the money and assaulted Dutta, breaking his teeth. Addressing the media, Sivasagar additional SP (Crime) Moidul Islam said, "The police have cracked the snatching case of Rs 10 lakh from a postal department employee in Sivasagar within 24 hours," Islam said. The swift police response involved a comprehensive investigation that relied heavily on CCTV footage analysis. Through meticulous examination of surveillance cameras, investigators were able to identify and arrest one Tultul Duwari. Duwari's confession proved instrumental in unravelling the entire conspiracy. Saikia is accused of providing critical information about the cash transfer to the criminal gang. According to the investigation, the robbery was carefully orchestrated. Biki and Mintu, riding a motorcycle, followed Bipul before launching their attack. CCTV footage revealed that the two perpetrators were seen communicating with the other accused before executing the crime.
