Oxford judge raps 'costs padding' no win, no fee solicitors

A judge has characterised the work undertaken by a firm of no win, no fee solicitors as "costs padding" in the case of a three-year-old boy who was injured on a farm.Sopley Farm, near Christchurch, Dorset, agreed to pay damages of £3,600 for the boy's cut lip, Oxford County Court heard.However, District Judge Richard Lumb said there was a suspicion that the costs reported by personal injury firm Express Solicitors, who represented the boy, may have been "artificially inflated" in order to reach a cap.The firm, in Wythenshawe, Greater Manchester, said it offered good value, was clear about its charges and had not received any complaint from its client.
Judge Lumb said the firm's accounts showed nearly 90 hours of work by 14 fee earners, "all at hourly rates which were very significantly higher than the SCCO [Senior Courts Costs Office] guideline hourly rates for Manchester". The incurred costs of £29,641.80 were way in excess of the £1,860 recoverable from the defendant, he noted.His judgement continued: "It would appear that the solicitors were prepared to undertake tens of thousands of pounds worth of work for which they were not going to be paid."Any objective observer would consider that to be a very odd way for solicitors to conduct business."The judge added: "The file reveals a considerable amount of duplication of work both by individual and other fee earners."There is also a considerable amount of non-progressive work undertaken that could properly be characterised as 'costs padding'."The judge said it raised a suspicion that the costs were overstated in order for the firm to ensure that its fee would reach a capped level.However, he said the cap would have been reached in any case, and the firm could claim a £900 success fee from the damages.In a statement, Express said its practice was to agree a maximum amount by way of a percentage deduction that clients would ever have to pay.Chief executive James Maxey said: "In this case the judge awarded the deductions but was somehow unhappy that the costs exceeded the pitifully low fixed costs."An awful lot of work was done but the contract limited the total charges to the client to an amount which ultimately the judge approved."

'We can confirm this incident occurred on the 18th July 2025 at approximately 00:50 hours, not on the 31st July as suggested by a recent anonymous Facebook post.' It comes just a few weeks after 'Pantherman' was spotted quite literally prowling around gravestones in Merseyside. A person dressed in a catsuit has been terrorising locals after being spotted stalking people along secluded paths and reportedly leaping out from behind gravestones. The mysterious figure, dressed in a skin-tight black cat suit and mask, was captured on camera meowing and writhing on the ground near Wallasey Beach, Merseyside. Footage shows the person wriggling under a fence near a Harvester pub in the Wirral before prancing along a path. Another video shows people in a car screaming as the figure approaches close by. Residents claim he resembles a 'banshee,' 'urban jaguar' and even a 'gimp' and locals like Abbie Gilbert have said the community are trying to hunt 'him or it' down. But Abbie said she saw the funny side and told Metro: 'I really found the whole thing quite amusing and I can't believe how many people in Wirral have also had encounters and are aware of him. 'From everyone's sightings, the Pantherman is harmless although he does look scary. I really don't think he's dangerous, just a bit strange.' It was one of four indictments leveled against the president-elect after he left office in 2021. Trump was charged with conspiracy to defraud the US, obstruction and conspiracy to obstruct, and conspiracy against rights. The case never made it to trial before the presidential election and was subsequently dropped following Trump's victory. However, Smith's findings were published just one week before Trump's inauguration, when he will be sworn in as the 47th president. Smith's report claimed Trump tried to retain power after losing to Biden by "using fraud and deceit." He also claimed Trump pressured election officials at the state level in a desperate bid to try and change the results. Trump was also said to have pressured then vice-president Mike Pence, who was President of the Senate, to change the election result, according to the report. Smith revealed that his team had "admissible evidence," which he believes would've helped them get a conviction against Trump - had he not won the 2024 election. "The department's view that the Constitution prohibits the continued indictment and prosecution of a president is categorical and does not turn on the gravity of the crimes charged, the strength of the government's proof, or the merits of the prosecution, which the office stands fully behind," the report said.
