Affordable housing development in Batavia gets first green light from city: ‘I think this is something that we need'

A proposed subsidized multi-family housing project in Batavia recently received the first green light from members of the City Council, many of whom are touting the project as filling a gap in affordable housing in the city.
On May 19, the Batavia City Council OK'd a request from the project's developer — Fox River Affordable Housing, a nonprofit arm of the Housing Authority of Elgin — to fund $1.2 million in land acquisition and engineering costs using the city's TIF, or tax increment financing, reserves, per a memo from the city's Community and Economic Development Director Scott Buening included in the meeting agenda.
The total cost of the project is expected to be just over $24 million.
Called The Residence at River Point, the proposed project is set to be built on the 400 block of South River Street, which officials say is a former limestone quarry site.
The proposed development would include 72 units, according to a proposal included in the City Council's meeting agenda. Of those, 18 would be set aside for households earning at or below 30% of the area median income, or AMI. In addition, 38 units would be set aside for households earning at or below 60% of the area median income, and 16 for those earning at or below 80%.
The area median income is a regional calculation and accounts for the Chicago metropolitan area, according to the Housing Authority of Elgin's Executive Director and Chief Executive Officer Martell Armstrong.
According to Chicago's Department of Housing, the median family income for the Chicago-Joliet-Naperville metropolitan area was $119,900 for a family of four in 2025. Income limits related to the AMI are adjusted for family size, however. For example, a single individual could qualify under the 80% limit if they made $67,100 or less, and under the 30% limit if they made $25,200 or less, whereas a family of four would qualify under the 80% limit if they made $95,900 or less, or $35,970 for the 30% limit.
The project was generally well received by City Council members, who at recent meetings cited a need for more housing of this variety in the area.
'When I got my first apartment, it looked an awful lot like this,' City Council member Dustin Pieper said at a Committee of the Whole meeting in May. 'There's definitely a need for that. Especially in our community, there's a lot of younger folks who want to be working here, want to be living here. This would be great for that, I think.'
City Council member Alan Wolff said not enough of this sort of housing is being built in the area, and that restrictions on constructing multi-unit buildings may be partially to blame.
'I think this is something that we need,' he said.
According to a 2023 statewide report from the Illinois Housing Development Authority on the Affordable Housing Planning and Appeal Act, Batavia's share of affordable housing — defined as being within the means of homebuyers making 80% of the regional median household income or renters making 60% of the regional median household income, per the authority — was at 23.5%. That's well above the 10% threshold that requires communities with low levels of affordable housing to submit a plan to the state as to how they'll build out a diverse housing supply. In Kane County, for example, Campton Hills, Lily Lake and Geneva all fell below 10%, according to the report.
However, the percentage of affordable housing stock in Batavia is still significantly lower than some of its surrounding cities, like Aurora and Elgin, whose affordable housing stock is each over 50%, according to the 2023 report.
A shortage of multi-family housing is not unique to Batavia, said Thomas Skuzinski, an associate professor at Northern Illinois University's Department of Public Administration, whose work focuses on local government management and who has previously done research on affordable housing.
'There's not as much multi-family (housing) as there could be,' Skuzinski said. 'There is just overall an imbalance that strongly favors single-family, detached homes. And that's pretty consistent across the U.S.'
And an uptick in young adults who deferred moving out of their family homes during the COVID-19 pandemic and a growing population of seniors on fixed incomes has only intensified the demand in the past few years, he said.
Local officials' concerns
While there was generally support from the city about the project, council members at the recent Committee of the Whole meeting also outlined some of their stipulations related to the project in Batavia.
City Council members Kevin Malone and Abby Beck, for example, said they wanted to ensure the final product prioritized biking and pedestrian safety and accessibility. Jim Fahrenbach said he would support the project if it went through, but he thought too few of the units were allocated for those earning 80% of the average median income and noted that none of the proposed units were market-rate.
'We have lost a pipeline, and the question is, 'How do we replace that?'' Fahrenbach said. 'A lot of this neglect of having these apartment complexes for folks to come in in their 20s and enjoy the community and grow into the community and then save for a home, is gone. So we need to replace it.'
Fahrenbach told The Beacon-News it's well-known that Batavia needs more affordable housing, and said that this project, while it doesn't provide market-rate units, could increase development activity in the area and spur on market-rate projects.
All of the units in the proposed project would have income-related stipulations, though the rent price tenants pay would be determined individually by the tenants' income and number of people in the household, Armstrong told The Beacon-News. The actual costs of the units are based on the size and number of bedrooms — about $315,000 per unit is what they're expecting.
In terms of the project's classification, Armstrong also noted that 'affordable housing' is more of an umbrella term, and referred to the project as having an 'income mixing range' of 30% to 80% of the AMI. 'Workforce housing,' he explained, tends to refer to housing for households making 60% to 80% of the AMI.
Batavia Mayor Jeffery Schielke noted that the limestone in the area might make the site challenging to build on and add possible unaccounted-for costs. But there have not been many affordable housing projects in Batavia in recent years, he told The Beacon-News, and he believes the demand is there for this sort of project.
And the project could put that land to good use, Malone said at the May 19 City Council meeting and 'turn a literal rock field into someplace people can live.'
Funding the project
But, despite securing an early stage of city approval, the money isn't to be spent yet on the project, City Council members clarified before approving the request for the TIF funding. It's merely a promise of funding down the line, once the project is determined to be feasible. Armstrong said at a meeting with the City Council that Fox River Affordable Housing needed this promise from the city in order to submit its application for the Illinois Housing Development Authority's Low Income Housing Tax Credit, which he said would provide the project with a considerable portion of its total funding.
The TIF money that the developers plan to use is also to be paid back to the city, in a way. Assuming the project continues, the city would allocate the $1.2 million, which would go toward the purchase of the land set at about $1 million along with soft costs like engineering and architectural plans, according to Buening. The city's approval is conditional on the proposal being taxable, Buening said, and its proposed location is within the city's TIF District 3, meaning it would generate TIF funding.
Essentially, a TIF district freezes the amount of property tax revenue each taxing body receives from an area at the point at which the TIF is instituted. The extra or 'increment' taxes created by the development of the property go into a special fund used to pay for costs related to improving the area.
The goal is to secure the land by the end of this year and begin construction immediately after, Armstrong said. But whether the project moves forward at all, he said, is contingent on the project being awarded the Low Income Housing Tax Credit developers are applying for.
The Low Income Housing Tax Credit is a dollar-for-dollar federal tax credit, according to IHDA's website, that helps move affordable housing projects forward. The maximum rent that can be charged on a property that receives this tax credit is 80% of the AMI — which is why there are no market-rate units in the proposed development. Rents are typically capped for a 30-year period in Illinois.
What's next?
Armstrong said that Fox River Affordable Housing and Housing Authority of Elgin expect to hear back about whether they've been awarded the tax credit later in June. He said the project would likely not be able to move forward without that funding source.
The developers also have to enter into a redevelopment agreement with the city, Buening noted, and go through the zoning process.
Should all go as planned, Armstrong said, the project's aim is to close on a deal for the land by the end of the year and immediately begin construction, as long as there are no major obstacles that push back their timeline.
There are several factors that can slow down affordable housing projects, Skuzinski noted.
In general, gaining public and city support for projects can require overcoming negative perceptions of affordable housing developments.
'There's a perception that property values go down whenever an affordable housing project or even a mixed-income project … go in, and that's just not true,' Skuzinski said. 'It has more to do with the design of the building, sort of what it looks like, how well it's managed.'
Additionally, because affordable housing developments tend to have slimmer profit margins and less options for obtaining loans, Skuzinski noted, the loss of one source of funding can slow down or jeopardize the project.
Amid discussion of the project at a meeting in May, Malone inquired about the availability of federal funding with regards to the project.
Low Income Housing Tax Credit is a federal funding source that's allocated by state agencies, in this case the Illinois Housing Development Authority. But, while President Donald Trump's administration has slashed the budgets of a number of government programs, the housing tax credit appears to be safe for now. It could potentially even see an influx of cash if the Senate leaves that part of the recently passed House of Representatives' budget bill as is.
Federal funding aside, Armstrong said the costs of materials and labor and interest rates have all driven up the price of construction since the pandemic, and they've made the Housing Authority of Elgin move more slowly and be more selective with what projects it takes on. And the added uncertainty of possible tariffs could also change their plans or slow progress.
And, for the housing authority, unlike developers intending to sell their developments, there's also the added component of managing the property.
'We are generally in it for the … lifespan in the building,' Armstrong said.
That's something the Housing Authority of Elgin wants to do more of, he said. It currently manages 164 units of Low Income Housing Tax Credit properties, he noted, but have a third-party entity that manages some of its other properties. They've also co-developed some projects, but intend to be the sole developer on the Batavia units.
Armstrong said the authority worked with the city of Batavia to identify this potential project and the proposed location.
'I'm not in the business of going somewhere and telling them what's good for them,' Armstrong said.
But the housing authority is willing to work with cities which identify a need for affordable housing, he said.
And, with projects like these, he said one of its goals is helping individuals of different income levels live in the same community.
'We're trying to deconcentrate poverty and do this in areas of opportunity,' Armstrong said, 'where people can have pride and lives in areas that provide jobs and education and so on.'
These kinds of projects are one way of supporting social mobility for both low-income and working class individuals and families, Skuzinski noted.
'There can be a benefit to allowing for social networking and ties across income classifications,' Skuzinski said. 'One of the best ways to do that is either through affordable housing projects that are in higher-income neighborhoods, or through projects that are themselves mixed-income. And it seems like the one in Batavia's trying to kind of do both.'
And, despite the challenges affordable housing projects bring, he said he thinks this project is well-positioned to move forward.
'When you have professionalized local governments working with a developer that's well-known, that's when these can be a recipe for success,' Skuzinski said. 'Why wouldn't you want to go ahead with something like this?'

Aurora City Council to vote on doubling hotel room tax

Aurora is considering doubling its hotel room tax rate, which has not risen since it was first adopted in 1987. The city's Hotel Occupancy Tax rate is currently set at 3%, but many nearby communities have higher rates that are similar to what is being proposed, according to Chief Financial Officer Chris Minick. He estimates that the proposed 6% rate would bring in an additional $1.1 million for the city each year, especially after the opening of the new $360 million Hollywood Casino-Aurora resort. The proposal is set to go before the Aurora City Council for final approval at its upcoming meeting on Tuesday, when the council is also set to consider extending a 1% tax on groceries that would otherwise expire statewide at the end of this year. There are currently around 635 hotel rooms within city limits, with an extra 220 expected to come from the new casino resort, Minick told the City Council's Committee of the Whole at its meeting last Tuesday. At its current rate and number of hotel rooms, the city brings in between $550,000 and $585,000 each year, he said. That money mostly goes into the city's General Fund to offset operational costs, Minick said, but the city also uses around $225,000 per year to support the Aurora Area Convention and Visitors Bureau. The proposed increase of this particular tax has a number of benefits, according to Minick. For example, he said that the tax is mainly paid by people who are not residents of Aurora, and it is discretionary. Plus, people do not typically shop for hotel rooms based on the tax rate, but instead based on how close they are to whatever attraction the person is looking to visit, Minick told the Committee of the Whole. Because of how close hotels in Aurora are to amenities, he expects there to still be significant demand for those rooms, he said. The Hotel Occupancy Tax only applies to the price of the hotel room itself, not to other costs like room service. The proposed changes to the tax not only double the rate but would also add a $10 daily flat fee on rooms offered for free, which Minick said is a common practice at casino resorts. If passed by the Aurora City Council on Tuesday, the new higher rate would go into effect on Jan. 1, 2026. The new Hollywood Casino resort is expected to open in the first half of 2026, according to past reporting. The proposed Hotel Occupancy Tax rate increase was recommended for approval by the Aurora City Council's Finance Committee earlier this month, though committee chair Ald. Ted Mesiacos, 3rd Ward, voted against it. Mesiacos also voted against recommending the local 1% grocery tax for approval at that same meeting. He told The Beacon-News just before Tuesday's Committee of the Whole meeting that he voted against the grocery tax because it would negatively impact the residents he represents. Illinois first put in place the 1% grocery tax in 1990 to help fund local governments, but it was repealed by a state bill passed last year. However, that bill allowed cities and villages to set their own tax to replace the statewide one, which Aurora is considering doing. Gov. JB Pritzker, who signed the bill, has said the statewide grocery tax hurts poorer people in particular because it takes a larger chunk of their income, according to reporting from the Chicago Tribune. For the same reason, Mesiacos said the tax should be reduced for communities like the one he represents. The grocery tax does not apply to those who receive benefits from the national Supplemental Nutrition Assistance Program, also called SNAP. However, after the Trump administration's megabill was passed and signed on July 4, many SNAP recipients may receive lesser or no benefits in the near future. Area elected officials criticized the federal tax and spending bill last week, saying it would hurt local residents. Aurora currently receives around $4.5 million in revenue through the grocery sales tax each year, and without those funds helping pay for public safety, road maintenance, public works, community programs and environmental services, the city would likely need to look to alternative funding sources or make cuts to services, city officials have said. And, as pointed out by Ald. Carl Franco, 5th Ward, at Tuesday's Committee of the Whole meeting, the city has been 'painting a picture that we're fiscally challenged right now.' Mayor John Laesch has made similar comments about the city's finances in the past, and even said during his inauguration speech in May that the city is in 'serious debt,' that his administration needs to get the city's 'financial house in order' and that residents will likely be seeing a property tax increase. The grocery tax is a significant piece of funding for the city, Franco said, and asking residents to pay $1 for every $100 they spend on groceries for the city to get millions of dollars each year doesn't feel like a stretch, especially since other communities are doing the same thing. Cities and villages have until Oct. 1 to approve the local continuation of the 1% grocery sales tax, which would take effect on Jan. 1, 2026, just after the tax expires statewide. Many nearby communities have already approved local extensions of the tax, including Montgomery, Sugar Grove, North Aurora, Batavia, Geneva and St. Charles, as have others throughout the Chicago area and the state. Naperville, in contrast, is considering increasing the city's sales tax to compensate for its lost state grocery tax revenue, according to the Naperville Sun.

Steve Weinshel: Cutting parking requirements while upzoning Broadway will create a crisis

One of the key aspects of Mayor Brandon Johnson's continued push for more housing development in Chicago is eliminating the city's parking mandates for new multifamily housing construction. It is a major component in Johnson's 'Cut the Tape' initiative intended to boost more affordable housing. While many of us might hope for a utopian future in which the average Chicagoan no longer owns a car, that is distinctly not the current situation. To pretend otherwise invites chaos throughout Chicago. The Johnson administration is attempting to rush through the City Council an ill-conceived and massive upzoning of Broadway from Montrose to Devon avenues in Chicago's Uptown and Edgewater neighborhoods. This change would allow for an additional 10,000 units to be built along this stretch of Broadway in addition to the thousands of units that current zoning already allows. A cornerstone of this plan is to radically reduce the number of parking spaces required in new large-scale housing developments. All of Broadway lies within a transit-oriented development zone due to its proximity to the Red Line and several bus lines. As such, developers are required to provide only one parking space per two housing units. But this is only the city's opening hand for reduced parking requirements. Under the city's Connected Communities ordinance, developers may reduce that one parking space per two-unit requirement even further, even down to no off-street parking at all. For example, several projects currently in development or recently completed in Edgewater provide as little as one parking space per 10 units or less. As a 35-year resident of one of Chicago's densest neighborhoods, I am no stranger to high-density urban living. I live in the Kenmore-Winthrop area of Edgewater, which together with Sheridan Road immediately to the east, is home to roughly 20,000 housing units, making it among the densest census tracts not only in Chicago but also the nation. To contemplate adding 10,000 housing units along Edgewater's adjacent stretch of Broadway with minimal off-street parking requirements constitutes urban planning malpractice. Such lunacy will plague Edgewater for generations to come. Anyone familiar with the east side of Edgewater knows that street parking is already virtually nonexistent. There is also a major shortage of off-street parking for current households. Many of the buildings in the area were built long before car ownership was common and have little or even no off-street parking of their own. Residents, even in higher-end condominiums, are forced to seek off-street parking elsewhere, such as in the neighborhood's many four-plus-one apartment buildings. Historically, residents could find such spaces within a block of where they lived. But in recent years, as parking pressures have continued to increase, residents now often have to venture several blocks or more from home to find a rentable space. As a result, countless drivers now repeatedly circulate throughout the area looking to win the parking space lottery, posing great risk to pedestrian safety and compromising air quality. The Chicago Department of Planning and Development's proposed framework for Broadway is predicated on the wishful thinking that people living near mass transit are substantially less likely to own cars. But that is simply not borne out by the facts. Car ownership rate for homeowners in Edgewater is 1.3 cars per owner-occupied household, according to Ownership rates for renters in the community are somewhat lower but are still 0.9 vehicles per household. Those figures are similar for the Uptown and Rogers Park communities adjacent to Edgewater. Even data provided by the city as part of its case for the Broadway upzoning framework demonstrates the point that it's creating a parking nightmare. That means more cars will be coming to Edgewater if its 'visions' are realized. Where these vehicles will go is anyone's guess, but city bureaucrats and their housing density mouthpieces try to deny this reality. Many new residents will likely aggravate current practices of illegally parking in front of fire hydrants, in handicapped zones, blocking alley entrances and corner tow zones that are essential for the passage of school buses and emergency vehicles. As a major artery for traffic coming off of DuSable Lake Shore Drive, Broadway is already a busy, relatively narrow corridor. It currently has metered parking and numerous business loading zones, but these may soon be disappearing with increasingly dense residential development. Intensified residential development will inevitably bring even more double parking for ride-share and delivery vehicles, which have already exploded in recent years. Before the city moves forward with any additional housing in Edgewater or Uptown, it needs to carefully study the car ownership rates for residents and limit additional housing accordingly. It could also help its own housing cause by requiring developers to proactively address parking problems by establishing car-sharing programs in new properties. Most neighborhoods abutting the CTA's Red, Brown and Blue lines on the North Side are already quite dense. Substantial new housing development has already been coming to all of these neighborhoods, especially along major commercial streets such as Broadway, Clark, Ashland, Western, Milwaukee, Irving Park, Montrose and Lawrence, even under old zoning standards. But does this mean these neighborhoods have endless capacity for further densification? There is a tipping point, and too much development in these communities threatens to greatly diminish the quality of life for future residents as well as the many thousands of current residents who have worked hard for decades to eradicate urban blight in Edgewater. If the Department of Planning and Development is serious about enhancing Chicago's north lakefront neighborhoods, perhaps it ought to actually do some planning.

New committee rakes in big dollars to influence Virginia Beach election referendum

VIRGINIA BEACH — A new political group backed by local business leaders and elected officials is raking in large donations in its bid to alter Virginia Beach's election system. Every Vote Counts, a referendum committee, has raised more than $330,000 since forming June 9, according to finance reports filed with the Virginia Department of Elections. The committee is gearing up to launch a campaign to persuade Virginia Beach residents to vote 'no' to a district-only election system in November. The committee wants a City Council with seven district-based seats and three seats elected at-large along with the mayor. A referendum question on the ballot this year will ask voters whether they prefer that alignment or the current system, which has 10 single-member districts. 'More citywide representation is good,' said former council member Linwood Branch, the mouthpiece for the group. Virginia Beach's former all at-large election system was overhauled after a federal judge ruled it unconstitutional in 2021, finding it diluted the voting power of minority voters. The city then shifted to the 10-1 election system, with three majority minority districts. But the city has faced lawsuits challenging the validity of the current iteration based on the way changes were adopted. The referendum is the latest in a string of efforts to garner public feedback on how the city should elect its school board and council members. The effort already has drawn support from high-profile business leaders, pulling in a steady stream of donations — ranging from $2,500 to $25,000. The committee is an unstructured group, according to Branch. The group's treasurer is Jack Ross, former president and COO of Dominion and Landmark Media enterprises, which used to own The Virginian-Pilot. Ross collects the funds and Davis Ad Agency is running the promotional campaign. However, multiple business leaders and current and former elected officials are also using their connections to support the effort. Among them are former Virginia Beach Mayor Will Sessoms, developer Bruce Thompson and councilmen Stacy Cummings and Cash Green. 'It's been largely word-of-mouth,' Ross said. Earlier this month, Bob Taylor and his brother, Joe, owners of Taylor's Do-It Centers, each made $10,000 donations to Every Vote Counts in support of an election system with some at-large representation. 'I think it's a much better blend than what we have now,' said Bob Taylor. Sessoms, his longtime friend, approached him about the committee and a donation, he said. Sessoms did not respond to a request for comment. Thompson, who declined to comment, is among 'many prominent supporters,' Branch said. The Pilot also reached out to several donors who did not respond, including Virginia Beach Development Authority member and developer Taylor Franklin, CEO of Franklin Group Companies LLC., which made a $20,000 donation on June 17. Donna Whitaker, a principal broker for Venture Realty Group, the firm behind the Atlantic Park project, contributed $10,000 on June 24. She confirmed the donation but didn't respond as to why she supported the committee. Cummings contributed $10,000 to Every Vote Counts on July 7. He believes the current 10-1 system divides the city. Cummings has served as the District 8 representative since January. 'I'm sitting in these council meeting and invariably, in every meeting, you have people saying my district, my district, my district,' Cummings said. 'It's an impediment of growth for the city, and we're not holding people accountable.' Seven people/businesses have donated $25,000 so far, the largest amount to the effort. They are Pramod Amin of Shamin Hotels; MEB General Contractors Inc.; Manan Shah of Pashm Global Hotel and Resort Management; Brian Holland of Atlantic Bay Mortgage Group; Robert Beasley of Harvey Lindsay, Sunsations Inc.; and Michael Sifen of Sifen Companies. Under the city's previous election system, which was ruled illegal, residents across the city could vote for all 10 council members and the mayor. Under the current system, residents can only vote for the member who represents their district and the mayor. One of Every Vote Counts' key arguments for more at-large representation is that it will increase accountability to voters. 'There's no better accountability then being able to vote for or against someone,' Branch said. 'I believe as a former elected official, if someone can vote for or against you, it does make a difference in your accessibility.' The group will launch a website, next week and other promotional material to get the word out before early voting begins Sept. 19, Branch said. Green, who has represented District 7 since January, will appear in a testimonial video. 'Under the 7-3-1, we can keep strong minority voting district and add the chance for more minority leaders to be elected city-wide,' Green said in the video, which Branch shared with The Pilot before its public launch. 'By voting no to 10-1, you're taking back the power to shape the future of our city, our schools, our neighborhoods, our quality of life.' The referendum will pose the question: 'Should the method of city council elections set forth in the Virginia Beach City Charter be changed from a modified 7-3-1 system to a 10-1 system?' That Branch is involved in the effort should come as no surprise. He and four other residents sued the city last year, saying Virginia Beach acted illegally in 2023 when it revised the election system because the General Assembly did not authorize a change to the city charter. A judge ruled last month that the district-based election system Virginia Beach imposed to comply with federal voting rights law is void. Circuit Judge Randall Smith stayed the order until after the referendum vote. If the city decides to pursue a 7-3-1 system, Smith would lift the stay so Virginia Beach can redraw its voting districts, which would need to be analyzed to see if they meet the federal standard, according to the court proceedings' transcript. Virginia Beach's voting system shake-up came after a federal judge ruled in 2021 the at-large voting system violated the federal 1965 Voting Rights Act because it 'denies Hispanics, African Americans and Asians equal access to the electoral and political process.' The same federal judge — Randall Jackson — officially reopened the case while lambasting city officials for what he described as intentionally sidestepping federal law by pursuing the referendum question. To date, Virginia Beach has spent more than $2 million defending the city in the federal lawsuit, according to the city attorney's office. Mayor Bobby Dyer met Wednesday with Virginia Attorney General Jason Miyares to ensure that holding the referendum is 'above board,' Dyer said. Miyares, who lives in Virginia Beach, previously said he believes the city can bring back several council seats that would be elected at-large. After meeting with Dyer, his legal analysis remained unchanged.
