CBI books city man for encashing fraudulent TDS refunds using PAN loophole
Nagpur: After a probe by the income tax department revealed that fraudulent refunds on tax deducted at source (TDS) were availed by a former bank staffer, Central Bureau of Investigation (CBI) has booked a Nagpur resident, Rattandeep Borkar. Tired of too many ads? go ad free now He allegedly misused his login credentials from the time he was working for Canara Bank, which later discontinued him, but the credentials were left active. Borkar identified cases where the TDS was deducted but the permanent account number (PAN) was not available. Taking advantage of the gap, he filed revised returns claiming refunds in such cases. However, this time he inserted PANs of persons known to him, and tweaked the system so that he got the tax refunds in their names. Borkar inserted PANs of 92 persons in entries where the PAN was not available in the bank records. Total refunds of over Rs1.26 crore were availed, and the persons whose PAN was used also got a cut, says the FIR. The CBI first information report also covers unknown officials of the PSU bank, noting that the fraud could not have happened without insider connivance. TOI had reported that tax sleuths are probing a TDS refund claim in a PSU bank in April. Based on the probe, the CBI registered an offence now. Borkar is alleged to have misused the original conso file and the unique token numbers in the systems. He then identified the cases from the financial year 2011-12 to 2018-19 and downloaded the latest TDS returns for revision. He also modified the files using the file validation utility and return preparation utility, as well as forging Canara Bank officials' signatures. The income tax department too has sent notices to the beneficiaries. The refunds were revised from July 2023 to September 2024. The allegedly fraudulent returns were filed in Gandhi Nagar, Sitabuldi, Ramdaspeth, and Sadar branches of the bank. Meanwhile, sources said mainly senior citizens who get interest on their accounts generally don't have PAN. Such accounts were particularly identified and exploited.
