
‘Slapp addict' Italian oil firm accused of trying to silence green activists
The company had previously limited itself to civil defamation lawsuits, including against ReCommon, but in Tricarico's case it initiated criminal proceedings over statements he had made in a television interview.
'There is intimidation against myself, for sure, which is not nice and is impacting daily work,' said Tricarico, who is now considering the energy and resources that would be needed if the case goes to trial. 'But I think the intimidation is broader.'
Environment groups say Eni is engaging in a campaign to stifle critics, with the company having filed at least six defamation lawsuits against journalists and NGOs since January 2019.
The publicly traded company, which is under the de facto control of the Italian economy ministry, is among the world's biggest historical polluters in terms of planet-heating gas. It plans to increase its underlying production by 3-4% a year over the course of the decade, even as roadmaps to stop the planet from heating call for rapid declines in fossil fuel use.
Court documents show Eni has initiated legal proceedings against critics including the Italian public broadcaster Rai, Greenpeace and multiple newspapers. The company has sought more than €10m (£8.6m) in damages across the known cases, according to analysis shared exclusively with the Guardian by Aria, a non-profit research organisation. Eni's latest lawsuit does not seek compensation.
Judges have ruled against Eni in three of the cases and another was resolved in a settlement agreement. Two more cases, including the criminal investigation into Tricarico and a civil case against Greenpeace and ReCommon, are continuing.
Simona Abbate, a climate and energy campaigner at Greenpeace Italy, said: 'Eni is trying to silence dissent. It's an international strategy that fossil companies use to limit the environmental movement.'
Campaigners say the cases are examples of 'strategic lawsuits against public participation', known as Slapps, which can bully journalists and watchdogs into silence with the threat of spurious legal action that stands little chance of success. Eni disputes the characterisation.
In April, a coalition of NGOs including Reporters Without Borders and Transparency International awarded Eni the title of 'Slapp addict of the year' for its defamation lawsuits. The groups highlighted Eni's 2024 case against Greenpeace and ReCommon after they sought to hold Eni accountable for climate damages.
The company is responsible for 0.46% of global emissions since the Industrial Revolution, according to figures from the Carbon Majors database that include emissions released by customers burning its fuels. Eni's case against the NGOs seeks to stop them from characterising its actions as 'crimes' or using similar language in campaigns.
A spokesperson for Eni said it 'has not only the right but the duty to turn to the judicial authorities when faced with false and defamatory statements that damage its reputation'.

They said: 'It is important to note that Eni has not initiated any Slapp suits against environmental groups, as it has not sought any financial compensation, but only the judicial truth to which it is entitled.'
In earlier defamation lawsuits that Eni lost, mostly concerning coverage of the acquisition of a Nigerian oilfield licence, the company had sought damages of €5m and €350,000 from the Italian newspaper Il Fatto Quotidiano and €5m from Rai. Eni was eventually acquitted of criminal charges in the corruption trial, which was brought about by NGOs including ReCommon.
Climate activists and oil companies are increasingly turning to the courts as fights over pollution and public opinion have become more fraught. While several oil and gas companies have been criticised by free speech campaigners for using legal threats to fight off critics, Eni has filed more lawsuits against journalists and environment groups than other European oil majors are known to have done.
Tricarico said there had been 'a change of pace' since Eni's attempts to claim damages from media organisations had failed, and it was now taking a more subtle approach by not asking for money.
'The company realised that probably this was not enough to stop the few critical voices – and actually was a pretty bad outcome in court,' he said. 'My feeling is that they are moving to a different approach that you might call a 'Slapp 2.0'.'

Starmer endorses UN's high-tax manifesto
Labour has paved the way for higher taxes on the wealthy, alcohol and fossil fuels by signing Britain up to a new United Nations pact. Ministers have endorsed the global agreement, which calls for greater environmental levies and 'gender-responsive taxation'. The UK's participation represents another break with Donald Trump, who pulled the US out of the deal over concerns about its provisions on tax. It comes after Rachel Reeves warned that taxes may have to be increased again in the autumn to plug the hole left by Labour's welfare rebellion. The Tories warned that Sir Keir Starmer was deliberately making it 'harder for a future government to reverse Labour's tax rises'. Known as the Sevilla Commitment, the UN agreement was thrashed out between 192 countries at a five-day summit in Seville, Spain, last week. While ostensibly focused on drumming up more development cash for poorer states, the final text of the deal contains 42 references to taxation. 'High net worth' There are specific mentions of taxes on 'high-net-worth individuals', as well as tobacco and alcohol, natural resources and pollution. Britain also signed up to a series of declarations on the side, including one that promotes higher taxes on unhealthy products such as sugary drinks. Gareth Davies, the shadow Treasury minister, accused Labour of 'outsourcing tax policy to organisations that don't reflect the priorities of the British people'. 'People want to see their taxes reduced and simplified, not increased and complicated to fund vacuous virtue signalling by global elites,' he said. 'This will only make it harder for a future government to reverse Labour's tax rises.' The commitments in the deal are not legally binding, meaning that they could not be used to force through the adoption of domestic tax policies. But critics warned that signing up to the pact shows the Government was locking Britain into a permanent course of ever higher taxation. One part of the pact encourages the 'broadening of the tax base', including a crackdown on the 'informal sector', which includes cash-in-hand payments. Elsewhere it says that signatories will 'promote progressive tax systems' and 'enhance efforts to address tax evasion and avoidance by high-net-worth individuals and ensure their effective taxation'. 'We will also promote effective and equitable government spending,' the text adds. In some passages the deal suggests specific tax rises that countries should introduce. 'We encourage effective taxation of natural resources that optimises domestic revenue,' it states, a reference that could cover North Sea oil and gas. 'We will consider introducing or increasing taxes on tobacco and alcohol, as a non-distortionary tax source with a clear potential to increase domestic revenue and reduce the risk factors of noncommunicable diseases,' another section adds. Elsewhere, the agreement says that countries should consider the environment, biodiversity, climate, and food security when setting their budgets. 'While respecting national sovereignty, options may include, but are not limited to, green budgeting, taxation and fiscal rules; and taxes on environmental contamination and pollution,' it states. One part of the deal says that signatories will 'promote gender-responsive budgeting', as well as 'advance discussion on gender responsive taxation'. A senior UN official said that the commitment 'outlines what to do with every kind of money – national, international, public, and private'. The agreement comes amid fears that Ms Reeves is lining up a series of fresh tax raids in the autumn as she struggles to fill an estimated £30 billion black hole. Labour MPs are openly pushing for new wealth taxes, while 'sin taxes' on alcohol, sugary and salty foods, and gambling could also be considered. Donald Trump pulled the US out of talks on the pact last month, with the White House warning that the proposed text 'crosses many of our red lines'. The US president had objected to tax measures in the deal and also wanted the references to climate, gender equality and sustainability removed. Alongside the main deal the UK also signed up to several declarations drawn up during the five-day conference in Seville. One is titled 'Accelerating Health Taxes: The 3 by 35 Initiative' and promotes a World Health Organisation bid to increase levies on alcohol, tobacco and sugary drinks. It included a commitment to 'broaden political and societal support for health taxes'. Another, called the 'Coalition for Tax Expenditure Reform', focuses on efforts to remove what it calls 'harmful' and 'ineffective' tax reliefs.

As Britain chases net zero, this town's emissions are soaring
Slough has emerged as Britain's fastest-growing pollution hotspot, with its surging data centre industry driving up greenhouse gas emissions. The southern town's concentration of more than 30 massive data centres has pushed up commercial emissions by 52pc since 2005 – making it the only place in the UK to see such a rapid rise in pollution. Slough's total emissions equate to five tonnes of CO2 for each of its citizens – far above the three tonnes per person seen in traditional industrial areas such as South Tyneside, the 3.7 tonnes recorded in Newcastle upon Tyne and the four tonnes recorded in Sunderland. The figures come from the latest government data on the UK's local and regional greenhouse gas statistics, which said Slough stood out from Britain's other council authority areas. 'All but one of the UK's 361 local authority areas have seen a reduction in commercial emissions since 2005,' said the report, covering emissions from 2005-2023. The one authority that saw an increase is Slough, where commercial sector emissions increased by 52pc between 2005 and 2023. This increase may be because of the large number of data centres that have been built there.' The government data shows that Slough's total commercial emissions rose from 183,000 tonnes of CO2 in 2005 to 280,000 tonnes in 2023. By contrast, the emissions from the entire North East of England – a much larger area – fell from 2.9m tonnes in 2005 to just 960,000 tonnes in 2023. It means emissions per person in the North East fell from 13.4 tonnes to just 3.1 tonnes – far lower than in Slough, and a direct consequence of the collapse of energy-intensive industries in the region. 'The North East of England was the region with the largest proportional fall in emissions over this period, at 67pc, in part due to industrial closures,' said the report. 'Data centre alley' Slough's massive increase in commercial greenhouse gas emissions is linked to the arrival of an estimated 31 large data centres. The concentration of data hubs – one of the densest on the planet – has seen Slough described as 'Europe's data centre alley'. Its explosive growth is linked to its proximity to London plus its positioning on the arterial cabling that links London to other countries including the US. This means Slough has high transmission speeds – essential for meeting the demands of financial institutions, technology companies and companies that stream movies, which all need minimal delays in data transfer. Slough has long had a negative reputation – perpetuated partly by past poet laureate Sir John Betjeman's famous poem of the same name whose first line reads: 'Come friendly bombs and fall on Slough!' Dexter Smith, Conservative leader of Slough Council, said the new figures were a bombshell because of the borough's aim of becoming carbon-neutral by 2040, with ambitions to achieve this by 2030. He said Slough's hopes of improving life expectancy for its citizens – currently 10 years lower than in surrounding boroughs – lay in opening the way for more such high-tech developments. 'I would be devastated if the explanation for this data was down to Slough's high concentration of data centres … We have 31 data centres with more on the way. Planning applications will have to comply with operating requirements that include stringent control of emissions and being carbon neutral,' he said. The Data Centre Alliance, trade body for the industry, said Slough's surging commercial emissions showed it was becoming a success story. Venessa Moffat, executive director, said: 'Slough offers access to one of the largest business and financial ecosystems in the world without the real estate costs and power constraints of central London. 'Every text sent, app downloaded, or movie streamed uses IT housed in data centres. But it's not data centres that pollute – it's the demand that we, as human beings, put on our digital infrastructure.'
