Court ‘yes' to Sabar's request for additional documents in Territorial Sea Act case

By: Jo Ann Mool Text Size: A declaration that the territory of Sabah, after the annulment of the Proclamation of Emergency of 1969 on June 19, 2012, includes the continental shelf under the North Borneo (Alteration of Boundaries) Order in Council 1954; Kota Kinabalu: The High Court here on Friday granted leave to the Sabah Action Body Advocating Rights' (Sabar) to produce additional documents in its action in challenging the Territorial Sea Act (TSA) 2012. Judge Alexander Siew How Wai in its ruling granted the plaintiff's application to seek leave to adduce additional 500 pages of documents from the British archives on the colonial office correspondence leading up to and after the North Borneo Order in Council (Alteration of Boundaries) 1954 and North Borneo Order in Council (Definition of Boundaries) 1958. In September 2023, the originating summons was filed by Sabar's chairman Datuk Dr Johan Arriffin Samad disputing the validity of the TSA, which limits the State's maritime boundary to only three nautical miles and named the government of the Federation of Malaysia as the sole defendant. The plaintiff is also seeking a declaration that the Continental Shelf Act 1966 and Petroleum Mining Act 1966 is inapplicable, unconstitutional, invalid, null and void in the territory of Sabah after June 19, 2012; A declaration that the territory of Sabah, after the annulment of the Proclamation of Emergency of 1969 on June 19, 2012, includes the continental shelf under the North Borneo (Alteration of Boundaries) Order in Council 1954; A declaration that the Mining Ordinance 1960 is valid in Sabah after June 19, 2012; A declaration that Section 3(3) Territorial Seas Act 2012 which limits the territorial waters of Sabah to three nautical miles is inapplicable, unconstitutional, invalid, null and void in Sabah as of June 22, 2012; A declaration that the territorial waters of Sabah, after the annulment of the Proclamation of Emergency of 1969 on June 19, 2012, includes the 12 nautical miles of sea under the Convention on Territorial Seas and Contiguous Zone 1958 and North Borneo (Definition Of Boundaries) Order In Council 1958; cost and any further or other relief deems fit. Earlier, in Friday's proceedings the defendant's counsel informed the court that the parties agreed and no objections to the application and requested for three months to file the affidavit in response. Siew directed the plaintiff to file the 500 documents by May 23; the defendant to file any response and other documents by Aug 22 and the plaintiff to file any reply by Sept 22. He fixed Oct 3 for further mention. KUALA LUMPUR: His Majesty Sultan Ibrahim, King of Malaysia, today presented the instrument of appointment to the new Chief Justice, President of the Court of Appeal, Court of Appeal Judges, and High Court Judges at Istana Negara. The ceremony, held at the Singgahsana Kecil (Minor Throne Room), was also attended by Prime Minister Datuk Seri Anwar Ibrahim, Deputy Prime Ministers Datuk Seri Dr Ahmad Zahid Hamidi and Datuk Seri Fadillah Yusof, Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said, and Chief Secretary to the Government Tan Sri Shamsul Azri Abu Bakar. According to a Facebook post, during the ceremony, Sultan Ibrahim presented the instrument of appointment for the position of Chief Justice to Datuk Wan Ahmad Farid Wan Salleh, who then took his oath of office and loyalty before the King. His Majesty also presented the instruments of appointment for the President of the Court of Appeal to Datuk Abu Bakar Jais, followed by the appointment of Datuk Azizah Nawawi as Chief Judge of Sabah and Sarawak. In addition, instruments of appointment as Court of Appeal Judges were awarded to Dr Shahnaz Sulaiman; Datin Paduka Evrol Mariette Felix Michael Peters; Ong Chee Kwan; Datuk Mohd Radzi Abdul Hamid; Leonard David Shim; Nadzarin Wok Nordin; Datuk Meor Hashimi Abdul Hamid and Muniandy Kannyappan. He took aim at decisions made by the Federal Government without consulting the Sabah Government, among others, the federal announcement on the joint oil and gas development in Ambalat waters. Datuk Seri Shafie Apdal as Chief Minister had amended the Sabah Land Ordinance in November 2018 in the State Assembly, to refine the definition of land in Sabah to include the area of the continental shelf as stated in the North Borneo (Alteration of Boundaries) Order in Council 1954. This is to ensure protection of Sabah's rightful territories should there be any dispute in the future. The amendment is in line with the existing provisions under the MA63 and Article 1(3) of the federal constitution which provides that the territories of any State are territories comprised therein immediately before Malaysia Day. Ambalat waters is within the boundaries stated in the Order in Council 1954. It is constitutionally wrong of the Federal Government to infringe on Sabah's property (the Ambalat waters) without consultation with the Sabah Government. Prosecution seeks to reinstate Isa Samad's corruption conviction at top court

PUTRAJAYA: The Federal Court has fixed Oct 29 to hear the prosecution's appeal to reinstate nine corruption charges involving former Felda chairman Tan Sri Mohd Isa Abdul Samad. Deputy public prosecutor Afzainizam Abdul Aziz said the date was fixed by deputy registrar Wan Fatimah Zaharah Wan Yussof during a case management proceeding today. He said the court also instructed them to file their written submissions before Oct 14. The charges involved RM3 million in bribes allegedly linked to the purchase of the Merdeka Palace Hotel & Suites (MPHS) in Kuching, Sarawak. The prosecution is seeking to reinstate the High Court's 2012 decision, which found Mohd Isa guilty and sentenced him to six years' imprisonment and a fine of RM15.45 million, in default of 18 years in prison. The prosecution filed the notice of appeal on March 7 last year and submitted the petition of appeal on June 26, listing 24 grounds as to why the Court of Appeal erred in acquitting Mohd Isa. The prosecution said the Court of Appeal was wrong in law in finding there was evidence from Ikhwan Zaidel indicating that Mohd Isa had never requested gratification from him in the two meetings with him in his office. The prosecution said Muhammad Zahid, who was one of the prosecution's witnesses, had understood the words to mean that anything given by Ikhwan should be accepted by him on behalf of Mohd Isa. It said the Court of Appeal made a contrary finding that the statement could not, in a literal sense, be interpreted as a specific request or directive to Muhammad Zahid to solicit a bribe from Ikhwan. The prosecution also argued that the Court of Appeal's findings of fact were inconsistent with the factual findings made by the High Court, which were based on evidence adduced through Muhammad Zahid and Ikhwan, both of whom were found to be credible witnesses. On March 6, 2024, a three-judge Court of Appeal panel led by Datuk Vazeer Alam Mydin Meera, sitting with Datuk Ahmad Zaidi Ibrahim and Datuk S M Komathy Suppiah, unanimously overturned Mohd Isa's conviction and sentence. In his judgment, Vazeer Alam said there was no credible evidence to prove the existence of a code word "salam" (allegedly linked to the corruption charges) between Mohd Isa and his former special officer, Muhammad Zahid Md Arip. In 2018, Mohd Isa, now 75, was charged with nine counts of accepting bribes totalling RM3,090,000 from Ikhwan, then a director of Gegasan Abadi Properties Sdn Bhd (GAPSB), through Muhammad Zahid, as a reward for helping to approve the purchase of the hotel by Felda Investment Corporation Sdn Bhd (FICSB) for RM160 million. The offences were allegedly committed on the 49th floor of Menara Felda, Persiaran KLCC, between July 21, 2014, and Dec 11, 2015. The charges were framed under Section 16(a)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, punishable under Section 24(1) of the same Act, which carries a maximum sentence of 20 years' imprisonment and a fine of not less than five times the amount of the bribe or RM10,000, whichever is higher, upon conviction.
