How do personal pension contributions affect what Universal Credit I receive? STEVE WEBB replies

I'm on Universal Credit and make contributions into a personal pension in addition to my workplace pension.
Unfortunately, I've had trouble persuading Universal Credit to deduct my personal pension contributions from my income.
Could you confirm that my pension contributions are deductible?
And do you know if they deduct just the amount I pay in, or do they deduct the full amount that goes into my pension which includes the tax relief from HMRC?
Steve Webb replies: The good news is that for people on Universal Credit, the money that you pay into any pension is deductible from your income before your UC is calculated.
By paying into a pension, your disposable income is lowered and this means you get extra UC compared with someone who isn't contributing to a pension.
This makes saving into a pension even more attractive for people on benefit than it is for many other groups.
As you have found, whilst the Department for Work and Pensions handles all of this automatically when it comes to contributions made through your pay packet, many people have reported problems getting them to accept that personal pension contributions which you make directly are also deductible.

The rules are however quite clear.
According to the Universal Credit Regulations 2013, the DWP should deduct any pension contribution you make and not just those made through a workplace pension.
The exact wording (from Section 55 of the regulations) is:
'(5) In calculating the amount of a person's employed earnings in respect of an assessment period, there are to be deducted from the amount of general earnings or benefits specified in paragraphs (2) to (4)—
(a) any relievable pension contributions made by the person in that period'
You will see that it says *any* pension contributions and not just those made through a workplace pension.
For people who are self-employed, and who declare their income to DWP through the standard UC forms for the self-employed, they should be prompted to provide information about their pension contributions alongside information about their profits from self-employment.
These contributions should automatically be deducted from their profits before UC is calculated.
But in your case, DWP will not know about the personal contributions that you have made and so you have to notify them each time you make a contribution so that this can be taken into account when your UC is worked out.
One other question which arises is exactly what figure they should use.
As you probably know, when you pay directly into a personal pension this is topped up by HMRC.
For example, if you pay in £80, HMRC will add £20 giving a 'gross' contribution of £100. The £20 is pension tax relief awarded at the basic rate.
Those who are higher rate taxpayers can fill in a tax return and claim back additional tax relief.
In the old system of working tax credits, which was based around people's gross income, it would have been the full £100 'gross' pension contribution which was deducted.
However, under Universal Credit a recent benefit tribunal case in which I was involved has confirmed that for UC purposes it is the 'net' figure which should be deducted.
In the example where you pay £80 which is topped up to £100 by HMRC, it is the actual amount that you paid in – the £80 – which is the correct figure to be used in the calculation.

A taxpayer contacted HMRC as they were owed a refund HMRC has explained the rules around tax refunds and how long they take to arrive. The update came after a taxpayer contacted a taxpayer as they were expecting to receive a refund. ‌ They asked over social media: "I had a call yesterday about a tax refund, guy on the phone said a cheque will be sent, anyway you guys can confirm whether it's been processed? As on my gateway it's still showing me I can claim the money." ‌ A person can manage some of their tax affairs by setting up a Government Gateway and personal tax account, on the website. You can use your account to claim a tax refund, as well as to submit and manage a self assessment tax return. ‌ HMRC replied to ask the person if they had asked HMRC to call them about their refund and if they had shared any personal details with the representative they spoke to, such as their bank details. The customer said they had called up to ask why they couldn't claim the cash online. They were told it was too late to claim the amount online and that HMRC would have to send out a cheque instead. The person said they did not share any bank details on the call. HMRC then asked if the person they spoke to had told them whether or not they had "completed the referral to arrange a replacement repayment". ‌ To this the customer responded: "I think he said they can only do a cheque and I think he said that's done for you and then the call ended, but I didn't get a email confirming it or anything like that and on my gateway it still says I'm owed money." HMRC then explained: "If it's the first time this repayment is being issued by cheque, then it can take up to 2-3 weeks. You won't get any notifications about this yet." The website states that if you get a P800 tax calculation letter informing you that you are owed a refund, if you claim the amount online it will take up to five working days to arrive. If you ask for HMRC to send you a cheque, it can take up to six weeks to arrive. However, if your letter states that HMRC will send you a cheque, this should arrive within 14 days of the date of the letter. If you are owed tax for more than one year, you will get a single cheque for the entire amount. The guidance explains: "Your tax calculation letter will tell you if HMRC will send you a cheque. You do not need to contact HMRC to make a claim - you'll automatically get the cheque by post."

Trump tariffs land 100-year-old Stilton maker with £800k bill

Donald Trump's trade war has landed one of Britain's oldest Stilton cheese makers with an £800,000 bill. Bill Mathieson, chief executive of the 114 year-old Long Clawson Dairy, in Leicestershire, said the company would be forced to pay almost £1m in extra levies because of new US tariffs – despite Sir Keir Starmer signing a trade deal with Donald Trump. Mr Mathieson said: 'We've got about £10m of sales going into the US … you take that and we've ended up with an increase of just under £800,000. The trade deal has had no impact in terms of benefit for dairy [producers]. It's certainly not helpful.' Under the terms of Sir Keir's trade deal with the US, tariffs on British steelmakers were reduced to zero, but a 10pc levy remained on other goods including cheese such as Long Clawson's. Mr Mathieson said the company would be forced to increase the price of some of its cheese exports as a result, but that it would be unlikely it could fully recover the impact of the tariffs through price rises. However, he added: 'We might take a bit of a hit, but actually we're very positive about the opportunities that exist in the US. Our strategy will be to try and offset [tariffs] by going out and winning new business.' Founded in 1911, Long Clawson Dairy is Britain's largest producer of Stilton cheese and produces a significant amount of the world's supply. Mr Mathieson also warned that the company faces a barrage of extra costs closer to home owing to tax rises on employers brought in from April. He said: 'Just through National Insurance (NI) contributions and [a 6.7pc increase in the] National Living Wage, it impacted us to the tune of about £1.5m.' He said the company was having to raise its prices as a result. Food bosses have repeatedly warned that raising the cost of employment will fuel inflation. Food prices rose by 4.5pc in the year to June, climbing from a rate of 4.4pc in May. This was the fastest rate of food inflation since February last year. Mr Mathieson added: 'We have to pass this on, because we don't have the margins, and we don't want to be another Stilton that goes to the wall because we no longer make money in our business.' Many of Britain's Stilton makers have closed in recent years as the cheese has suffered from a lack of demand. Arla, the UK's biggest dairy company, said last year it would end production at its 244-year-old Tuxford & Tebbutt Creamery in Melton Mowbray, Leicestershire, if it was unable to find a buyer. Long Clawson has spent recent years battling to rejuvenate the image of Stilton and convince Gen Z shoppers of its merits, working with celebrity chefs and social media influencers. Mr Mathieson said this project was now bearing fruit and that sales of Stilton and blue cheeses were growing strongly. He added that the company was working on developing a more mild Stilton to help appeal to younger people who have not developed a taste for the intense flavour of traditional Stilton. He said: 'What we've been told is that a younger generation, they'd like something that's a bit more of an entry point into blue cheese. So we've developed a Stilton that is milder and a lot more buttery.'
