High Court acquits all 12 convicted in 2006 Mumbai train blasts case

India Today3 days ago
The Bombay High Court on Monday acquitted all 12 men who were convicted of the 2006 Mumbai train bombings that killed 189 people and injured over 800. The acquittal came nearly two decades after the serial blasts shook Mumbai's suburban railway network.A division bench of Justices Revati Mohite Dere and Gauri Godse read out the operative part of the order, pointing out serious flaws in the prosecution's case. The court observed that key witnesses were unreliable, identification parades were questionable, and confessional statements were extracted through torture.advertisement"The defence had raised serious questions about the test identification parade. Many witnesses remained silent for unusually long periods, some over four years, and then suddenly identified the accused. This is abnormal," the bench noted.
One witness, the court found, had deposed in multiple unrelated crime branch cases, including the Ghatkopar blast case, making his testimony 'unreliable'. Several others failed to explain how they could suddenly recall and identify the accused after years. The judges also highlighted procedural lapses. "Some witnesses were not even examined during the trial. As for recoveries like RDX and other explosive material, the prosecution could not establish that the evidence was sacrosanct until it reached the Forensic Science Laboratory," the bench said.Observing "non-application of mind", the High Court concluded that the prosecution had "thoroughly failed" to prove its case beyond reasonable doubt. "It is difficult to say that the prosecution can sustain its charges," the bench held, quashing the special Maharashtra Control of Organised Crime Act (MCOCA) court's October 2015 judgment that had sentenced five to death and seven to life imprisonment.Of the 12 originally convicted, one, Kamal Ansari, died in 2021 due to Covid-19 while lodged in Nagpur prison. The remaining 11, who have spent 19 years behind bars, are now set to walk free.Advocate Yug Mohit Chaudhry, representing some of the accused, said, "This judgment will be a sign of hope for those wrongly incarcerated". The bench responded, "We did our duty and it was our responsibility".Public Prosecutor Raja Thakare, while acknowledging the verdict, said the judgment would serve as a "guiding light" for future trials. The 2006 Mumbai train blasts remain one of India's deadliest terror attacks, with seven bombs exploding in first-class compartments during peak hours on the Western Railway line.- Ends

‘Tourism on upward path': Goa minister slams ‘social media influencers' over ‘false narratives'

Goa minister Rohan Khaunte slammed 'social media influencers', alleging that they take money to create false narratives about a decline in the state's tourism. He countered their claims with official data that shows Goa's "strong upward trajectory". Goa's tourism is on a strong upward trajectory, supported by robust efforts and initiatives undertaken by both the state and Central governments, the minister said. (Unsplash) Addressing the Parliament during the ongoing Monsoon session, Khaunte said that the government has "nothing to hide as data speaks for itself". He dared the influencers to show proof of the 'decline' they are making claims about. He spoke about the reports of a decline in tourists to the coastal state. He said, "They (influencers) take money to create noise and circulate false narratives. But when we presented official data, none of them countered it. If there is a decline, show proof. We have nothing to hide, data speaks for itself." "There is a rise in tourist arrivals. Goa's tourism is on a strong upward trajectory, supported by robust efforts and initiatives undertaken by both the state and Central governments. Flights arriving in Goa and the hotels in the state are almost full with tourists," PTI news agency quoted the minister as saying. 'Increased flight arrivals, hotels mostly full' Citing official data, the Goa tourism minister said that between January and June this year, Goa recorded more than 57 lakh (57,12,758 precisely) tourist arrivals. Of these, over 34 lakh domestic arrivals were via Vasco's Goa Dabolim International Airport, and more than 22 lakh were through the Manohar International Airport at Mopa. There were a total of 3,23,835 international arrivals, with over 1 lakh via the Dabolim airport and over 2 lakh through Manohar airport. Khaunte said that in the past six months alone, Dabolim and Mopa airports have witnessed a huge number of arrivals. Additionally, hotels have also remained occupied between 70 and 100 per cent throughout the year. The state minister presented a comparative analysis, showing pre-pandemic numbers to illustrate Goa's remarkable recovery in tourism. "In 2019, Goa recorded 71,27,287 domestic and 9,37,113 international tourists, totalling 80,64,400. In 2024, the number surged to 99,41,285 domestic and 4,67,911 international tourists, totalling 1,04,09,196," he said. Khaunte went on to add, "This reflects a 39.48 per cent growth in domestic tourism compared to pre Covid-19 levels and a 50 per cent recovery in international tourism. Goa has bounced back stronger than ever. These numbers clearly show that tourism is thriving." Further, Goa has also tapped into new markets for tourism, with flights and international promotions for countries like Poland, Uzbekistan, and Kazakhstan driving the connections. "Goa is now linked to several parts of the world. Efforts like roadshows and marketing campaigns have opened up previously untapped tourist segments," the state tourism minister said in the assembly.

'Religious Claims Can't Justify Land Grab': Bombay HC Refuses To Recall Demolition Of Illegal Dargah

The court said assertions based on 'mob fury' or 'footfalls of people' cannot lend legitimacy to an illegal structure raised without any municipal permission. The Bombay High Court has refused to grant relief to a trust that sought protection for a structure it claimed was a historic Dargah, reiterating that no religious or charitable claim can override legal ownership and statutory compliance. Dismissing an interim application, a division bench of Justices AS Gadkari and Kamal Khata made it clear that assertions based on 'mob fury" or 'footfalls of people" cannot lend legitimacy to an illegal structure raised without any municipal permission. The application was filed by Gazi Salauddin Rehmatulla Hoole, representing a registered trust, seeking recall of the Court's earlier April 30 order which directed the demolition of a 17,610 sq. ft. structure on land owned by New Shree Swami Samartha Borivade & Anr. The trust claimed the structure was a Dargah dating back to 1882, based on entries in a government gazette, a 1982 sale deed, land records from 1989, and registration under the Charity Commissioner. However, the court noted that none of these documents proved ownership or sanctioned construction. The trust had also failed to produce a single valid municipal permission. 'Such defence cannot give right to an applicant to claim protection or continuation of a thoroughly illegal structure," the bench held. According to the Thane Municipal Corporation (TMC), no permission had ever been granted for any construction on the site. Following dismissal of a civil suit in April 2025 which had challenged ownership of the land, the Corporation had issued a notice asking the trust to produce documents, none were submitted. The High Court criticised the trust for delaying tactics and said the application was an attempt to frustrate its demolition orders. 'This is a classic case of usurpation of the land… we are unable to accept that mere footfalls of people based on an assertion that this is a Dargah can prove that it is a legal structure," court observed. Court also rejected the argument that the trust was denied a hearing. It pointed out that a hearing had already been conducted in January 2025 under the MMC Act, and a subsequent demolition order was passed following due process. The bench further stated that even if the structure appeared in past land records or was referenced in sale deeds, those entries did not establish title, ownership, or legality. 'The applicants have entirely failed in proving they own the land or have permission… even for one square foot," court said. Finding no merit in the plea, court directed the Thane Municipal Corporation to proceed with the demolition and complete it within two weeks from the date of the order's uploading. view comments First Published: July 24, 2025, 17:13 IST Disclaimer: Comments reflect users' views, not News18's.
