Dehradun: Uttarakhand high court has quashed the cancellation of a restaurant's GST registration and allowed it to reapply, saying the GST Act remains "technically complex for citizens focused on running their daily businesses". The division bench of Chief Justice G Narendar and Justice Alok Mahra held that the delay in seeking revocation must be condoned as such cancellations affect sources of livelihood and reduce state revenue. The court passed the order earlier this week while hearing a petition filed by M/s River View Restaurant in Bageshwar. The bench noted that GST is still in its initial phase and that several of its provisions are beyond the understanding of a common person. The court directed the petitioner to file a fresh application for restoration of GST registration within three weeks. It also instructed the department to process the application within the following three-week period. Counsel for the respondents — commissioner and joint commissioner of state goods and services tax — said the petitioner had the option to apply for revocation under Section 30 of the Central GST Act, 2017. The provision allows a registered taxpayer, whose GST registration has been cancelled by the proper officer on their own motion, to apply for revocation of the cancellation order within 30 days — which can be extended up to 90 days — provided all pending returns are filed and tax dues are paid. The petitioner's counsel admitted that no such application was filed within the prescribed time. The court said, "We feel that the limitation should not take precedence for reconsideration of the order of cancellation. Keeping a larger objective of the involvement of livelihood and also loss of revenue to the department, we are of the considered opinion that delay in invoking the provisions of the Act is required to be condoned and is, accordingly, condoned." Several high courts, including Delhi, Madras and Gujarat, have in recent months condoned delays in GST registration revocation filings under section 30, particularly in cases involving small businesses, where courts observed that cancellation could affect income and state revenue.

The Union Minister of State (MoS) for Finance Pankaj Chaudhary has clarified in the Rajya Sabha during the Monsoon Session of Parliament that the government does not intend to charge GST on UPI transactions over ₹ 2,000. Speaking in the Upper House on July 22, while answering questions the minister clarified speculations that the Finance Ministry is plans to impose goods and service tax (GST) on unified payments interface or UPI transactions that exceed ₹ 2,000 in value. 'There is no recommendation of levying GST on UPI transactions of over 2000 from the GST Council,' Pankaj Chaudhary stated on July 22, according to an Economic Times report. He added that GST rates and exemptions are decided on the basis of recommendations of the GST Council, which is a Constitutional body comprising of members from both the Centre and States and Union Territories (UTs), it added. Further, Chaudhary added that the Centre does not foresee revenue shortfall at this stage, and aims to achieve Budget estimate targets for 2025-26. The fiscal deficit for 2025-26 is estimated to be around ₹ 15.69 lakh crore, at 4.4 per cent of GDP. In a written reply in the Rajya Sabha, he said the government supports state finances through Finance Commission grants, Centrally Sponsored Schemes, and Special Assistance as loans to states for capital expenditure. Replying to another question, the minister said that insurers are required to decide on the request for cashless authorisation within 1 hour of receipt of such request and grant final authorisation within 3 hours of the receipt of discharge authorisation request from the hospital as per IRDAI Master Circular on Health Insurance Business dated May 29, 2024. 'However, the data related to the average time taken by insurance companies and third-party administrators (TPAs) for the claim settlement is not maintained by IRDAI. IRDAI has informed that during FY 2023-24, 58.39 per cent of total claims were settled through cashless mode in terms of count and 66.16 per cent in terms of amount,' he said.

Sources told TOI that the Centre has described these as "low-hanging fruits" that can be quickly "fructified" through executive orders or notifications, without the need to amend existing laws. The push comes days after LG VK Saxena cleared a proposal withdrawing Delhi Police's powers to issue licences to seven categories of businesses — swimming pools, eateries, hotels, guest houses, discotheques, video game parlours, amusement parks and auditoriums. Live Events Officials said a recent presentation was made to the Prime Minister, highlighting reforms already introduced by the Lieutenant Governor to streamline business regulations in Delhi. Impressed by Saxena's efforts, the PM directed officials to ensure that traders are no longer entangled in bureaucratic red tape while setting up operations. According to officials, the deregulation cell conducted an extensive review of existing laws and held multiple rounds of consultations with representatives from the Delhi government, MCD, NDMC, DDA, RERA, and the Union Ministry of Housing and Urban Affairs. These discussions, along with an analysis of best practices from other states, shaped the final set of recommendations aimed at untangling the regulatory web created by overlapping agency jurisdictions. One of the reforms — exempting GST- or FSSAI-registered businesses from mandatory Shops and Establishment Act registration — can be implemented via a labour department notification, reported TOI. To streamline the process, the cell has suggested designating either MCD or NDMC as the nodal agency for all business-related licences. It has proposed that applicants be required to visit only one office for all approvals. It further recommended transferring powers to issue FSSAI and weights and measures licences to the civic agency and designating the MCD commissioner or NDMC chairperson as commissioner of food safety and controller of legal metrology. "Any other licence for commercial activity currently handled by Delhi govt should also be brought under MCD to ensure a single point of contact," the cell said. The recommendations noted that these reforms would pave the way for a truly effective single-window clearance system. The Lieutenant Governor has been advised to bring all key stakeholders — including MCD, NDMC, FSSAI, GST, ESIC, EPF, fire services, and the DPCC — onto a unified platform to streamline approvals and coordination.
