CHESAPEAKE, Va. (WAVY) — Like Jim Brewer and Jaime Duzz, Marlaena Horn of Chesapeake has been declared dead, but is very much alive.
This is the third case in a month of a person who was declared dead, but is actually alive.
Back in January, 10 On Your Side reported that Duzz, a Virginia Beach resident, had been reported dead, with her debit card shut down, and facing troubles getting a job.

Brewer, meanwhile, was considered dead to the Virginia Retirement System, American Express and Medicare.

Following that report, 10 On Your Side got an email from Horn, claiming she has been reported dead.
What makes this case unique is that it deals with the IRS.
Horn's husband died, but she said she was also seen as dead, even after meeting with the IRS.
'I got another letter saying I am dead,' Horn told 10 On Your Side in her home during an interview to gather facts for this story.
For Horn, it all began after the death of her husband in December 2022.
'This is the last lingering thing, except not living with my husband, that I have had to deal with,' Horn said.
On June 3, 2024, she got an IRS form that read, 'We are unable to process your tax return.'
She was troubled and claims she couldn't file taxes with the IRS because they think she's dead.
She went to the federal building in Norfolk Oct. 4 and met with the IRS. They see she's alive, takes her tax return and dated it received.
They also gave her this dated note, 'I am requesting that social security number be unlocked. Social Security Administration accidentally reported me as deceased. However, I am not.'
Then Jan. 6 she got this in the mail: 'Your 2023 return could not be processed.'
'I'm dead,' she told 10 On Your Side. 'This is February of 2025, and this is still not resolved. This is absurd.'
With Horn, 10 On Your Side called the IRS number on the notice she received, and went through to a case worker.
Was she surprised to get on the phone so quickly with the IRS?
'I was surprised,' she said. 'It went through so fast.'
The case worker told Horn that it had happened, but not all the time.
'There is coding in the system that says you are deceased,' the IRS worker told her. 'It is kind of weird. … Without us having any date of death in there for you, there is nothing to indicate that you died. … In our system, that is still the part that is still causing an issue on our side.'
He kept working trying to figure it out, and the IRS caseworker represented the IRS with professionalism and was quick in figuring out how it happened and solving the issue.
'It appears they reversed the indicator that you were deceased,' he told her. 'Why did you get that other notice? For some reason, there were two on there. They have now reversed it for you. … There were two entries in the system, and because there was one still showing that you were deceased, it generated this (these notices).'
He deleted it and fixed it.
'How would I assess this success we have had today,' she said. 'If it went through and it is corrected, it has been 100% effective.'

A Massachusetts man is facing charges of health care fraud and money laundering for his alleged role in a scheme to defraud Medicare of millions using a New Hampshire-based medical equipment company. Leo Anzivino Jr., 34, of Teaticket, Mass., faces charges of conspiracy to commit health care fraud, conspiracy to commit money laundering, and money laundering. He pleaded not guilty in U.S. District Court. A trial is scheduled to begin Aug. 19. According to a federal indictment, Anzivino Jr. acted as the straw owner of a durable medical equipment company, Advanced Medical Supply in Rochester and conspired with others to cause the submission of false and fraudulent claims to Medicare between December 2023 and March 2024. Anzivino and his associates allegedly submitted fraudulent Medicare billings for medical equipment that was medically unnecessary, not covered by Medicare, or never provided. The allegedly fraudulent claims totaled $6.33 million, and the conspirators reportedly received payments from the government totaling $2.85 million. Anzivino allegedly fraudulently opened a New Hampshire bank account for Advanced Medical Supply, claiming he would maintain exclusive control over it when it was in reality operated by one of his co-conspirators. Anzivino allegedly transferred the money from the New Hampshire account to a separate account in Massachusetts to try to hide the fact that a different conspirator actually controlled the money, charging documents allege. In April 2024, the FBI and other federal agencies were seen conducting "court-authorized activity" at Advanced Medical Supply. Kristen M. Setera, spokesperson for the FBI's Boston Division, confirmed federal agencies responded to the business, but declined to give a reason at the time. "The FBI and the U.S. Department of Health and Human Services, Office of Inspector General are conducting court-authorized activity," Setera wrote in an email. The government seized approximately $350,000 in assets tied to the alleged scheme.

As always, the numbers boggle the mind. The Justice Department on Monday unveiled new healthcare fraud charges against 324 defendants nationwide, including 37 in South Florida, who were recently arrested as part of the government's annual take-down initiative. Overall, Justice Department officials said 96 doctors, nurses and pharmacists were among those arrested across all 50 states. Authorities said the defendants submitted more than $14.6 billion in falsified bills to the federal Medicare and Medicaid programs as well as to private insurers, describing the magnitude of fraud as the 'largest' in U.S. history — more than double the prior record of $6 billion. The alleged schemes, fueled by stolen identities, financial kickbacks and fabricated bills, continue to plague the medical equipment, genetic testing and painkiller sectors, among others. READ MORE: Kendall companies and doctors pay $810,000 to settle Medicare fraud charges In a statement, Attorney General Pam Bondi described the array of defendants as 'criminal actors who prey upon our most vulnerable citizens and steal from hardworking American taxpayers.' Agents with the FBI and Health and Human Services seized more than $245 million in cash, luxury vehicles, cryptocurrency and other assets nationwide, authorities said during a news conference in Washington on Monday. But while that number may seem huge, it pales next to the government's losses to healthcare fraud every year, according to experts. South Florida, often described as the capital of fraud, continues to be among the hardest-hit regions in the country. For all of its resources committed to fighting the schemes, including data analytics, the federal Medicare and Medicaid programs for the elderly and indigent continue to lose untold sums to fraud, waste and abuse because they routinely pay bills quickly — leaving law enforcement to chase after offenders who cheat the system after payments land in their pockets. Authorities say the Centers for Medicare and Medicaid Services has reduced the rate of 'improper payments' — a combination of 'fraud, waste and abuse' — to 7.46% for the 2022 fiscal year compared with 9.51% in fiscal year 2017, the latest comparisons available. But the federal agency has never publicly disclosed the total amount of improper payments that should not have been made or were made in the wrong amount. Experts estimate that CMS, with an annual budget of $850 billion funded with payroll taxes, loses tens of billions yearly as a result of improper payments. Here are a few South Florida cases filed by the U.S. Attorney's Office in Miami during the national take-down: ▪ Dave Sudarshan Singh, 37, of Pembroke Pines, was charged on Thursday with conspiracy to commit healthcare and money laundering for submitting false claims to Medicare for over-the-counter COVID-19 tests — tests that beneficiaries, including some who were deceased, had not requested. An indictment accused Singh and others of using his business, MDP Products and Services, Inc., to file over $14.1 million in bogus claims to Medicare between 2022 and 2023. Medicare, in turn, paid Singh's business about $13 million for the over-the-counter tests, which did not qualify for reimbursements, prosecutors said. His arraignment is pending. ▪ Lazaro Delgado, 59, of Miami, was charged last week with conspiracy to commit health care fraud, alleging he and others submitted false Medicare and Medicaid bills for orthotic braces on behalf of unsuspecting beneficiaries. Prosecutors said Delgado acted as an intermediary to place a nominal owner as the head of Hucel Custom Med Inc., while other co-conspirators coordinated the phony claims for durable medical equipment products that the beneficiaries did not need. In 2022, Hucel fraudulently billed Medicare/Medicaid for about $9 million worth of orthotic braces and received government reimbursements of $1.8 million. His arraignment is pending. ▪ Marlen Veliz Rios, 58, of Hialeah, owner of Loves Community Health Mental Health Inc., was charged last week with health care fraud and conspiracy to commit money laundering. An indictment accused Veliz Rios of scheming with others to bill more than $15.3 million worth of wound care and skin graft products on behalf of Medicare beneficiaries who never did not need them or receive them. As a result, Medicare paid her company about $10 million. Further, the indictment accused Veliz Rios of transferring the money from Loves' bank account to shell companies under her control and then to others in the alleged laundering scheme. As part of the probe, federal agents have seized $4.6 million from her various accounts, prosecutors said. Her arraignment is pending.

The personal information of more than 100,000 Medicare recipients may have been compromised in a recent "data incident," the Centers for Medicare & Medicaid Services said June 30. As a result, some beneficiaries will be receiving new identification numbers. In the Monday announcement, CMS said approximately 103,000 people may have been impacted by the unauthorized use of their data, including mailing addresses, last names, dates of birth, zip codes, plan premium details and information about services received, such as dates of treatment, treatments, diagnosis codes and the identity of medical providers. CMS became aware of suspicious activity linked to accounts on May 2, 2025, according to the notice, when the Medicare call center began receiving calls from beneficiaries about letters confirming the creation of accounts they did not make. Unspecified "malicious actors" were responsible for creating the accounts between 2023 and 2025, said CMS. The suspicious accounts have since been deactivated and the agency has disabled the ability to make new accounts from foreign IP addresses. Beneficiaries potentially impacted will soon receive a letter detailing the incident, along with a new Medicare ID number and card. CMS says it is not aware of any identity theft occurring as a result of the breach.
