Queensland's new disclosure laws fall short when it comes to natural hazard risk
In 2004, the couple settled on a secluded 8,000 square metre block of land at Tamborine Mountain because it seemed like the perfect spot.
But without realising it, they built their home in an area prone to landslides.
The Scenic Rim Council has a public landslide hazard map, but the couple was unaware at the time of purchasing the property that the document existed.
The home owners said they did "the normal checks" before the sale and believed the seller should have disclosed the landslide risk.
They made that discovery nearly two decades later in 2022 when heavy rainfall triggered a series of landslides, damaging their million-dollar home.
"The back deck pulled off, the front side of the slab has moved and slipped," Mr Radunz said.
"The floor has dropped, the driveway is all cracked, doors don't close very well, windows don't close, and it has substantially damaged the pipe system underneath."
Their two-storey home has been held up by steel poles for the past three years to prevent it from collapsing and the Radunzes are looking to move.
"The house has to be demolished at some stage as a result of the landslides [since 2022] … but it's safe to live in for the moment," Mr Radunz said.
"We're hoping no new heavy weather comes in."
The couple had intentionally underinsured the property to save on premiums, and while they had since received a payout from the insurer, it would not cover their losses.
"We're so heartbroken because all the finance and the heartbreak we have been going through in the past three years is unbelievable … no-one should go through that," Ms Radunz said.
Mr Radunz conceded that he and his wife did not do enough due diligence before buying their property, but said that realisation had only come with hindsight.
"Looking back, we didn't know what questions to ask.
"But how do you know to look? Because you wouldn't suspect it's a landslip zone."
In Queensland, there is no legal requirement for sellers to disclose if a property is affected by natural hazards such as landslides or flooding.
The state government passed the Property Law Act in 2023, which requires owners to disclose important information about a property to prospective buyers.
The new seller disclosure statement comes into effect from August 1.
Real Estate Institute of Queensland chief executive Antonia Mercorella said the law would not have made a difference to the couple's "tragic" situation as sellers would not be required to disclose information about a property's natural hazard history.
"There are just certain disclosures that the law doesn't consider that a vendor needs to make," Ms Mercorella said.
She said vendors would not also be required to disclose the structural soundness of the building, pest infestations, the presence of asbestos within buildings, or improvements on the property.
Instead, sellers were obliged to provide a range of information, including any encumbrances affecting the property, zoning information, building compliance certificates, and rates and water charges.
Under consumer law, however, sellers would be obliged to reveal relevant information if asked.
"For instance, if a buyer were to ask the question: has this property previously flooded? Then clearly consumer laws exist that make it clear that one cannot lie about that or mislead the buyer," Ms Mercorella said.
She urged buyers to carry out their own investigations on a property, either through speaking with the real estate agent or lawyer, or by referring to the flood or landslide hazard mapping provided by the local council.
Queensland councils have been advocating for years for the natural disaster disclosure to be included in the legislation and some remain disappointed it has been omitted.
"This could have been an easy fix that could have helped create fewer headaches for people," Moreton Bay Council Mayor Peter Flannery said.
Cr Flannery said that although council information about natural hazard risks was freely available online, it was often overlooked by potential buyers.
"It's not put up front to them that this is something that you should be made aware of before you continue on with this contract."
Mr Radunz said he hoped other prospective buyers could learn from their experience and avoid the same costly mistake.
"Do all the searches you can, whatever you think might go wrong, go and check it out," he said.

Pilots killed in Oakey plane crash were carrying out mandatory training, ATSB says
Two men killed in a plane crash in Queensland on Sunday afternoon are believed to have been conducting a mandatory pilot proficiency check moments before their aircraft hit the ground. Australian Transport Safety Bureau (ATSB) investigators believe the plane, which took off south of Toowoomba at Warwick, was attempting an instrument landing system (ILS) approach to Oakey Army Aviation Centre at the Swartz Barracks when the crash occurred at Oakey at about 3pm. The aircraft burst into flames, killing both men instantly. Aviation specialist service Aero Logistics confirmed that one of its pilots was killed in the crash. Chief executive Ben Smee said the pilot had been working with an external flight examiner. "This is a terrible tragedy for the two people onboard the aircraft and their families, friends and workmates," he said in a statement. Today ATSB investigators have been scouring through the wreckage and investigating the history of the aircraft and the two men on board. "We still don't have access to all maintenance records — they're part of what we're routinely get over the course of the next couple of days," ATSB Chief Commissioner Angus Mitchell said. The Reims-Cessna F406 Caravan, a twin turbo-prop 12-seater aircraft built in France in 1990, had been in Australia for 13 years, according to the ATSB. In 2014 the ATSB assessed the aircraft after one of its pilots suffered hypoxia during a flight. That investigation concluded there had been an error with the plane's oxygen system when it was above 10,000 feet and the issue was rectified. Mr Mitchell confirmed that the fault found in 2014 was "unlikely to be associated with what occurred" during Sunday's crash. Recent flight-log data showed the aircraft had made numerous flights in the same area and around Emerald in central Queensland in the days leading up to the crash. Mr Mitchell said flight data could play a key role in determining the cause of the crash. "A small aircraft like this is quite likely to have some sort of recording devices … what state they're going to be in is something that will determine later on," he said. "There are other recording devices, whether that be mobile phones, iPads, that we can often recover from site, and anything that's been recorded, whether that be radar traffic, and radio traffic." Mr Mitchell could not confirm whether a "mayday" call had been made prior to the crash. "[The plane] left Warwick about 40 minutes prior to the accident," he said. "There is some of that circling that was done around the Oakey [area], but whether Oakey [Swartz Barracks] was an intended destination or simply part of the training and part of the proficiency check for the pilot we're yet to clarify." The Oakey Army Aviation Centre has an ILS – a ground-based navigation system – installed to allow aircraft to land in any weather. An Australian Defence Force spokesperson said flying over a restricted area must be avoided unless in an emergency, according to minutes from the Brisbane Airport Commmunity Airspace Advisory Board Meeting in February. The meeting minutes also advise that civilian aircraft may make requests to air traffic control in restricted Defence areas, including military bases, for emergencies only. ATSB preliminary reports are likely to take between six and eight weeks to complete, according to Mr Mitchell. "A preliminary report is very much an assessment of the facts as we know them — quite often that will be a very good indication of the sequence of events that occurred," he said. "We will look at the history of the aircraft, what is it normally being used for and what potentially differed yesterday to have such a tragic outcome that two families are obviously grieving for today and more broadly an aviation community."

Crocodile shocks locals at popular holiday spot, far south of usual habitat
Locals are baffled after reports of a 3.5-metre crocodile in Noosa, hundreds of kilometres further south than the animal's usual range. Noosa local James Graham said he picked up signs of a 'massive' crocodile on his fish finder on Sunday. The pictures appeared to show the distinctive shape and tail movements of a croc. Mr Graham told he was fishing the Noosa River, about one kilometre from the river mouth and opposite Ricky's River Bar, when he noticed the 'pretty startling' images. He was accustomed to seeing crocodiles on his sounder much further north, while chasing barramundi near Townsville, but never in Noosa. Crocodile habitat typically begins at the Boyne River, about 400 kilometres north of Noosa, and sightings outside that area are rare. Mr Graham's sighting came just hours after another Noosa resident, Ross Buckley, had also reported seeing a croc. 'Was out for my usual 6.30am stroll this morning with my dog down along the dog beach at the Noosa Spit, (and) spotted approximately a 3.5 metre crocodile a few meters off the shoreline, just past the bend where the mangroves start,' Mr Buckley told a community Facebook group. 'At first I thought it was a bit of driftwood, but then it moved. I've lived here over 30 years and never seen anything like it – I've heard a few locals say they have seen one in the same neck of the woods, although I didn't think much of it and just thought they were tugging my tousle, until today it turns out, I owe them an apology! 'Just wanted to give a heads up to all the locals who walk their dogs here early and usually swim around this area, be careful and stay safe. Not sure what's going on with wildlife lately but this gave me a real fright. Definitely won't be back here for my morning walk.' Mr Graham said he saw Mr Buckley's post that morning and didn't think much of it – until his own experience later that day. 'You see that on social media and you just react thinking isn't that ridiculous? There's no way there's a crocodile in Noosa, especially in the middle of winter,' he said. 'Hours later I was fishing, and not catching anything, and all of a sudden my mate goes Oi, look at this. 'And there's a massive picture of what looks like a crocodile.' Queensland's Department of the Environment, Tourism, Science and Innovation (DETSI) said wildlife rangers investigated a reported sighting at Noosa Spit on Sunday but 'found no evidence of a crocodile'. A follow-up search was planned for Monday, a spokesman for the department said. 'While the investigation is ongoing, people are asked to be vigilant around the water. 'The Noosa area is considered atypical crocodile habitat, and any crocodile confirmed to be present will be targeted for removal from the wild. 'Anyone who sees what they believe to be a crocodile in the Noosa area is encouraged to make a sighting report as soon as possible.' Queensland residents can report crocodile sightings by using the QWildlife app, completing a crocodile sighting report on the DETSI website, or by calling 1300 130 372.

Noosa fisherman captures underwater image of possible crocodile sighting
A fisherman on Queensland's Sunshine Coast believes he has captured a picture of a crocodile on his underwater equipment, despite the area being 300 kilometres out of the reptile's usual habitat. Long-time Noosa fisherman James Graham shared the photo of the crocodile-shaped silhouette from the fish sounder on his boat in the Noosa River yesterday. "I've been fishing all of my life and I commit myself to the best fishing equipment on the boat. "So when I was driving along at Noosa, just throwing a line in, something came across the screen that just looked like it belonged many hundreds of kilometres north." The Department of Environment confirmed it was aware of the reports and was investigating, but noted Gladstone's Boyne River, about 300km north of Noosa, was "commonly considered the southern boundary of typical crocodile habitat". However, earlier this month a crocodile was euthanased by rangers after being found in the Mary River, about 50km inland from Noosa. Rangers were also searching for a crocodile earlier in the year when one of the ancient animals was spotted at Inskip Point, about 60km north of Noosa. It was never caught. Mr Graham said he had heard some discussion on social media earlier that day of a crocodile being spotted and immediately doubted it. "I thought, 'In the middle of winter, in the middle of Noosa? That's the silliest thing I've ever heard'," he said. But the figure spotted on his equipment changed his mind. "It's very, very clear," he said.
