
Sofronoff knew ‘destructive' potential of leaking confidential documents to Australian and ABC journalists, court hears
Hearings continued on Tuesday into the former Queensland judge's legal challenge to findings by the Australian Capital Territory's Integrity Commission that he had engaged in 'serious corrupt conduct' by leaking documents relating to his investigation into the Lehrmann case to Janet Albrechtsen at the Australian and Elizabeth Byrne at the ABC.
Those leaked documents included notices sent to then-ACT director of public prosecutions Shane Drumgold that the inquiry was considering making adverse findings against him.
Scott Robertson SC, representing the ACT Integrity Commission, told the court those documents were disclosed to journalists knowing they posed a significant risk to Drumgold's career. 'It wasn't an accidental disclosure, it was a knowing disclosure,' Robertson said.
A 2022 criminal trial against Lehrmann, who was accused of raping Brittany Higgins in the ministerial office of Senator Linda Reynolds at Parliament House in 2019, was abandoned with no verdict because of juror misconduct, and prosecutors decided against a re-trial. Lehrmann denied the allegations.
Sofronoff was appointed by the ACT government to determine whether the investigation into the trial had been affected by political influence or interference. His report ruled that out but made 'serious findings of misconduct' against Drumgold, which were partially overturned in March 2024.
The Integrity Commission launched an investigation in May 2024 to determine whether Sofronoff acted corruptly in leaking confidential documents, including providing the inquiry's final report to journalists before its official public release.

The corruption watchdog's report, known as the Juno report, said Sofronoff claimed his conduct 'complied with the requirements of the Inquiries Act' and that, in leaking the documents, he had 'acted in the public interest to ensure the media were adequately informed' about his inquiry and 'in a position to comment accurately' about it.
The commission found that Sofronoff 'had not, in fact, acted in good faith', that his actions 'undermined the integrity of the Board's processes and the fairness and probity of its proceedings to such an extent as to have been likely to have threatened public confidence in the integrity of that aspect of public administration. It therefore constituted serious corrupt conduct.'
Sofronoff is challenging this finding on the argument that the commission made a series of errors in its interpretation of legislation, and that there was no evidence to support findings that he had acted dishonestly or not in good faith.
Robertson said Sofronoff clearly knew the material he was disseminating ought to be kept confidential and that parties affected by it would expect him not to send it to journalists.
The non-publication order that Sofronoff issued in April 2023 over the material provided to his own inquiry (as there was a risk that adverse findings may be made at the time), showed he 'quite appropriately' believed that material should be kept confidential, 'yet he acted inconsistent with that own indication', Robertson said.
Evidence for that inconsistency included Sofronoff sending two subpoenaed statements relating to the investigation into Drumgold to Albrechtsen in a text message with the words 'strictly confidential' attached, Robertson said.

While a number of people were notified that Sofronoff's inquiry was considering making adverse comments against them, Sofronoff only leaked the notices of possible adverse comment against Drumgold to Albrechtsen, the court heard.
Serious adverse findings could, and in this case did, destroy Drumgold's career. The destructive potential of those documents could not reasonably have been lost on Sofronoff, Robertson said, as he was 'an individual of extensive [legal] pedigree'.
'As sensitive and confidential documents go, it's hard to identify a more serious example. The public release of these documents and even the use of it as journalistic background is or was apt to undermine Mr Drumgold's interest, that's the factual context in which the commission makes its relevant findings.'
Robertson argued that if Justice Wendy Abraham were to find that the facts behind the commission's finding were not in error, she would be 'very unlikely' to find error in the subsequent evaluation of Sofronoff's conduct as dishonest.
Sofronoff's barrister, Adam Pomerenke KC, said there was a difference between 'disclosure' and 'publication', and that the suppression order only related to publication. Sofronoff was aware of the terms of his own suppression order, but 'knew that [material] would not be published while this order was operative. That's a different thing from being disclosed'.
Justice Abraham queried the distinction, saying: 'A person providing a statement [to the inquiry] would not expect that to be provided to a journalist without their knowledge, at this stage, with the order in place, would they? They would have the expectation that it would not be.'
'I'm going to stick to that distinction between publication and disclosure, it's a recognised distinction,' said Pomerenke.
The court reserved its judgement.

Doug Brown, 56, nicknamed Dinosaur, is a respected member of Victoria's baseball community, where he continues to coach children at a club in Melbourne's western suburbs. Several officials from the Sunshine Baseball Club were contacted by Daily Mail Australia on Friday, but no responses to a series of questions were provided. On Tuesday, Joshua Brown again fronted Melbourne Magistrates' Court where details of 73 child sex offences were made public. Charge sheets released to the media showed police allege Brown is accused of committing 18 offences on a single day while working at a Point Cook centre, in Melbourne 's west. The charges linked to that day include multiple counts of sexually touching an unknown child aged under 16, engaging in a sexual activity in the presence of an unknown child under the age of 16, and the production and transmission of child abuse material. Among the most shocking allegations is that, on December 2, 2022, the former childcare worker contaminated food with bodily fluids. It is this alleged crime that sparked a massive public health warning, with the parents of 2,000 children urged by authorities to have them tested for infectious diseases after Joshua Brown's alleged offending was revealed on July 1. It can be revealed that the alleged sex offender's family continues to live in the family home in Point Cook where he grew up. On Friday, his younger sister was seen leaving the home just after dawn. While Daily Mail Australia attempted to make contact with the Brown family, no one answered the door and a calling card was ignored. The Brown family's social media pages indicate Joshua Brown had been a loved and treasured member of the family. Images show a young Joshua Brown, before the distinct arm tattoos he now bears, at family events. In one, he appears to be enjoying a camping adventure with his father and friends. In another, he poses alongside his sister and a group of girls. Another shows Joshua Brown in the arms of his mum alongside his sister. It is understood Joshua Brown did not share a love of baseball in the same way as his father and younger sister still do. Mr Brown is local baseball legend after he started playing the sport at the age of six and continued on for 39 years before retiring in 2014. He made a name for himself at Footscray before moving to Sunshine in the 1990s. A player profile indicated his preferred fielding positions were third base and catcher. He also represented Australia in the Provincial League. He was named one of the club's top 21 players of all time in 2013. Mr Brown continues to be an active member of the club where he has played a leading role in coaching junior teams. Joshua Brown's mother was previously outed as a prison guard who became involved in a tragic death in custody case. Images captured of her in 2022 showed her alongside Doug and her daughter. The image was captioned by their daughter: 'I'm their favourite'. In 2022, in an unrelated case, Ms Brown appeared at an inquest into the death of Veronica Nelson, 37, an Indigenous woman who died in her cell at Melbourne's Dame Phyllis Frost Centre in January 2020. Ms Brown was the last person to speak to Ms Nelson, and the inquest heard she lied to the inmate 'multiple times' about medical help coming to help her. The inquest said Ms Nelson's death was preventable, but an autopsy found her cause of death was attributable to Wilkie's Syndrome in the context of opiate withdrawal. It made no findings againt Ms Brown. In an interesting twist, Ms Brown had been grilled during that inquest by top Melbourne barrister Rishi Nathwani, KC, who acted for Aunty Donna Nelson at the time. On Tuesday, Mr Nathwani was now acting for Joshua Brown, arguing that his client's charge sheets be withheld from the media. During that hearing, Mr Nathwani revealed the case against Joshua Brown remained very much 'in flux'. An affidavit supplied by detectives to the court said the investigation was incomplete and needed more time to compile the final brief of evidence against Brown. 'Your honour has had the benefit of the affidavit which indicates that the police are working very hard,' Mr Nathwani said. Brown's co-accused, Michael Simon Wilson, 36, faces 45 charges ranging from rape to possession of child abuse material, transmission and production, as well as 'sexually penetrating an animal, namely a dog'. Doug Brown was named a junior coach in April The relationship between Wilson, who is not a childcare worker, and Brown remains unclear. Charge sheets indicated both men are facing charges that were allegedly committed on the same dates, including on April 28, 2022, when Brown allegedly committed multiple counts of producing child abuse material, and Wilson allegedly committed multiple counts of possessing and accessing child abuse material. Both men will reappear in court on separate dates, with Brown not due back until February next year.

Teacher claims kiss with teen girl in photo booth supposed to be 'pretend'
A music teacher captured kissing a teenage girl in a photo booth has claimed the passionate embrace was supposed to be a 'pretend kiss'. Adelaide educator and flautist Janelle Colville Fletcher, 40, is standing trial in the South Australian District Court accused of sexually abusing a teenage girl. Fletcher also stands accused of grooming the girl and another teenage girl to make them more amenable to sexual activity. The prosecution, led by Chris Allen, alleged Fletcher sexually abused the girl in various locations, including the girl's home, over several months. Mr Allen presented photographs and correspondence between the pair, including a snapshot taken in a photo booth at a cinema which showed them kissing. Fletcher, under questioning from defence lawyer Andrew Culshaw, told the court she did not voluntarily engage in the kiss. 'It was meant to be a pretend kiss, like we had done previously where your lips don't actually touch, and in that particular photo we got close and she did sort of pull me in and yeah, the photo went off,' she said, as reported by The Advertiser. 'Her hand was on my neck and then the lips touched.' Fletcher claimed the teen continued contacting her after the photograph was taken, but that she blocked all further contact from the girl. The prosecution has alleged the relationship began after a game of truth or dare in which Fletcher allegedly dared the girl to kiss another teenage girl. Mr Culshaw, Fletcher's defence lawyer, told the court his client had not engaged in any such game and did not encourage the girls to engage in sexual activity. Fletcher pleaded not guilty to one count each of sexual abuse of a child and communicating with intent to make a child amenable to sexual activity. During cross-examination, she denied ever being sexually involved with the girl, and insisted she was heterosexual. 'That just never happened,' she told the court. The court was also read emails sent by the pair, including one message in which Fletcher told the girl: 'My feelings for you are not lust but love'. Asked to distinguish the difference between lust and love, Fletcher replied that love was 'not necessarily sexual or romantic'. The music teacher said she had intended to 'slowly get her to think it was her idea to not be with me, but to be with someone her own age'. Fletcher admitted she had told the teen she loved her but insisted it was only because she believed it was what she wanted to hear. She characterised her feelings as a 'big sister' type of love. The trial continues, with closing arguments expected to be held on Monday.

Anthony Albanese risks turning Australia into a high-taxing European nation with his plan for a radical new tax on superannuation savings, an investment group warns. The federal government wants to impose a new 15 per cent tax on unrealised gains on super balances above $3million, where capital growth would be taxed before assets are sold. Wilson Asset Management chairman Geoff Wilson said this departure from taxing capital gains after assets are sold would see Australia share a similarity with European nations, which are renowned for their high taxes and targeting the rich. 'Australia is proving to be no different from Norway, Spain and Sweden, where taxing unrealised gains led to capital exodus and therefore lower than expected tax revenue,' he said. In 2023, the Labor government announced that from July 1, 2025, 0.5 per cent, or 80,000, of super balances with more than $3million would be hit with a new 15 per cent tax on unrealised gains. This would be in addition to the 15 per cent tax on earnings that already exists for all super during the accumulation or working phase. The debut of a new tax on unrealised gains also marks the biggest change to the capital gains tax since it was introduced in Australia in 1985. Previously, European nations have been the main enthusiasts for taxing the notional or paper value of assets, based on gains during a financial year. Norway applies a 38 per cent unrealised gains tax on the wealth of those who leave. Sweden does a similar thing, but with a 30 per cent exit tax on unrealised gains. Spain also has an exit tax, based on unrealised gains, if someone with a large investment portfolio leaves the country to become a tax resident elsewhere. Germany during the 1970s and 1980s taxed unrealised gains on wealth, but the policy was notoriously difficult to administer. France still has a wealth tax that applies on assets worth more than €1.3million (AU$2.1million) of real estate assets, but it stops short of taxing unrealised gains. Other European nations, renowned for having higher income taxes to fund more services, do not touch retirement savings in the way Labor is proposing to do. US Democrat presidential candidate Kamala Harris last year campaigned to tax unrealised gains on wealth - but only for the ultra rich with assets worth US$100million (AU$152million) or more. Australia would be the first to apply an unrealised gains tax to superannuation, in a bid to raise $2.3billion a year in Budget revenue. Left-leaning crossbench senators David Pocock and Jacqui Lambie last year declined to back Labor's Better Targeted Superannuation Concessions bill, because they are opposed to taxing unrealised gains. The Greens back taxing unrealised gains but want the threshold reduced to $2million, but indexed to inflation. They hold the balance of power in the Senate, and Labor is still negotiating amendments with the minor party. The government has previously flagged giving Australians a year's notice from the time legislation is passed, with Mr Wilson noting panic selling was already occurring in self-managed super funds to avoid the potential new tax. 'Despite requiring Senate approval, the proposed tax on unrealised gains has already prompted a rush to liquidate assets ahead of the 30 June 2026 implementation date,' he said. Wilson Asset Management has proposed an alternative super tax strategy to Labor's plan to tax unrealised gains, in a submission to the government's Economic Reform Roundtable, where it argued it would raise $2.433billion in revenue. 'The outcome of the proposal would allow the government to increase tax revenue from high balance accounts without breaching the realisation principle of the tax act,' Mr Wilson said. 'Our proposal is in the national interest and a Budget-positive alternative to the government's proposed policy to tax unrealised gains in superannuation.' He proposes to keep the existing structure of taxing realised capital gains, but adding a new 15 per cent tax to balances of $3million to $6million. A 17.5 per cent tax would apply for balances of $6million to $10million, rising to 20 per cent for balances of $10million to $20million and 25 per cent for balances above $20million.
