Judicial reform in focus as Azalina leads comparative study with UK, Australia, India and Singapore

KUALA LUMPUR, July 10 — Malaysia will now be looking at the way judges are appointed in four countries including the UK and Singapore, as part of efforts to consider how the country's judicial appointments system can be reformed.
The Prime Minister's Department's Legal Affairs Division (BHEUU) announced this following a preliminary discussion today between Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said with the heads of two parliamentary special select committees.
'Among other things, this discussion agreed to carry out preliminary comparative research about the approaches of the judicial appointment systems in several selected countries, namely the United Kingdom, India, Australia and Singapore.
'This preliminary comparative research will give a holistic understanding about the process of judicial appointments in countries with similar systems in order to enable Malaysia to make an evidence-based evaluation of the need for reforms and to adapt best practices according to national context.
'This research is also intended to evaluate an effective model for judicial appointments, identify best practices and recommend reforms that are appropriate for Malaysia's context as a constitutional monarchy and in line with the Federal Constitution,' BHEUU said in the statement.
The statement said the Malaysian government through the BHEUU welcomes public feedback and the public's views about this matter.
'This inclusive approach is important to ensure each perspective is taken into account before the research outcome is tabled for the Cabinet's consideration.
'The government remains committed to strengthen public confidence by carrying out transparent and evidence-based reforms,' it concluded.
Earlier in the statement, the BHEUU said Azalina's meeting was with the Dewan Negara's Special Select Committee on Law Review's chairman Rita Sarimah Patrick Insol and with the Dewan Rakyat's Special Select Committee on Human Rights, Election and Institutional Reform's chairman MP William Leong Jee Keen.
The BHEUU said the meeting was held in relation to public concern about reforms in Malaysia's judicial system to ensure the integrity of the judiciary in upholding the rule of law.
BHEUU said both parliamentary committees' chairman had expressed concerns over the latest developments on the issue of judicial appointments and stressed the importance of more in-depth studies to ensure a more transparent and credible process of appointing judges.
Currently, in Malaysia, the Judicial Appointments Commission (JAC) vets and selects candidates to be recommended to the prime minister.
The prime minister can accept the recommendations or ask for alternative names from the JAC, and the Yang di-Pertuan Agong would appoint judges on the prime minister's advice and after consulting with the Conference of Rulers.
The Bingham Centre for the Rule of Law had in 2015 published a study on the best practices for appointing judges in the Commonwealth, with the report looking at 53 Commonwealth members including Malaysia.
There are currently 56 countries in the Commonwealth, including India, Australia and Singapore.

'As part of the Unity Government, BN frequently holds discussions, including regular sessions with top leaders not only from BN but also from other coalition partners. 'These meetings allow for the exchange of views and for the Prime Minister to provide updates on government policies and related matters,' said the Higher Education Minister after officiating the Jeli Umno Division Delegates Meeting in Bukit Nangka here today. The Prime Minister held the meeting with BN MPs at his official residence in Seri Perdana, Putrajaya, yesterday. The session, which lasted over an hour, is believed to have also addressed preparations for the upcoming Parliamentary sitting. In his speech at the division meeting, Zambry, who is also an Umno Supreme Council member, urged party members in Kelantan to continue strengthening their resolve and confidence in advancing the party's mission in the state. 'The spirit of relentless struggle must be upheld by all Umno members in Kelantan, as demonstrated during the Nenggiri by-election last year, which BN won. KUALA TERENGGANU, July 12 — Prime Minister Datuk Seri Anwar Ibrahim has asked the people of the state not to be influenced by baseless claims that the federal government is not doing any development for their welfare. He said in fact, a total of 445 programmes and projects with an allocation of RM1.836 billion have been approved in Terengganu under the Fifth Rolling Plan (RP5) Development Programmes/Projects of the 12th Malaysia Plan (MP12). He said this was an increase of RM239 million compared to last year, thus refuting claims by some quarters that no development was being done for the state. '..this is I announcing projects that are underway or have started to proceed. Sometimes it is slow (because we have to take into account) the issue of land acquisition, impact studies and suitability, but the approved (project) is RM1.836 billion. 'So if there are people giving talks in any village, claiming no projects, please explain the approved allocation of RM1.836 billion,' he said when speaking at the Closing Ceremony of the Terengganu Madani Rakyat (PMR) 2025 Programme at the Pasar Kedai Payang compound, here today. The Finance Minister said that among the important development projects currently underway for the people of Terengganu is the initiative to expand broadband internet coverage in districts such as Hulu Terengganu and Besut which will benefit more than 15,000 households. In addition, RM300 million has been allocated to upgrade the existing water distribution system which will increase piped water supply to 98 per cent by the end of this year. 'Then, RM2.243 billion has been allocated specifically for flood mitigation projects and estuary conservation and coastal erosion in Terengganu. 'I also discussed with the Menteri Besar that we (the federal and state governments) must find new technologies to prevent this erosion from continuing to occur so that preventive measures can be expedited,' he said. He said that all these are evidence of the commitment that the federal government also prioritises the people in this state regardless of the excessive accusations that do not benefit and result in continued tension between the state and federal governments. 'In this country, if there is cooperation and focus on important matters for the country, we will be safe but if we are still hanging around with negative campaigns, it will not help. For example, the accusation that we do not want to help the Malays or that the Islamic economy is currently challenged. '...but this is a programme, why did I choose Terengganu (as one of the locations for the event). Terengganu has more than 90 per cent Malays, but I didn't choose it because it's Malay alone, but because the state has recorded progress and excellence in education and other fields. 'So I hope we can listen but evaluate it well and don't make it an issue that doesn't benefit us,' he said. During the event, Anwar also witnessed the handover of a replica cheque for the allocation for road and slope maintenance on Terengganu's federal roads totalling RM158.6 million from the Ministry of Finance to the Ministry of Works. The three-day Terengganu PMR, which ends today, has become a strategic platform to unite the federal government, state governments, ministries, agencies and government-linked companies (GLCs) in delivering information, opportunities and services directly to the people. — Bernama

KUALA TERENGGANU, July 12 — The Ministry of Education (MOE) is leaving it to the authorities to investigate the recent incident involving a liquor auction within a school compound that went viral recently. Education Minister Fadhlina Sidek said the ministry will not compromise on any form of misconduct or violation of regulations involving educational institutions. 'We have handed the matter over to the relevant authorities for investigation. We will not tolerate any misconduct or breaches of the rules. Action will be taken,' she told reporters after officiating the closing ceremony of the Madani Rakyat Programme (PMR) 2025 in Terengganu today. She said investigations are ongoing, including into reports of a scuffle during the auction, and the Ministry will continue to monitor the case to ensure regulations are upheld and appropriate action is taken. The incident sparked public outrage after a primary school facility in Pontian, Johor, was used to host a liquor auction, during which a fight was also reported to have occurred. — Bernama
