How a century-old ‘zombie subdivision' became Melbourne's ‘worst case of urban blight'

The intergenerational failure to develop Solomon Heights has been blamed on a tangle of planning problems, according to Brimbank council analysis: it's hard to reach, with one road in and out of the precinct; its residential-sized lots are unsuitable for large-scale industry; and its neglected expanses are a refuge for several critically endangered plants and animals, including the striped legless lizard and the golden sun moth, which are protected under federal and state environmental laws.
But the century-long campaign to develop Solomon Heights has never stopped.
Glen Ora, a company that owns the undeveloped roads in the southern half of the precinct, has launched legal action to try to connect the area to water and kickstart development.
The company has gone to the Victorian Civil and Administrative Tribunal, appealing Greater Western Water's refusal earlier this year to grant water connection permits in the precinct. A statement of contentions seen by The Age says the refusal 'would stifle and prevent the future creation of infrastructure works in the subdivision'.
The company has also approached the Department of Transport and Planning about developing Solomon Heights for housing, but it has been told there are no plans to rezone the area from industrial to residential.
Glen Ora director Ron Silverstein was reluctant to comment to this masthead about his company's legal bid to force Greater Western to plumb the estate before VCAT has made a decision.
'What I'm prepared to say is there's an enormous amount of green tape involved in a transaction like this … from the Commonwealth, state and council,' he said. 'There's a huge regulatory system, which is complex, very expensive, and you need very deep pockets to do something like this.'
The company is fighting to develop the Solomon Heights as it awaits a separate judgment over whether it is liable for rubbish dumping on the land.
The Commonwealth-run Australian Rail Track Corporation, which owns land in Solomon Heights, has sued Glen Ora for more than $828,000, plus costs and interest. According to a statement of claim filed in court, subcontractors hired by Glen Ora dumped contaminated construction spoil, including asbestos, copper and lead, on ARTC-owned land.

When The Age visited Solomon Heights last week, it was clear rubbish dumping was a persistent problem. There were piles of old tyres, a rusted car body, mounds of mangled wires and rotting timber. The flat, grassy terrain is also choked with artichoke thistle and prickly pear.
But Silverstein was eager to show this masthead something else that grows hidden among the weeds, and which is key to the precinct's future.
'One of the features of this property is that it's got a critically endangered plant and I don't want you to laugh when you see it. It's extremely valuable,' he said.
In an overgrown corner of the estate near the Melbourne-Sydney railway line, eight spiny rice-flower plants grow, although only a trained eye would spot them.
Each critically endangered plant is marked by a stake tied with a ribbon. The delicate yellow-flowered plants are protected under environment and biodiversity laws.
There are 240 spiny rice-flowers in the estate, according to ecological surveys.
'People look at them and they can't understand why they're so important, and the answer is, I don't know either,' Silverstein said.
Brimbank City Council has spent several years in a state of planning paralysis over Solomon Heights.
In a 2019 report, it named the existence of protected plants and animals as a key impediment to development, along with the difficulty of getting property owners in the precinct to agree on a way forward.
In 2022, it completed a feasibility study into creating a conservation reserve in the northern part of the estate. The Age sought a copy of the study via a freedom-of-information request but was denied, with the council saying the report is confidential.
'The document contains land use planning information, being information that, if prematurely released, is likely to encourage speculation in land values, which can be commercially sensitive,' Brimbank said.
Individual lots are currently listed for more than $230,000 each.

The council said it has no plans to pursue public acquisition of any part of the estate.
Lancashire argues that the southern part of the estate should be developed into an industrial estate that would boost local employment, and the northern section converted into an environmental reserve.
'There is a way forward,' he says. 'To see that this has been going on in my community for 100 years is gut-wrenching … we've done environmental study after environmental study. We need to stop the delays, we need to come back with a report on how to actually do it.'
Monash University senior lecturer in urban planning Dr Elizabeth Taylor has studied Solomon Heights and other 'zombie subdivisions' like it, which are 'the living dead of the real estate market', seemingly trapped in time and unable to be developed.
In her research, Taylor wrote that many potential solutions have been posed for the estate but 'a default position of inaction has defined it for nearly a century'.
This is partly because current planning laws were not written with a 99-year-old riddle like Solomon Heights in mind. But mostly, it comes down to the cost of fixing the problem and the likely gap between what the council would be prepared to spend on compensation versus what the private landowners would demand.
'You can imagine Solomon Heights maybe being a cool park or something like that, but it just gets stuck because nobody wants to pay for it,' Taylor said.

The half-brother of five-time world champion boxer Lester Ellis, Deicke has been linked to other businesses and properties that have been damaged by fire. In April 2023, Deicke agreed to buy a Portsea mansion for $8 million from Wallace Cameron, the former chief executive of pathology group Gribbles. However, the luxury home on Franklin Road was razed by fire in September 2023 before the deal could be settled, and Deicke was refunded a deposit of $800,000. The cause of the fire has not been determined. A car wash business in Brighton co-owned by Deicke and another smash repair business in Moonee Ponds were also extensively damaged by fire. The Age is not suggesting Deicke had any involvement in the fires he has been a victim of. In November 2023, Deicke was charged by federal police over the importation of 120 kilograms of liquid cocaine that was found inside 600 wine bottles in 2018. More than 500 jobs are in jeopardy after a coal company in Queensland appointed administrators amid challenging business conditions and financial strains. Bowen Coking Coal on Wednesday appointed Mark Holland and Shaun Fraser from McGrathNicol Restructuring as administrators. It followed failed discussions with lenders and after the company could not secure a cash injection to save the business. The company said 'the current challenging environment for the coal industry' due to higher costs and lower global coal prices had led to its collapse. It also said the Queensland government's progressive royalty structure - which was imposed in 2022 - had hurt the company's bottom line. Bowen appointing administrators follows the Queensland Revenue Office rejecting the company's submission for these royalty payments to be deferred. 'The decision to appoint administrators is very disappointing,' the company said in a statement to the ASX. Bowen had opened its Burton mine, located about 160kms east of Mackay, in 2022, but the administrators may now sell the asset. 'The Burton Mine Complex is a quality asset, and management has been successful in delivering operational improvements that have seen the company transform Burton into one of the most productive and low-cost metallurgical coal mines in Australia,' Bowen said. 'The administration process is expected to provide a window which will allow for a sale or recapitalisation to be completed.' The voluntary administrator confirmed it has taken control of the company and will ensure it continues to operate until next steps can be determined. 'The Administrators have assumed control of the BCB Group's operations and intend to continue trading on a 'business as usual' basis while a sale and/or recapitalisation process is undertaken,' McGrathNicol Restructuring said. 'This includes the operations at the Burton Mine Complex located in the Bowen Basin of Queensland, which will continue uninterrupted.' Bowen stopped trading on the ASX in June. Its share price had plummeted from almost $40 in early 2022 to seven cents when it halted trading. In June, Bowen warned it would be forced to halt operations if market conditions did not improve. The coal operation's collapse comes as Australia's heavy industry continues to struggle under high power prices, which has forced many plants to beg for government handouts. Nickel smelter Glencore recently revealed it is on the brink of collapse in a threat to 17,000 jobs. Rio Tinto-owned Tomago, which is Australia's largest aluminium producer, is seeking billions of dollars from the federal and NSW governments amid high power prices and as cost-effective and consistent renewables remain largely unavailable. Tasmania to proceed with Marinus Link decision, with Labor given a day to agree after 'sham' briefings

The Tasmanian Liberal government intends to approve a final investment decision on the Marinus Link interconnector project after months of negotiations with the Commonwealth. But with the government in caretaker mode, the decision requires consultation with the Labor opposition, with Premier Jeremy Rockliff giving Mr Winter until 9am tomorrow morning to give his support. The Commonwealth, however, has extended its deadline for a decision until August 2. Mr Winter and crossbenchers were given a briefing on Tuesday, where they were taken through a presentation on the project and were first able to see thousands of hard-copy pages of information. They were required to keep information confidential and were told the government intended to proceed with its final investment decision for Marinus Link. Greens leader Rosalie Woodruff described the process as "a sham", independent candidate Peter George said it did not show "respect" to crossbenchers, and independent Kristie Johnston called it a "document dump". Mr Winter said they had not been "properly consulted", and that the public should be able to see details in Treasury's whole-of-state business case, which the government received in May. That business case has not been publicly released. Mr Rockliff then sent Mr Winter a letter on Wednesday with an ultimatum for his support. "Pending your agreement, the Tasmanian government intends to make a positive Marinus FID [final investment decision] on the basis of the Australian government's new and current offer of amendments to the Shareholder Agreement," the letter reads. "As you are aware, not taking a positive FID at this stage will be equivalent to taking a negative FID. The final details of Tasmania's stake in the estimated $5 billion project — designed to give the mainland increased access to Tasmania's renewable energy resources — are still not publicly known. In 2023, the Tasmanian government negotiated its stake down from 20 per cent to 17.7 per cent, bringing it to an estimated $117 million. The project was also reduced from two cables to one, bringing its capacity down from 1.5 gigawatts to 750 megawatts. It also involved transmission line projects in Tasmania's north-west that have attracted community opposition due to significant clearing of native vegetation. Labor, the Greens and independents have also questioned whether the project would result in higher power prices for residential and industrial users in Tasmania. The government promised to release the whole-of-state business case by the end of June, for an investment decision by the end of July. Incoming Liberal MP Bridget Archer said it was not released due to the ongoing negotiations with the Commonwealth, that it contained third-party information, and that the government had secured "a better position" since the business case was completed. When asked if the business case should be released publicly before the investment decision was made, she said, "yes, hopefully". Last week, Mr Rockliff said that releasing the business case publicly before the decision "would be my expectation, absolutely". Energy Minister Nick Duigan said Labor, the Greens and independents now had access to all documentation. Mr Winter replied to Mr Rockliff by letter to say that he would be unable to meet the Wednesday morning deadline. Mr Winter said it was an unreasonable expectation. "This morning, I received a letter from Jeremy Rockliff demanding that I give full endorsement to more than 1,000 pages of material and years of work within 24 hours," he said. "Let me be clear: I won't be bullied into making a decision like that quickly. Mr Winter said Labor supported Marinus Link in principle, but needed more time to assess information that was first presented on Tuesday. Ms Archer said the consultation was in line with caretaker conventions, while Mr Duigan said the "new deal that has been struck with the Commonwealth" was beneficial for Tasmania. "Our commitment to Tasmanians is Marinus will protect power prices without any additional cost to our state, and that's what we are delivering," he said.
