Muthanna Complex tenants face July 30 eviction deadline
KUWAIT CITY, July 16: The Ministry of Finance, through the company managing the Muthanna Complex, has requested all tenants to fully vacate the complex and hand over the leased premises by Wednesday, July 30, reports Al-Seyassah daily. In a notice addressed to tenants, the company called for cooperation and coordination with the complex's management to initiate the handover process within the specified deadline. In the letter sent by the Ministry of Finance to the company concerning the eviction of the Muthanna Complex property, it was stated that the eviction is in line with a decision issued by the Higher Committee for Public-Private Partnership Projects, approving the Muthanna Complex project for public auction under the Partnership Law provisions. The letter emphasized the necessity of vacating the entire complex, including all commercial and residential units, within a maximum period of 30 days from the date of the letter. However, legal experts confirmed that this procedure is illegal, as eviction can only be carried out following a demolition permit, with tenants granted a six-month grace period. In cases of renovations, eviction and evacuation of the leased property are not required. In a related development, the Public-Private Partnership Authority announced an invitation to submit bids for public auction No. 2/2025 concerning the modernization, development, repair, radical maintenance, management, operation, and periodic maintenance of the Muthanna Complex project.

Kuwait tightens grip on foreign property access
KUWAIT CITY, July 16: In a new regulatory move aimed at organizing the real estate market and improving the investment environment, Minister of Justice Counselor Nasser Al-Sumait announced that a draft decree has been submitted to the Fatwa and Legislation Department regarding controls on real estate ownership by foreigners through companies listed on the Boursa Kuwait and real estate funds. Al-Sumait explained that the draft decree was prepared under the provisions of Decree-Law No. 7/2025, which regulates real estate ownership, and is now pending approval by the Council of Ministers. The objective is to strike a delicate balance between attracting organized real estate investment and protecting the demographic structure as well as preventing the exploitation of residential properties for purely commercial or investment purposes. The decree takes into account the legal frameworks specific to citizens of the Gulf Cooperation Council countries and preserves the privileges granted to them regarding real estate ownership in Kuwait. The decree includes the following articles: Article 1: Companies listed on the stock exchange with non-Kuwaiti shareholders, as well as licensed real estate funds with non-Kuwaiti unit holders, may own real estate if their objectives include real estate dealings. The provisions of this paragraph do not affect the right of units supervised by the Central Bank of Kuwait or others to own real estate, per the law of the Central Bank of Kuwait or any other applicable legislation. Article 2: Persons licensed by the Capital Markets Authority (CMA) to practice the activity of investment portfolio managers may open and manage investment portfolios for non-Kuwaiti clients. These portfolios may include securities issued by companies listed on the stock exchange whose objectives include real estate dealings or units of real estate funds. Article 3: Listed companies, real estate funds, and investment portfolios licensed by the relevant regulatory authorities in Kuwait are prohibited from engaging in any transactions involving real estate, plots, or land designated for private residential purposes, whether by sale, purchase, mortgage, transfer of rights, authorization to dispose of the property to a third party, or acceptance of such authorization on behalf of a third party, except for the exceptions granted to units supervised by the Central Bank of Kuwait or any other exceptions specified by law. Article 4: Ownership of any real estate shares in kind may not be transferred to non- Kuwaitis in the event of the liquidation of a listed company or real estate fund, without prejudice to their right to receive an amount equivalent to their share of the liquidation proceeds, unless they have legal grounds permitting such ownership following the applicable laws. Article 5: The provisions of this decree shall not affect the treatment of Gulf Cooperation Council (GCC) citizens as Kuwaitis, per the relevant regulations. Nor shall they affect any provisions regulating real estate ownership contained in other laws. Such cases shall remain subject to the provisions of the laws, regulations, and decisions governing them. Article 6: Each minister, within their respective jurisdiction, shall implement this decree, which shall take effect from the date of its publication in the official gazette 'Kuwait Al-Youm'.

‘Every dinar goes to the right man'
KUWAIT CITY, July 16: Official spokesperson of the Ministry of Social Affairs Yousef Saif Al-Mutairi confirmed that charitable work in Kuwait is subject to the highest standards of transparency and governance within an integrated framework that links donors, projects and beneficiaries, ensuring that every Kuwait dinar reaches its intended recipient. In an interview with Al-Akhbar Channel, Al-Mutairi indicated that the ministry relies on precise monitoring indicators to evaluate the performance of charitable organizations. He explained these indicators begin with the financial indicator, which includes audited budgets and financial reports detailing revenues and expenditures for each project, while controlling administrative expenses and transparently disseminating data to donors. From an administrative perspective Al- Mutairi stressed the need for a clear organizational structure within the organizations, appointment of a general manager and an independent internal auditor, and documenting internal regulations and holding official meetings to ensure compliance and integrity. Regarding monitoring activities, he emphasized the importance of measuring project completion rates and ensuring they are implemented according to plan. He underscored the need for careful monitoring of external projects through reports that include photos and plans, as well as field visits to confirm implementation. He also emphasized the need to evaluate implementing agencies abroad in terms of efficiency and accreditation, focusing on a project's sustainability rather than temporary implementation. He asserted that charitable work in and outside Kuwait is left to the discretion of associations based on community needs and donors' desires, indicating the ministry is committed to achieving a balance that ensures the benefit of those in need in Kuwait as well. He disclosed that the ministry has moved from prior oversight only to a combination of prior and subsequent oversight to overcome challenges and ensure complete transparency. He warned that any donation outside official platforms is a violation, even if the intention is good, and that no individual is allowed to collect donations under his name. He pointed out that the 'Central Aid' platform, launched by the ministry to control and regulate donations, is a pivotal tool that connects donors with beneficiaries through associations, prevents duplication, and enables accurate assessment of cases through registration via the Kuwait Mobile app. He affirmed that the ministry uses monthly reports to evaluate the performance of associations according to these indicators. 'Compliant associations are granted broader powers to collect donations, while non-compliant associations are given development notes, with the possibility of taking strict measures, such as suspension, in the event of serious violations affecting donor funds,' he clarified.
