the bloodstock billionaire allegedly threatened any sale of Barne estate to anyone other than him, as he claims was agreed, would put the defendants in 'litigation for years' and cost 'millions'.
Anna Thomson-Moore, the wife of defendant Richard Thomson-Moore, has told the High Court that the family had to take out a commercial loan in order to fight the case taken by Mr Magnier over the collapse of the alleged deal for the land.
Mr Magnier wants the court to enforce a €15 million deal he claims he agreed with Mr Thomson-Moore in a handshake deal for 751 acres of the land in Co Tipperary on August 22nd, 2023, at Mr Magnier's Coolmore home.
In her evidence on Friday, Ms Thomson-Moore told defence barrister Martin Hayden SC that on September 7th, 2023 – two weeks after the claimed handshake deal – Mr Magnier called to Barne with his son, JP, and met the Thomson-Moores, who told Mr Magnier they had to work through tax issues and involve the trustees of the estate to complete any deal.

Ms Thomson-Moore said at the end of that conversation their estate agent, John Stokes, who had walked out with the Magniers, returned to the house with two brown envelopes given to him by JP containing a total of €50,000 in cash about which she felt 'uncomfortable' and told Mr Stokes this.
Ms Thomson-Moore told Mr Hayden the money was put in their safe at Barne and that the following morning they decided to return the money as Ms Thomson-Moore was now 'very uncomfortable' with the situation.
The Magnier side has told the court the money was a token of 'appreciation' to the Thomson-Moores for letting the Magnier side on to the land before any sale was finalised.

The Magnier side was ultimately gazumped by Irish-born, US-based construction magnate Maurice Regan, who offered €22.25 million and was made the preferred bidder. Mr Regan is not a party to the case.
The Magnier side has sued the Barne estate, Mr Thomson-Moore and three companies of IQEQ (Jersey) Ltd group, seeking to enforce the purported deal, which they say had been 'unequivocally' agreed.
The Barne defendants say there was never any such agreement, as they needed the consent of the trustees to finalise any agreement, and subsequently they preferred to sell the estate to Mr Regan.
The Barne estate has been held for the benefit of Richard Thomson-Moore and others by a Jersey trust.
Mr Magnier claims the deal had been agreed at the kitchen meeting and there had been no mention of it being subject to trustee approval, which he has said to the court on numerous occasions.
Ms Thomson-Moore told the High Court on Friday Mr Magnier was told a number of times before the alleged deal that any agreement was subject to the consent of the trustees.
Both sides entered into an exclusivity agreement from August 31st to September 30th, 2023, stipulating the estate would not permit itself or its representatives to solicit or encourage any expression of interest, inquiry or offer on the property from anyone other than Mr Magnier.
During September 2023, said Ms Thomson-Moore, Mr Regan had offered around €20 million for the estate but the trustees recommended honouring the exclusivity agreement with Mr Magnier.
Ms Thomson-Moore said she was 'frustrated' that the trustees were not looking at the higher offer at all.
After the expiry of the exclusivity deal, she said there was a 'flurry' of calls in early October 2023, during which time Mr Stokes told the Thomson-Moores Mr Magnier had told the estate agent he would take the matter to court and 'tie this up for years and millions in litigation'.
Ms Thomson-Moore said a commercial loan was taken out by the defendants under Barne Estate Ltd to provide liquidity to defend the Magnier action.
'We did not have the means to defend these proceedings without a loan. I think it is important to have access to justice and we were being steamrolled into proceedings because of a lack of cash and it would not be fair. It felt like an onslaught of proceedings that kicked off very quickly,' she told the court.
Ms Thomson-Moore, a solicitor, said the stress and impact of the proceedings initiated against them had been 'enormous' and that this had become 'oppressive'. She said it also had delayed the family's plans to move to her native Australia to attend to the health needs of their son, who needs around-the-clock care.
The case continues before Mr Justice Max Barrett.

Staff at a Dublin -based research and development subsidiary of Amazon that made a loss of €23 million last year were paid on average of just more than €124,000 each, latest accounts show. When pension payments, share awards and social welfare costs were added in, the average cost for the 1,540 employees at Amazon Development Centre Ireland Ltd was €172,000. The accounts show that the workers at the Irish entity were paid €191.2 million between them in wages and salaries in 2024. In addition, social welfare costs amounted to €22.3 million, while pension payments totalled just under €5 million and share-based costs amounted to €47.2 million. In 2023, the Amazon subsidiary paid its then 1,581 staff €195.3 million in wages and salaries, giving an average of just more than €123,600. Total payroll costs amounted to €279.8 million for the year. The share awards over the past two years were primarily in the form of restricted stock units (RSU). These represent the right to receive shares in Amazon on a one-for-one basis upon vesting. Typically, employees have to serve between two and five years before the shares vest. Unvested stock for staff who don't fulfil the terms of service is forfeited. The Amazon company is focused on contract research and development for other entities within the Amazon and Amazon Web Services family. The accounts note that it is 'dependent on the continued success of the group of companies'. Its administrative expenses declined in 2024 to €275 million from €297 million a year earlier. The tech giant's subsidiary closed the year with accumulated losses of just under €100 million, up from €77 million at the end of 2023. Its net assets rose to €120 million last year, up from €95 million at the end of the prior financial period. No dividend was paid last year. A going-concern note in the accounts states that has 'sufficient financial resources' to support the Irish company. In spite of its losses, the accounts show the company paid Irish corporation tax of just more than €1 million in 2024, related to an adjustment in relation to share-based payments. Its immediate parent company is listed as Sales Inc, based in Seattle. Amazon did not comment on the accounts when contacted. Amazon has been operating in Ireland for more than 20 years. In total, Amazon employs 6,500 people in Cork, Dublin and Drogheda across data centres, Amazon Web Services and its fulfilment centre in Dublin. Among the roles at these operations are data engineers, operations management, and finance. Revenues at the company's web services arm, Amazon Data Services Ireland (ADSIL) Ltd, rose by €1 billion to €7.09 billion last year, while its pretax profit increased 23 per cent from €15.16 million to €22.96 million. Accounts filed recently for ADSIL show its pretax profit increased by 23 per cent to €22.96 million on the back of the soaring revenues in the 12 months to the end of December last.

The real Temple Bar: Thriving cultural quarter or ‘a violent post-apocalyptic place'?

Ask any Dubliner where to go for pricey pints, tourist tat, and the type of 'traditional Irish' establishment they would never themselves frequent, and they'll happily give directions to Temple Bar . Ask them to point towards Dublin's cultural quarter, however, and they are likely to be a bit nonplussed. Temple Bar has, since its inception, been promoted as the city's cultural quarter, but most would agree it has strayed considerably from that vision. The origins of the present-day Temple Bar lie in a plan devised 50 years ago by CIÉ to develop a new central bus station for the city. From the mid-1970s the company began to buy up buildings, and the many derelict sites, in the area between Dame Street and the south Liffey quays with a view to levelling them for the new transport hub. Government funding was slow to follow the transport company's scheme, so with admirable fiscal rectitude CIÉ rented out the properties (those not in use as surface car parks at least) at low rents to Dublin's 'bohemian' set – artists, musicians and independent retailers – and in doing so sowed the seeds of the demise of its bus garage plans. He envisioned a district of 'attractive small places' with 'recording studios, places for the music industry, art galleries, studios' and also 'pubs, restaurants, discos – anything that contributes to a lively inner city young people's place'. An urban renewal act and a tax incentive scheme came into force in 1991, a development company – Temple Bar Properties – was established, and Temple Bar was born. Photograph: Dara Mac Dónaill It didn't take long before property prices began to rise, as they did across the city in the 1990s, and for the more lucrative enterprises – pubs, night clubs, hotels and restaurants, to start pushing out the artists and smaller independent operators. By end of the decade it had become a byword for hedonism, even targeted in 2001 by a Channel 4 documentary series of the type that focused on the bad behaviour of 'Brits abroad', though generally in sunnier climes. [ The rise and fall of the Temple Bar dream: 'I feared that our home would become uninhabitable' Opens in new window ] In part to counteract this image, the Noughties saw a definite shift in emphasis in the development of Temple Bar from growth to management, with Temple Bar Properties becoming the Temple Bar Cultural Trust in 2005. However, within a few years that entity had run into difficulties, with several reports and audits identifying financial, governance and regulatory weaknesses. Photograph: Dara Mac Dónaill In 2016 the council published a public realm plan to improve the area, which resulted in not very much for quite a long time, but eventually in 2023 led to a €5 million upgrade of Temple Bar Square, the focal point of the eastern end of Temple Bar. The year 2016 also saw a significant intervention in the fight against overtourism in the district, spearheaded not by the council but by Temple Bar residents who sought a ruling on whether or not planning permission was required to use an apartment for holiday rentals. The council planners determined it was required, a ruling upheld by An Bord Pleanála . This ultimately led to a city-wide and then State-wide crackdown on the unauthorised use of homes for short-term letting, and while that battle goes on, it would never have started without the intervention of those residents. Photographs: Dara Mac Dónaill The council has in recent years upped its game in efforts to rein in the worst excesses of Temple Bar, using the planning process. The 2022-2028 city development plan includes a number of provisions to guard against the expansion of pubs and takeaways, and to avoid the concentration of the types of shops which would 'reinforce particular activities in the area to the detriment of the cultural, residential and social functions of the area'. A number of planning applications have been refused by the council since these provisions were introduced, though some of these decisions have been overturned on appeal to An Bord Pleanála. The council has, in the last two years, increased the number of artists' studios in Temple Bar and plans to refurbish the long-closed Eden restaurant in Meeting House Square to provide more. It is also in the process of taking ownership of the historic Smock Alley Theatre at the western end of Temple Bar to create a new Dublin municipal theatre. Photograph: Dara Mac Dónaill Perhaps the council's most significant physical intervention in Temple Bar is its most recent: the removal of traffic from Parliament Street since July 4th, which is likely to attract more activity, from the eastern end of the district. Some in the quieter west end may have misgivings over what may be drawn upon them. The image of Temple Bar has been severely tarnished by several violent assaults – on tourists, as well as on two off-duty gardaí . The stark depiction by Judge Pauline Codd, at an assault sentencing hearing last year, said Temple Bar was becoming a ' a violent post-apocalyptic place'. 'It's shocking to see it, that people can't be safe down there. It makes it a no-go area for people.' The IFI in Temple Bar. Photograph: Dara Mac Dónaill Martin Harte, chief executive of business group the Temple Bar Company, says dystopian assessments are not fair characterisations of the area. 'I think a lot of the criticism and the view or positioning of Temple Bar comes from the late 1990s and early Noughties and that massive, mad drink culture. It was true then, there were queues outside every pub and hotel; it certainly isn't true now,' Harte says. He argues that there is an overconcentration of addiction and homeless services throughout the city centre. However, he believes the district is moving closer to the original vision of a cultural, entertainment area, but also a residential quarter. 'Certainly in last couple of years the vintage clothes shops are back, the tattoo parlours, the cafes, the cultural collectives, the private galleries – they've really come back. Of course some have been lost, but a huge amount have come, and Temple Bar has a thriving cultural scene. I think it's probably going to get closer to what people thought it might be in the first place. I think its best years are ahead of it,' Harte says.

Brash Italian banker seeking to lift barriers to European deals may make it harder for others

Jamie Dimon , the fast-talking head of US banking giant JP Morgan of almost two decades, didn't mince his words when asked at a Department of Finance event on Thursday for business and policy leaders about the state of the Democratic Party . 'I have a lot of friends who are Democrats, and they're idiots,' said the 69-year-old. 'I always say they have big hearts and little brains. They do not understand how the real world works.' 'They're very ideological,' he said, as part of a broad-ranging discussion that spanned financial markets (they're too complacent about Trump 's administration reaching trade deals, he reckons) to artificial intelligence. Dimon – the go-to for US authorities when looking for a rescue buyer for ailing banks during times of crisis, having taken on Bear Stearns and Washington Mutual in 2008 and, more recently, California's First Republic Bank – feels he's earned the right to be heard on subjects outside his bailiwick. READ MORE [ Commerzbank delivers surprise profit jump as it fends off UniCredit Opens in new window ] His latest annual letter to shareholders, published in April, took aim at the likes of uncontrolled immigration, 'incompetent government', culture wars, and the US's education and healthcare systems. On a tour of some JP Morgan operations in Europe this week, Dimon had no problem securing private audiences with Italy's prime minister Giorgia Meloni, German's new chancellor, Friedrich Merz, and Taoiseach Micheál Martin. What European banker could get such access? Certainly not the one who would see himself as Europe's answer to Dimon – Andrea Orcel, chief executive of Unicredit , Italy's second largest bank. Orcel, a suave, brash, 61-year-old, who spent most of his career in investment banking, has set his sights on turning Unicredit into a European banking champion since he took charge four years ago. It would be in line with the European Central Bank's (ECB) ambition of having stronger pan-European banks to boost the resilience of the sector with more diverse earnings – hoping that tougher regulation and bail-in tools since the financial crisis offer protection against the obvious too-big-to-fail risks. The ECB's former president, Mario Draghi, highlighted in his landmark report last year on EU competitiveness that part of the problem is the fragmented, traditionally less profitable European banking landscape, with lack big European players compared to their US. JP Morgan, the world's largest most valuable bank with a market capitalisation of $800 billion (€684 billion), is more than six times the €107 billion value of Spain's Santander, the largest in the euro zone. UniCredit and Italian peer Intesa Sanpaolo are hovering around €90 billion. Orcel has ruffled feathers in European capitals to make his mark. Last September, he caught the German establishment off guard when he revealed he had quietly built up a 9 per cent stake in Commerzbank, the country's second largest bank and key finance provider to its SMEs. Berlin unwittingly handed half the stake to him when it sold down its Commerzbank stake on the market. The disclosure prompted a backlash from politicians, businesses and unions – wary of how Unicredit had cut two thirds of the jobs and hundreds of branches at German regional bank HypoVereinsbank since it bought the then struggling lender in 2005 to boost profitability. Then chancellor Olaf Scholz slammed the move as 'an unfriendly attack'. Undeterred, Orcel accumulated financial derivatives over the following three months entitling him to buy a further 21 per cent of Commerzbank. But, by then, he had also launched an all-share bid for smaller Milan rival, Banco BPM – a bank Orcel had previously run the rule over in 2022. Here, too, he encountered political resistance, with Meloni's government, which is more keen creating a third banking force through tie-ups below Unicredit and Intesa Sanpaolo, the country's largest bank. Rome has used so-called golden powers to impose conditions on Orcel's bid for Banco BPM – including a stipulation that Unicredit halt activities in Russia, where it and Austria's Raiffeisen are the two main remaining Western lenders. Vladimir Putin's officials, however, are making it difficult to reverse out of that market by imposing stiff discounts and exit taxes on asset sales by business from 'unfriendly' countries. Unicredit's designs on Banco BPM are at a critical juncture. Its court appeal against the imposition of the 'golden power' was heard this week and a decision on that is due by next Wednesday. The European Commission is also raised concerns about Rome's heavy-handedness. Unicredit's bid – now valued at €14.5 billion – is currently set to exposure on July 23rd. Orcel issued a reminder to Berlin this week that he hasn't gone away – more than doubling its equity stake in Commerzbank to about 20 per cent by converting some of its derivative contracts. UniCredit said it also plans to convert the remaining 9 per cent it holds in derivatives without specifying when. The hostile move triggered an obvious response. Germany's finance ministry reiterated a rejection of Unicredit's 'uncoordinated and unfriendly' approach, ruling out a sale of the state's remaining 12 per cent stake in Commerzbank. A near-term bid is unlikely as the immediate focus is on Banca BMP. A more than doubling of Commerzbank's share price since last September also makes it difficult for Orcel to make an outright offer at these levels and achieve his minimum 15 per cent return on investment on deals, according to analysts. To be sure, Unicredit, which has a decent presence across central and eastern Europe, has had a friendlier reception elsewhere of late. A move to double its take in Greece's Alpha Bank to 20 per cent – and plan to increase it further to just under 30 per cent – in May has been warmly welcomed by the government and regulators in Athens. Some might see Orcel's aggressive approach elsewhere as necessary to breaking down barriers. But it risks stoking banking nationalism across Europe – making it harder in future for other would-be consolidators.
