Man who claimed partner deliberately stabbed herself fails in appeal

A man convicted of manslaughter, who claimed that his partner deliberately stabbed herself to death, has failed in a bid to have his 12-and-a-half-year sentence reduced on appeal.
Martin Hayes (36) was found not guilty of Amadea McDermott's (27) murder, but guilty of her manslaughter by the majority verdict of a Central Criminal Court jury in November 2023.
Hayes, with an address at Poddle Close, Crumlin, Dublin 12, had pleaded not guilty to murdering the mother of two at her home in Rathvale Drive, Ayrfield, Coolock, on or about July 20th, 2017.
He told the trial that his partner inflicted the injury on herself. Hayes had admitted using violence against Ms McDermott in his own evidence to the trial.

Mr Justice Paul McDermott sentenced him to 12 years and six months in November 2023.
Speaking following Haye's conviction in 2023, Eucharia McDermott described her sister's killer as a 'deranged monster'.
Hayes appealed his sentence, arguing that the judge gave excessive weight to the aggravating factors in the case, specifically in setting a headline sentence of 14 years.
James Dwyer SC, defence counsel for Hayes, also argued that inadequate weight was given to the mitigating factors in the case resulting in a final sentence that was 'higher than it should have been'.
In dismissing the appeal on Tuesday, Mr Justice Patrick McCarthy said there were limited mitigating factors in this case. He said the judge rightly placed the offence in the category attracting a headline sentence of between ten and 15 years.
The offence was aggravated by domestic violence, he said, noting there had been evidence of 'fresh violence' to the face of the deceased, which it was accepted occurred on the night of the killing as well as older bruises indicating previous violence.
Mr Justice McCarthy said there was also evidence of 'an unhealthy, extreme and unfounded' view of purported impropriety of a sexual nature which indicated a 'very significant form of coercive control'.
He also noted the circumstances of the appeal were 'slightly out of the ordinary' in that it had been contended that the judge fell into error in the decision he made as to the factual circumstances for the basis of manslaughter.
Dismissing this ground of appeal, he said the trial judge approached the matter in a rational way upon the evidence and adopted what might be described as 'the rational, obvious and clear view' of what happened.
Imposing sentence in November 2023, Mr Justice Paul McDermott said the killing was clearly a case of domestic violence and he noted that during her life, Hayes had tracked Ms McDermott's movements using a secret app on her phone.
The judge further noted the recent bruises on Ms McDermott's body as recorded by a pathologist following her death and evidence that Hayes had a history of aggressive and violent behaviour towards his victim.
In 2023, Amadea McDermott's sister, Eucharia, said that Hayes had told 'lie after lie without a shred of evidence' in his testimony to the trial when he falsely alleged that Ms McDermott had caused her own death by stabbing herself.
She thanked gardaí and the prosecution team who had, she said, 'helped to convict this violent, sick, evil, twisted, deranged monster.'

Former meat-factory worker Mario Pompa sued his employers Hilton Foods (Ireland) Ltd over a shoulder tear sustained while carrying heavy loads He was awarded a total of €17,958 including €11,000 for his shoulder, €5,000 for the neck and back pain, and €1,958 in special damages. Hilton Foods, which was insured by Aviva, subsequently appealed the decision. While the defendant accepted ­liability, it was argued that Mr Pompa was exaggerating his injuries. 'In the absence of evidence as to when these videos were made, I must disregard the videos,' she told the appeals court sitting in Dublin. Regarding discrepancies in some of Mr Pompa's evidence, Ms Justice Phelan noted how English is not his first language as he is originally from Slovakia. She said his 'thought process was a little delayed by reason of this' and it was 'not surprising' that after five years he did not remember exactly what he had told his GP. Ms Justice Phelan said she could not penalise him for the lack of detail in the medical reports about him going to the gym because none of the doctors were called to give evidence. Read more Therefore, the judge was not able to ascertain what questions were asked during the consultations. 'I am satisfied that having observed him, heard his evidence and looked at the medical reports, that he did not exaggerate his symptoms or the severity of his injuries,' she said. An MRI scan had shown he had ­suffered a deep tear in his shoulder, which she was satisfied was caused by his work at Hilton Foods. While she considered the injuries to be in the minor range, she said she had to depart from the personal injury guidelines because she did not believe his injury made a substantial recovery within two years. 'The minor range does not provide for substantial resolution outside of two years,' she said. Mr Pompa was awarded a total of €18,250 including €14,000 for his shoulder injury, €2,500 for his neck, back and arm complaints, and €1,750 in special damages.

Three men charged in relation to seizure of €340,700 in cash

Three men have appeared in court charged in connection with the seizure of more than €340,700 in cash in Drumcondra, north Dublin on Friday. Mohamed Alsourani (43), Anas Altahlh (40) and Issa Al Aboud (43) appeared before Dublin District Court on Saturday evening. The three men are charged with being in possession of the cash knowing or believing it was the proceeds of criminal conduct. Gardaí told the court that the men were stopped in a taxi while on the way to Dublin Airport after the Garda Response Team received confidential information. The men had arrived in Ireland on July 22nd and stayed in a room in a hotel in the north inner city. The court heard two of the men are Syrian-Swedish citizens and that an Arabic translator would be required for the third man. Police in Northern Ireland investigating the deaths of a woman and her children in Maguiresbridge , Co Fermanagh, have appealed for more information regarding the movements of a vehicle. The victims have been named as Vanessa Whyte (45), originally from Co Clare, and her son and daughter, James and Sara Rutledge. Sara was 13 years old and James was 14, the Police Service of Northern Ireland (PSNI) said. A fourth individual, an adult male, is in a serious condition in hospital in Belfast . READ MORE A murder investigation has been launched, and the Police Service of Northern Ireland (PSNI) said one line of inquiry was a triple murder and attempted suicide. Detectives from the major investigation team, conducting the murder investigation following the shooting incident, are continuing with their enquiries. On Saturday, the PSNI issued an appeal for information involving the movements of a vehicle. 'Our investigation is ongoing and we are working tirelessly to determine the exact circumstances of this tragedy,' Detective Chief Inspector Neil McGuinness said. A book of condolence, set up next to a framed photo of the family and surrounded by white flowers and candles, was also opened at the school. The deaths have caused widespread shock across the small Co Fermanagh community. Flowers, teddy bears and an Arsenal football top with written notes have been laid close to scene of the incident in Drummeer Road.
