A PEOPLE smuggler who trafficked nine adults and two children has argued that being deported would be too disruptive for his kids.
Miklovan Bazegurore's lawyers tried to argue that being extradited to Belgium would breach his right to family life.

They claimed that his daughter, 10, who has special educational needs, would suffer if he was jailed in a different country.
The Kosovan national was locked up in 2018 after pleading guilty at Aylesbury Crown Court to conspiracy to facilitate illegal immigration.
He had links to a lorry that was caught by the National Crime Agency in Milton Keynes in 2016 having nine Albanian adults and two children
hidden next to a concrete mixer inside.
Since his release in 2023, he has been fighting extradition to Belgium, where he was handed a separate conviction for people smuggling and sentenced to five years.

His lawyer tried to argue that extraditing him would 'be extremely disruptive for the children', according to The Times.
But The Court of Appeal his offences as part of an 'international smuggling ring" were so bad that extradition outweighed the impact on his kid.
Bazegurore is expected to be deported in the next few weeks.
It comes after a sick Palestinian gran won permission to come to Britain for medical treatment — despite fears it could undermine immigration controls.
The 67-year-old has a daughter, 50, living in Britain.
She argued successfully at an immigration tribunal last month they had a right to family life under a European Human Rights rule.
But in court documents seen by The Sun on Sunday, the Home Office warned it could also lead to a 'proliferation' of similar applications.
The woman, who suffers from spinal stenosis, is financially supported by her daughter.
She lives in war-torn Gaza City and was deemed vulnerable by the tribunal as she suffers from PTSD and depression.
The treatment is expected to cost about £20,000 at a private hospital in Windsor, Berks, and the woman will return to Gaza after it is completed.
Upper Tribunal Judge Rebecca Owens allowed her appeal for a visitor visa.

Keely Morgan, 15, had been crossing the street in Caerau, Cardiff, at around 9.30pm on May 1, 2023, when she was hit by Christopher West, 42, just months after undergoing a life-saving kidney transplant. The driver, who was sentenced today at Cardiff Crown Court to 16 months in prison, had been travelling with his two daughters and their friend when he crashed into Keely. One of the passengers told police West had been "snaking" along the road and had removed his car's black box, which invalidated his insurance. The motorist had also showed off the fact he had removed it before causing Keely's death. West previously pleaded guilty to causing death by dangerous driving and causing death while uninsured. Despite also claiming that his driving had been normal, testimonies from his passengers countered these claims. At his sentencing today, West was branded as an "irresponsible show off" by judge Paul Hobson. He said: "Keely Morgan was just 15-years-old when she died on May 1, 2023. While West had been described as "apologetic" and in a state of panic after the crash, the judge slammed this view. "Although you may well be sorry for what happened to Keely, a large part of your concern is for yourself." Not only was West handed a 16-month prison sentence but he was also disqualified from driving for two years and eight months. 'NO SENTENCE WILL EVER BRING HER BACK' Earlier this week at the trial, Keely's mum Sian Morgan paid an emotional tribute to her daughter in her victim statement. Sian said her daughter had been given a "second chance of life" aged 13 and had fought "so hard" to live a normal life. The tragedy of her "preventable" death will haunt her forever, she continued. Sian said: "She fought so hard to have the opportunity to live a normal life and have the joys of being a teenager. "She remained brave, courageous, and positive, but those dreams have been cruelly taken from her in an instant. "She'll never be able to finish school, go to university, follow her dreams, experience the joys and the milestones of life. "She had so much love to give. She was truly an incredible person with promise and a future ahead of her." The young girl's devastated parents described the tragedy as "beyond repair" and a loss they will carry for the rest of their lives. Her life mattered. Her death must mean something. Sian Morgan Sian said: "Every day I wake up and relive a nightmare. Her loss ripples through every part of our lives. "My heart aches every day for my daughter who I can no longer hug or see the incredible person she could have been. "The world is a darker place without her. The trauma of losing her in a sudden, violent, but preventable way haunts us." She added: "This was totally avoidable. That one decision, that one moment, took everything from us. "A pedestrian crossing is meant to protect people like Keely who was using the crossing appropriately as she had a right to do so but she was struck and killed. "Her life was taken by the drastic failure of you and you alone. You had a duty to uphold fundamental safety laws of being safe while driving and you chose not to do so. "She was an irreplaceable part of my life and her family loved her more than words can say. "Her life mattered. Her death must mean something. No sentence will ever bring her back."

She said she fell in love with Davidson and that he had told her that he loved her back. Davidson told her he would take her to his house and out for dinner once she was old enough to leave school. Davidson went on to stroke the girl on the face and called her "pretty." The dad-of-three made further comments in front of pupils, such as boasting about the size of his manhood. Davidson, of Milngavie, East Dunbartonshire, was found guilty of two charges of engaging in sexual activity with a pupil. He was also convicted at a Glasgow Sheriff Court of two further charges of conducting himself in a disorderly manner. Sheriff Michael Hanlon ordered Davidson to do 200 hours of unpaid work and put him under supervision for two years. Davidson was also put on the sex offenders register for two years. The court heard from a now 19-year-old childcare student who recalled having Davidson as her English teacher at age 14. I told him that I loved him, and he said that he loved me back." The teenager stated that she texted him that she loved him, but Davidson responded in person. She further recalled being asked out to dinner by Davidson. The girl added: "He would tell me about his bedroom and that after I left school, I would go to his house. He said his bedroom had mirrors." I really liked him and thought he liked me back. I told him that I loved him, and he said that he loved me back Girl giving evidence The girl stated that at one time they spoke about his aftershave. She said: "He put his arm around me and said 'smell' then touched my face." Davidson also called her "pretty" on another occasion and remarked that he liked the girl with her legs crossed. The girl claimed that she did not report Davidson as she did not want him to get "in trouble." She added: "I thought after I left, there would be a chance to be with him." A 31-year-old woman - who is now a primary school teacher - told the court that she was taught by Davidson in fourth year. She described Davidson's classes as "uncomfortable" and "informal." The woman stated that Davidson would walk in front of her at "waist height" while facing her. She added: "He would lean himself on the table so his groin was on the table. He would wear particularly tight trousers." "I was given into trouble and walked out of the class, and then I told the deputy head of the department because I shouted and swore at him." The woman stated that "nothing came" from the report. She also said that Davidson would lick his lips and raise his eyebrows. He would lean himself on the table so his groin was on the table. The section referred to a "nasty, dirty, wide hole." A 24-year-old former student earlier told jurors that Davidson would "stand close" to her in class. She said: "It wasn't just me, there were other students, we were eye level with his crotch." The now bar tender claimed that "creepy" Davidson made her feel "uncomfortable." The woman stated that Davidson also told her that he was attracted to people who smoked. Prosecutor Kyle Dalziel asked the witness if Davidson was aware that she smoked, and she replied: "Yes." The woman further claimed Davidson complimented her on her body and told her that she had a "womanly figure." She stated that Davidson had a picture of Marilyn Monroe with her white dress on the wall of his classroom. Deirdre Flanigan, defending, put it to the witness that Davidson does not recall making the remarks on the school trip. The advocate followed up by asking if the woman had spoken to someone in the school administration about him. The woman replied: "I didn't report him, but I should have. At 17, it is daunting to speak up." Mr Dalziel later followed up with a similar question about why she did not speak up and the woman replied: "I didn't feel like I would be believed." Davidson - who is now a legal assistant at a law firm - told the court in his evidence he had "suspicions" that one of the girls liked him. He stated that he was "deeply ashamed" for not reporting the matters to senior members of staff at the school. Davidson added: "I am deeply sorry it ended up the way that it has - I was definitely swayed. "I should have reported it, and I didn't, seeing the girl giving evidence was horrifying viewing. "Each time she had messaged and I didn't reply, she would appear sheepish, embarrassed and apologetic for sending them and not to tell anyone."
