Investigation continues into André Naude's murder five weeks later

Five weeks after alleged underworld figure André Naude was murdered, police have confirmed no arrests have been made.
Police spokesperson, FC van Wyk, said: 'Kindly be advised that the matter you are referring to is still under investigation. There are no new developments to report to the media at this stage.'
Naude was shot and killed in a hail of bullets on June 12 in Voortrekker Road, Parow.
Police said he had been in the company of friends when he was ambushed by gunmen inside a vehicle.
Naude, 55, died at the scene while a 61-year-old man was wounded and two others aged 45 and 55 were unharmed.
IOL reported that at the weekend, two lives were lost during a shooting in Voortrekker Road in Parow.
It is understood that a gunman in a silver VW Polo had opened fire.
Police spokesperson, Joseph Swartbooi, said two persons were killed and two others left wounded during the shooting.

Naude was no stranger to controversy and was murdered just months after his apparent business partner, Mark Lifman was gunned down in a parking lot in George.
Both were charged with the murder of Brain Wainstein, known as the Steroid King.
Naude was also friends with alleged leader of the Sexy Boys, Jerome 'Donkie' Booysen.

Trial of alleged Durban hitman delayed due to absent lawyer
The trial of two hitmen has had a setback as lawyer Sthembiso Nkatha fails to come to court Image: FILE Concerns as a trial of alleged hitmen charged with 15 murders faces delays due to a lawyer who also acts as a Magistrate has been a no-show at the Durban High Court. The lawyer has 'failed' to formally excuse himself from the case. The murders include the mass shooting at Durban's iNanda, which resulted in the death of six people. The said lawyer, Sthembiso Nkatha, represents Sbonelo 'Madanon' Wiseman Shangase. Shangase is charged alongside Thalente Mkhize. They together face 28 charges, including the 15 murders, robberies, attempted murders, possession of firearms and ammunition, and kidnapping. Their trial was scheduled to run from July 21 to August 22; however, on Monday, the matter could not commence as Nkatha was not present. Additionally, last year, the pre-trial of the men faced delays due to Shangase's payment issues with Nkatha. However, despite all of that, Nkatha committed to Judge Bruce Bedderson that he would continue representing Shangase after he was assured of payment. On Thursday, Shangase made a brief appearance at the high court before Judge Jacqueline Henriques, who asked him if Nkatha had contacted him regarding funds. 'Is there a possibility that he may have contacted members of your family?' she asked. Shangase seemed to be in the dark. Judge Henriques asked him if any of his family members were present in court. Shangase turned back to look at the gallery and responded by telling the Judge that no one was there. She asked Shangase if he had consulted with Nkatha before July 21, and he said no. Judge Henriques, who looked concerned and kept on brushing her hair with her hand and seemed frustrated, asked again when Shangase had a consultation with Nkatha. Shangase said it was before the end of 2024. Additionally, it had been said that Nkatha withdrew his services due to non-payment; however, the State senior prosecutor, advocate Krishen Shah, told Judge Henriques that he had not received an email from Nkatha stating that. He said in the past weeks he had emailed Nkatha and advocate Phumelele Daniso from Legal Aid additional statements, and it was delivered to both of them. Daniso is representing Mkhize. 'There was no response from Nkatha,' he said. Shah confirmed to Judge Henriques that Nkatha acts as a magistrate. Judge Henriques asked Shah to forward her the email he had sent to Nkatha and delivery receipts. He adjourned the matter to Monday for Shangase's legal representation issue.

NPA's decision not to prosecute Sassa fraud raises concerns over accountability
South African Social Security Agency has not completed lifestyle reviews, investigations, and audits have on the 11 implicated officials in compliance with remedial action by Public Protector Kholeka Gcaleka Image: File The National Prosecuting Authority (NPA) has declined to prosecute fraud and corruption in connection with the multi-million contract awarded by the South African Social Security Agency (Sassa) to Azande Consulting citing lack of prospects of success. This was revealed by the Police Ministry when it was responding to parliamentary questions from DA MP Alexandra Abrahams when she enquired whether the Hawks received request to probe possible bid rigging and corruption. This was after then acting Public Protector Kholeka Gcaleka found in 2022 that Azande Consulting should have been disqualified as it did not meet the requirements for the door-to-door survey performed as part of the Integrated Community Outreach Programme in nine provinces over a period of three years. Gcaleka also found that Sassa's Bid Adjudication Committee failed to do due diligence for an appointment made by the Bid Evaluation Committee, prior to accepting and approving Azande Consulting as one of the preferred bidders. In her remedial action, Gcaleka referred to the DPCI to consider conducting criminal investigation for possible bid rigging and corruption. Gcaleka also said that the Sassa CEO should consider conducting periodic lifestyle audits on 11 implicated officials and take action against them for breaching the institution's code of conduct. In its reply, the Police Ministry confirmed that the Directorate for Priority Crime Investigation received a request to conduct a criminal investigation in the matter that related to possible fraud and corruption. It also said the matter was officially reported to the DPCI by the Department of Social Development in August 2021 and a comprehensive investigation was conducted. 'The investigation was finalised, and the matter was submitted to the National Prosecuting Authority (NPA), on 2024-04-03, for a prosecutorial decision. Following a review of the evidence presented, the NPA declined to prosecute on 2024-12-12, citing no prospects of successful prosecution,' the ministry stated. Meanwhile, Social Development Minister Sisisi Tolashe said the lifestyle reviews, investigations, and audits have not yet been completed on the 11 implicated officials in compliance with Gcaleka's remedial action. Tolashe said Sassa has to develop a draft policy framework to guide the implementation of lifestyle audits and reviews. 'This policy is essential to ensure that such reviews are conducted in a manner that is legally sound, procedurally fair, and aligned with best practices in public administration.' She said internal consultations for the draft policy have concluded, with final approval expected by June 2025 and that Sassa was in the process of appointing a suitably qualified and independent service provider to conduct the lifestyle audits. 'Sassa is also undertaking the security vetting with State Security Agency and of the 11 employees, four have completed their vetting process and security clearance issued. 'One is in progress, two outstanding and four have left the employment of Sassa through resignation or retirement.' Tolashe further said once the policy was approved and the service provider is appointed, Sassa will initiate the lifestyle audits and investigations of the 11 officials identified in the Public Protector's report. 'Sassa remains committed to upholding the principles of good governance, transparency, and accountability,' she said.

Accused kidnapper Sameemah Jacobs back in the dock

Cross-examination by Sameemah Jacobs's Legal Aid lawyer, Asongewa Mafuya, is expected to take place in the Bellville Magistrate's Court. Jacobs is charged with kidnapping and defeating the administration of justice and may face additional charges as the investigation continues. A week ago, State prosecutor Salaahuddeen Simon completed his portion of presenting the reasons why Jacobs was not a candidate for bail. Sergeant Dawid Fortuin took the witness stand in which he said Jacobs was a flight risk and that the community's plight had to be considered. He said that a day prior to the kidnapping, a woman by the name of "Chevon" contacted Sharmar and said she would receive R500 in cash and a baby parcel when they attended a workshop in Bellville on June 28. Imaad was found two days later at Jacobs's home following a tip-off from the Tafelsig residents. Fortuin had the court hanging on his lips when he detailed how Jacobs was attempting to breastfeed Imaad and that baby was crying. He said Jacobs had hospital documentation which had been tampered with. In another twist, he said a witness, who cannot be identified, gave police a statement that she had visited Jacobs at the Bellville Police Station following her arrest, in which she claimed that Sharmar had given her the baby and that she did not kidnap the infant.
