Watchdog raps Penang Fisheries Dept, urges disciplinary action over trawler zone breaches
Zone A and Zone B refer to designated maritime zones for trawler operations based on distance from the shoreline, with Zone A being closer to the coast and Zone B farther offshore.
In a statement today, EAIC said its investigation revealed that the Penang DOF has failed to properly monitor enforcement officers under its jurisdiction.
'Inspections at the Batu Maung enforcement base were only conducted once a year. The management was also found to be unaware of the daily enforcement duties performed by its personnel, as well as operational constraints at the base.
'Penang DOF also failed to ensure that the enforcement logbook entries were properly and completely recorded by the responsible officers,' the commission said.
Following its findings, the EAIC recommended that a letter of reprimand be issued to the senior management of Penang DOF involved for ineffective oversight, and disciplinary action be taken against officers who failed to properly record logbook details.
It also proposed that the DOF's standard operating procedures (SOPs) for handling complaints, investigations and operations be improved to include video recordings as evidence, and that training be provided to Penang DOF personnel on compliance with SOPs, guidelines, enforcement protocols, operations and licensing procedures.
In a separate statement, the EAIC said it has received a complaint alleging that Perak Malaysian Maritime Enforcement Agency (MMEA) had released detainees along with a vessel found using 'bubu naga', a prohibited fishing gear.
'The investigation, conducted under Subsection 27(4) of the Enforcement Agency Integrity Commission Act 2009 (Act 700), found that the alleged misconduct could not be verified.
'As such, the EAIC decided to halt the investigation, and no disciplinary action will be taken against the officers involved,' it said.
Nevertheless, in line with Subsection 4(1) of Act 700, the commission has recommended that the MMEA director-general take appropriate improvement measures to prevent a recurrence of similar incidents. — Bernama

PUTRAJAYA: The Enforcement Agency Integrity Commission (EAIC) has recommended that criminal charges be filed against an Immigration Department officer for alleged abuse of power involving the issuance of medical visas to foreign nationals. In a statement, the EAIC said its Special Task Force, led by Commissioner Datuk Seri Dr Razali Ab Malik, had conducted a thorough investigation under Section 17 of the Enforcement Agency Integrity Commission Act 2009 (Act 700). The investigation revealed that the officer had approved medical visit visas for foreign nationals from several countries despite being aware that the supporting documents were incomplete and failed to comply with Immigration Department Circular No. 10/2001. Razali said the task force had examined breaches in the visa approval process, including reviewing compliance with standard operating procedures, interviewing relevant witnesses, seizing documents and compiling recommendations for further action by the relevant authorities. "The EAIC found clear elements of abuse of power in the approval of these visas, which did not meet the basic procedural and documentary requirements," he said. As a result, the commission has referred its investigation findings to the Attorney-General's Chambers with a recommendation to prosecute the officer under the Penal Code (Act 574), the Immigration Act 1959/63 (Act 155), and the Passport Act 1966 (Act 150), in accordance with Paragraph 30(1)(c) of Act 700.

Bank officer loses RM241,700 in online vehicle purchase scam, including EPF savings
KUALA TERENGGANU, July 28 — A bank officer was left devastated after losing his savings, including in the Employees Provident Fund (EPF), totalling RM241,700 to an online vehicle purchase scam. Kuala Terengganu police chief ACP Azli Mohd Noor said the incident began last July 4 when the 52-year-old victim came across an advertisement for a used four-wheel-drive vehicle on Facebook. Intrigued by the offer, he said, the victim clicked on the link and began communicating with the alleged seller via the WhatsApp application and was then instructed to give a copy of his identity card and a sum of money as an advance payment to a representative of the suspect's company, claimed to be based in Port Klang, Selangor. 'Between July 9 to 21, the victim made 40 payments to eight different accounts totalling RM241,700. The victim began to feel cheated when asked to make an additional payment of RM31,000 supposedly for fingerprinting costs at the Royal Malaysian Customs Department (JKDM),' he said in a statement today. Azli said the victim lodged a police report at 9.37am yesterday, and the case was being investigated under Section 420 of the Penal Code. — Bernama

Four reports filed over ‘Turun Anwar' rally, police to investigate effigy caning and drone use
KUALA LUMPUR, July 28 — Police have received four reports in connection with the rally at Dataran Merdeka on Saturday, including one case involving an effigy resembling Prime Minister Datuk Seri Anwar Ibrahim being caned near the National Mosque. Acting Kuala Lumpur police chief Datuk Mohamed Usuf Jan Mohamad said the remaining three reports were related to the use of drones. He said that the effigy case has been referred to the Classified Crime Investigation Unit in Bukit Aman for investigation under Section 41 of the Sedition Act 1948, Section 504 of the Penal Code, and Section 233 of the Communications and Multimedia Act 1998. 'The three other reports related to drones have been forwarded to the Civil Aviation Authority of Malaysia (CAAM) for further action,' he said at a press conference here today.
