Govt may commission market studies before bringing in ex-ante regulations for Big Tech: MoS for corporate affairs

Time of India3 days ago
The government could undertake market studies to build "an evidence-based foundation" for introducing an ex-ante framework under the proposed
Digital Competition Bill
to regulate the Big Tech, minister of state for corporate affairs Harsh Malhotra indicated in the Lok Sabha on Monday.
In a written reply, Malhotra said: "Based on the suggestions/comments/inputs received, it is felt that an evidence-based foundation through market studies is required to consider all relevant aspects for ex-ante regulation considering it is in nascent implementational stages globally."

In March 2024, a high-level official panel led by then corporate affairs secretary Manoj Govil had suggested a new antitrust law with an ex-ante framework to regulate only 'systemically significant digital enterprises' that have a 'significant presence' in India. It had submitted with the
Ministry of Corporate Affairs
(MCA) a draft digital competition bill, along with its report, for consideration.
Malhotra said over 100 stakeholders from various fields had submitted their responses with the MCA on the draft Bill between March and May last year.
Additionally, the ministry of electronics and information technology had organised stakeholder discussions on the draft bill in June last year and those comments are awaited, he added.

The
corporate affairs ministry
is unlikely to bring in the proposed digital competition legislation this fiscal, as it aims to first introduce amendments to the Insolvency and Bankruptcy Code (IBC) and the Companies Act, ET has reported. On top of that, the ministry is also tied up with plans to expand the PM Internship Scheme for youth soon.
Since digital competition is a rapidly-evolving and complex area, the government reckons undue haste in regulations could be counter-productive, people aware of the development had told ET earlier.
Malhotra, too, had said in March that the government was in no hurry and that it would follow all the due processes before bringing in the new law.
Ex-ante framework
Ex-ante regulations
usually stipulate a set of dos and don'ts with an aim to disallow certain practices from being pursued. The Govil panel had suggested that the penalty for violations of rules and regulations be as high as 10% of the digital entity's global turnover.
Under the existing ex-post framework, violations of the competition law are investigated after they take place.
While some experts said the ex-ante framework is modelled around EU law, government officials have said the legislation would factor in domestic sensitivities.
A number of big technology firms, including Apple, Meta, Google, Amazon and Flipkart, had opposed ex-ante regulations before the Govil panel.
The obligations for large players would be spelt out through subordinate legislation after deliberations with stakeholders, the panel had suggested.

'Secular' and 'socialist' will remain in Preamble: Government

'Secular' & 'socialist' will remain in Preamble: Government NEW DELHI: Taking a position different from that of the RSS , govt on Thursday said it does not intend to drop 'socialist' and 'secular' from the preamble of the Constitution 'The government has not formally initiated any legal or constitutional process to remove the words 'socialist' and 'secular' from the Preamble of the Constitution. While there may be discussions or debates in certain public or political circles, no formal decision or proposal has been announced by the government regarding amendments to these terms,' law minister Arjun Ram Meghwal told the Rajya Sabha in a written response. This runs contrary to the RSS's stand articulated by its secretary general Dattatreya Hosbole that the twin additions to the Preamble made during the Emergency and by a Lok Sabha whose tenure was over should be scrubbed. This was endorsed by former Vice President Jagdeep Dhankhar who termed the two insertions as festering sores. 'Regarding the atmosphere created by office bearers of some social organisations, it is possible that certain groups are expressing opinions or advocating for reconsideration of these words. Such activities can create a public discourse or atmosphere around the issue, but this does not necessarily reflect the official stance or actions of the govt,' the minister said, in what could be seen as a reference to the RSS leader's stand. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Gold Is Surging in 2025 — Smart Traders Are Already In IC Markets Learn More Undo Apart from the Emergency when fundamental rights were suspended, almost all the senior opposition leaders jailed and elections postponed, incorporation of 'secular' and 'socialist' in the Preamble have been opposed also because it was done by a Lok Sabha whose five year-tenure had already run out. The minister said the apex court had clarified that 'socialism' in the Indian context signifies a welfare state and does not impede private sector growth, while 'secularism' is integral to the Constitution's basic structure. The remarks of both Hosbole and Dhankhar were used by the critics to renew their charge that govt was conspiring to change the Constitution, something that had figured prominently in last year's 2024 polls.

New Vice President difficult in monsoon session amid set timelines

While the Election Commission of India has begun the process of vetting the electoral roll of both Houses in consultation with their secretariats. Rajya Sabha Secretary General will be the Returning Officer of the per the Constitution, no deadline has been fixed for election of the new Vice President in case of resignation of the incumbent and the general understanding is that it should be conducted "as soon as possible". However, once the Election Commission issues a notification, the polling process will have to be completed within 60 state that 14 days have to be given for filing of nomination papers, followed by three-four days for withdrawal and scrutiny of forms. Another 14 days will be set aside for campaigning. It appears unlikely that the new Vice President will be elected in the monsoon session that ends on August 21 and has only 20 working days Vice Presidential election electoral college has 782 members at present with Lok Sabha having 542 members and the Rajya Sabha 240. The Basirhat Lok Sabha seat in West Bengal fell vacant due to the death of TMC MP Sheikh Nurul Islam while the two Anglo-Indian nominated seats have not been filled. In the Rajya Sabha, the four seats of Jammu and Kashmir are vacant while Punjab AAP MP Sanjeev Arora resigned on July 1 after winning the Ludhiana West Assembly NDA has a total of 427 members with 293 in the Lok Sabha and 134 in the Rajya Sabha, while the combined Opposition has only 355 (249 in the Lower House and 106 in the Upper House. Hence, the candidate of the ruling dispensation will win hands the Election Commission follows the protocol by the book, it will be a long drawn process. Moreover, if the acrimony between the Treasury and the Opposition is any indicator, the latter is not likely to give the government a walkover. In which case the 14 days time for campaigning, followed by polling, counting and declaration of result will have to be set such a scenario where polling is held after the monsoon session, MPs of both Houses who are based out of Delhi will have to visit the national capital on polling day.
