JUNE 27 — An appeal is a creature of statute and will only lie if a statute gives such a right and then only within the limits which the statute giving the right stipulates.
Accordingly, by reason of Section 87(1) of the Courts of Judicature Act 1964, an appeal lies to the country's apex court -- that is, the Federal Court -- from any decision of the Court of Appeal in its appellate jurisdiction in respect of a criminal matter decided by the High Court in its original jurisdiction.
This means that the criminal trial must commence in the High Court, as the case was in the corruption case of former youth and sports minister Syed Saddiq Syed Abdul Rahman.

Syed Saddiq was convicted by the High Court in 2023. On Wednesday (June 25), the Court of Appeal quashed the conviction, ruling unanimously that the High Court judge had erred in several decisions, and that there was no element of dishonesty when the former minister instructed his staff to remove money from Bersatu's youth branch Armada's bank accounts.
The Public Prosecutor has not waited long to appeal against the acquittal having filed a notice of appeal the very next day (June 26).
Syed Saddiq faces another court battle for his freedom. As the song goes, it ain't over 'til it's over.

PETALING JAYA : Police have arrested a 36-year-old mother and her 61-year-old boyfriend after the former's teen daughter was allegedly raped by the man as the woman watched on. More recently, the girl came across text messages last month of the two planning to engage in sexual activity, Siti said. The man allegedly expressed his intention to have sex with the girl at a hotel, causing her to fear for her safety. She fled to a friend's house before lodging a report at the Pandan Indah police station. This led to the arrest of the mum, who works as a security guard, and her self-employed boyfriend. The pair have been remanded for a week to assist with investigations.

(Bernama pic) PETALING JAYA : A policeman died after his motorcycle skidded during an operation to curb illegal street racing in Kuala Lumpur early this morning. Kuala Lumpur traffic investigation and enforcement department chief Zamzuri Isa said Amirul Aiman Othman, 24, was declared dead at the scene following the 4.30am incident on Jalan Kuching, heading towards Selayang from Jalan Tun Razak. 'A preliminary investigation revealed that he lost control of his motorcycle while navigating a bend and collided with a metal road barrier before tumbling down an embankment. 'Another officer riding behind the victim also lost control of his motorcycle and sustained minor injuries. He is receiving outpatient treatment at Kuala Lumpur Hospital,' Bernama reported him as saying. Zamzuri said the officers were conducting surveillance to prevent illegal street racing activities in Kuala Lumpur. He said Amirul had been serving with the department since completing his training and had been attached to the intelligence/operations division for over a year.

Police to probe scuffle between cop, protester at anti-graft rally
A scuffle between a policeman and a protester, at an anti-corruption rally in central Kuala Lumpur today, shown in a video posted by X user @lancelot_se. PETALING JAYA : Police are investigating a scuffle which broke out between a cop on duty and a protester at an anti-corruption rally attended by about 100 people in Kuala Lumpur earlier today. Dang Wangi police chief Sulizmie Affendy Sulaiman said one of the rally-goers had lit a flare at about 4.30pm, producing thick smoke which could have endangered participants, security personnel on duty and members of the public nearby. Because of this, policemen on duty took preventive action, he said. 'As this preventive action was being taken, a scuffle broke out between the rally-goer and a policeman, leaving the latter with minor injuries. The scuffle was broken up by other policemen. Three reports were later lodged over the incident,' he said in a statement. Sulizmie said the investigation was into the use of criminal force against a public servant, the letting off of fireworks, and insulting behaviour. Around 100 protesters gathered outside the Sogo shopping complex at about 2pm today before moving to Dataran Merdeka through Jalan Tuanku Abdul Rahman. They urged Putrajaya to strengthen the legal system and reinforce the independence of anti-corruption institutions.
