
Agency for college athlete payment deals agrees to loosen third-party restrictions
The College Sports Commission said it will now consider a third-party company that seeks to pay a player to have a 'valid business purpose' if the deal 'is related to the promotion or endorsement of goods or services provided to the general public for profit.'
It did away with the concept that collectives established simply to pay players did not have a valid business purpose even if they sold products for profit.
That guidance, issued earlier in July, threatened to fundamentally change the concept of third-party collectives, which were established in 2021 as the main source of NIL deals for players. With schools now allowed to pay players directly under terms of the industry-changing House settlement, the role of collectives was thrown into limbo.
The CSC, in charge of vetting third-party deals worth $600 or more, was trying to make it more difficult for schools to use collectives as a workaround to the $20.5m cap that the schools are allowed to pay players.
Plaintiff attorneys threatened to take the case back to court, arguing the CSC guidance amounted to an incorrect reading of the lawsuit settlement that made the payments possible.
The CSC's new guidance provides a more liberal view of what third-party collectives can do.
The CSC's 'for-profit inquiry focuses on whether the sale of goods or services is for profit and not whether the entity itself is operating at a profit or a loss at any given time,' the CSC said in a news release.
Part of the CSC's requirements include athletes needing to, in certain cases, provide documentation showing the entity's efforts to profit from the deal.
In a joint statement, the defendants and plaintiffs reiterated that 'the traditional purpose of many NIL collectives – raising money to induce student-athletes to attend or play at an institution – does not satisfy the valid business purpose requirement.'
But, the statement said, 'In evaluating such payments, the Settlement's requirements focus on substance, not labels' – an indication that the focus should not be on whether the organization making the deal is considered a 'collective,' but only whether it sells something to the public for profit.
Parts of the arrangement that don't change are the CSC's task of determining fair market value for the goods and services provided and the collectives' ability to match athletes with other businesses offering NIL opportunities.

Oil slips as OPEC+ proceeds with September output hike
SINGAPORE, Aug 4 (Reuters) - Oil prices extended declines on Monday after OPEC+ agreed to another large production hike in September, with concerns about a slowing economy in the U.S., the world's biggest oil user, adding to the pressure. Brent crude futures fell 40 cents, or 0.57%, to $69.27 a barrel by 0115 GMT while U.S. West Texas Intermediate crude was at $66.96 a barrel, down 37 cents, or 0.55%, after both contracts closed about $2 a barrel lower on Friday. The Organization of the Petroleum Exporting Countries and their allies, known as OPEC+, agreed on Sunday to raise oil production by 547,000 barrels per day for September, the latest in a series of accelerated output hikes to regain market share, citing a healthy economy and low stockpiles as reasons behind its decision. The move, in line with market expectations, marks a full and early reversal of OPEC+'s largest tranche of output cuts, plus a separate increase in output for the United Arab Emirates, amounting to about 2.5 million bpd, or about 2.4% of world demand. Analysts at Goldman Sachs expect that the actual increase in supply from the eight OPEC+ countries that have raised output since March will be 1.7 million bpd, or about 2/3 of what has been announced, because other members of the group have cut output after previously overproducing. "While OPEC+ policy remains flexible and the geopolitical outlook uncertain, we assume that OPEC+ keeps required production unchanged after September," they said in a note, adding that solid growth in non-OPEC output would likely leave little room for extra OPEC+ barrels. RBC Capital Markets analyst Helima Croft said: "The bet that the market could absorb the additional barrels seems to have paid off for the holders of spare capacity this summer, with prices not that far off from pre-tariff Liberation Day levels." Still, investors remain wary of further U.S. sanctions on Iran and Russia that could disrupt supplies. U.S. President Trump has threatened to impose 100% secondary tariffs on Russian crude buyers as he seeks to pressure Russia into halting its war in Ukraine. At least two vessels loaded with Russian oil bound for refiners in India have diverted to other destinations following new U.S. sanctions, trade sources said on Friday, and LSEG trade flows showed. However, two Indian government sources told Reuters on Saturday the country will keep purchasing oil from Russia despite Trump's threats. Concerns about U.S. tariffs impacting global economic growth and fuel consumption are also hanging over the market, especially after U.S. economic data on jobs growth on Friday was below expectations. U.S. Trade Representative Jamieson Greer said on Sunday that the tariffs imposed last week on scores of countries are likely to stay in place rather than be cut as part of continuing negotiations.

White House defends firing of labor official as critics warn of trust erosion
WASHINGTON, Aug 3 (Reuters) - White House economic advisers on Sunday defended President Donald Trump's firing of the head of the Bureau of Labor Statistics, pushing back against criticism that Trump's action could undermine confidence in official U.S. economic data. Later on Sunday, Trump again criticized BLS Commissioner Erika McEntarfer, without providing evidence of wrongdoing, and said he would name a new BLS commissioner in the next three or four days. U.S. Trade Representative Jamieson Greer told CBS that Trump had "real concerns" about the BLS data, while Kevin Hassett, director of the National Economic Council, said the president "is right to call for new leadership." Hassett said on Fox News Sunday the main concern was Friday's BLS report of net downward revisions showing 258,000 fewer jobs had been created in May and June than previously reported. Trump accused McEntarfer of faking the jobs numbers, without providing any evidence of data manipulation. The BLS compiles the closely watched employment report as well as consumer and producer price data. The BLS gave no reason for the revised data but noted "monthly revisions result from additional reports received from businesses and government agencies since the last published estimates and from the recalculation of seasonal factors." McEntarfer responded to her abrupt dismissal on Friday in a post on the Bluesky social media platform, saying it was "the honor of her life" to serve as BLS commissioner and praising the civil servants who work there. McEntarfer's firing added to growing concerns about the quality of U.S. economic data and came on the heels of a raft of new tariffs on dozens of trading partners, sending global stock markets tumbling as Trump presses ahead with plans to reorder the global economy. Investors also are watching the impact of the surprise resignation of Federal Reserve governor Adriana Kugler, which opened a spot on the central bank's powerful board and could shake up what was already a fractious succession process for Fed leadership amid difficult relations with Trump. Former Treasury Secretary Larry Summers, who worked in both the Clinton and Obama administrations, also criticized McEntarfer's firing. "This is a preposterous charge. These numbers are put together by teams of literally hundreds of people following detailed procedures that are in manuals," Summers said on ABC's "This Week." The BLS surveys 121,000 employers - businesses and government agencies - each month, seeking their total payroll employment during the week in which the 12th day of the month falls. The response rate has fallen sharply since the COVID pandemic, from 80.3% in October 2020 to about 67.1% in July. Knowing that, BLS allows late-arriving employer submissions, and revisions to earlier submissions, to be taken into account over the next two months. That means each month's initial estimate of employment for the immediately preceding month also contains revisions to the two months before that. The revisions in Friday's report were large by historic standards. The downward revision of 125,000 jobs for May was the largest between a second estimate and third estimate since a 492,000 reduction for March 2020. That was the largest ever and was reported in June 2020 for the payrolls report for May 2020.
