firecracker explosion
killing 17 people and injuring 25 severely during Chandan Yatra in Puri on May 29 last year.In the order uploaded on Thursday, NGT's east zone bench further directed the chief secretary to "take appropriate action against those found guilty of gross negligence and lapse in taking proper security steps to prevent the occurrence of the incident in question".The bench comprising Justice B Amit Sthalekar (judicial member) and Dr Vijay Kulkarni (expert member) said, "For future, it is directed that no explosives of any kind shall be permitted in such religious functions where the swell of the crowd is not just in thousands but in several lakhs and even a small lapse can result in loss of lives of lakhs of people.
One cannot rule out that such an incident can even be triggered by ill-intentioned and anti-social elements using more lethal explosives other than mere firecrackers."NGT was hearing a petition filed by Sanjay Kumar Nayak (46), a resident of Aska in Ganjam district, seeking direction to the authorities to take steps to prohibit bursting of crackers during the rituals of Lord Jagannath in Puri. Advocates Sankar Prasad Pani and Ashutosh Padhy appeared in virtual mode on the petitioner's behalf.While ordering the probe, the bench said it was evident from the Puri collector's affidavit that no one noticed crackers being taken in a trolley and stacked at Dasa Tutha on the north-west corner of the Narendra Pokhari without permission from the competent authority. During Chandan Yatra on May 29, 2024, a cracker after being ignited hit the stack of crackers kept at Dasa Tutha, which led to all the crackers getting lit and causing a huge explosion."This clearly shows that there was gross dereliction of duty on the part of the district administration including the police authorities," the bench observed, adding, "The district administration and the police administration cannot be absolved of their negligence in such a grave security lapse." "In the instant case, it was stacking of firecrackers but one cannot rule out the possibility that it could have been something even more lethal resulting in a massive explosion causing extensive damage to the Lord Jagannath temple itself and loss of human life on a large scale," the bench also observed, while disposing of the petition."That apart, it cannot be ruled out that some offensive material could have been loaded on the trolley rickshaw and carried in the midst of the Chandan Yatra so as to offend the sensibilities of the devotees and thereby create a riotous situation," the bench said. It questioned why the district and police administrations didn't anticipate such an eventuality."The police swinging into action after the occurrence of the incident does not explain the lethargy and total inactivity and the requirement to be vigilant at all times particularly on the occasion of religious functions," the bench observed.

CHENNAI: Tamil Nadu is among the states worst affected by groundwater overexploitation, with 106 assessment units—33.87% of the total of 313—classified as over-exploited, according to a comprehensive report of the Central Ground Water Authority (CGWA) submitted before the principal bench of the National Green Tribunal. The CGWA report, which was based on the data provided by every State last month in a specific format, says that, in Tamil Nadu, while No Objection Certificates (NOCs) for drawing groundwater in over-exploited and critical areas are restricted to domestic use, infrastructure development, and non-water-intensive industries, the enforcement of these norms has been inconsistent. A total of 492 illegal groundwater extraction units were sealed in the state based on orders from the Madras High Court. However, unlike other states such as Punjab and Haryana, Tamil Nadu has yet to introduce provisions for pricing or environmental compensation for illegal groundwater extraction. 'There is no provision for collecting Environmental Compensation under existing regulations in Tamil Nadu,' the CGWA noted. 'NOCs have only been issued to water-based industries located in safe and semi-critical areas, not in over-exploited ones.' Within the State, Chennai, Salem, Coimbatore, Dindigul, Mayiladuthurai, Vellore, and Tirupattur districts are the worst affected. For instance, out of 16 groundwater assessment units in Chennai, 13 are over-exploited, which is 81.25%.

NEW DELHI: The SC on Thursday agreed to hear on July 28 a plea questioning whether BS VI-compliant vehicles should have an end-of-life period of 15 years for petrol variants and 10 years for diesel—treating them on par with BS IV norms—in the Delhi-National Capital Region. A two-judge bench of the apex court, headed by Chief Justice of India (CJI) B R Gavai and Justice K Vinod Chandran, agreed to hear the matter after a counsel mentioned it for urgent listing. The petitioner's lawyer submitted that the government cannot override the court's earlier directions on pollution control. 'The government cannot alter the limits already set by the apex court for curbing vehicular emissions to check pollution in Delhi,' the counsel said. The application filed in the top court sought relief for BS VI-compliant vehicles, arguing that these newer-generation models adhere to stricter emission norms and should not be subject to the existing limits of 15 years for petrol and 10 years for diesel vehicles in Delhi and the National Capital Region. The petitioner contended that since the timeline for phasing out older vehicles was previously fixed by the apex court, any modification must come through judicial review. 'The government cannot unilaterally alter the policy,' the plea stated, citing existing orders from the SC and NGT concerning air quality control and vehicular pollution. The petitioner urged the court to examine whether a distinction can be made in policy for BS VI-compliant vehicles, and if the current vehicular age bans require review in light of advancements in automotive technology and emission control systems. Notably, in the backdrop of this petition, it is significant to mention that in 2015, the NGT had ordered a blanket ban on diesel vehicles older than 10 years and petrol vehicles older than 15 years in Delhi-NCR, as a pollution control measure. Delhi govt asked its transport and environment departments to study the current guidelines on end-of-life vehicles, enforcement against overaged vehicles and the reaction of the public and stakeholders to the action. Govt will also assess the removal of vehicles so far and the impact of this on air quality levels, officials said on Thursday. One official added, "Govt may then file a review petition on the policy in the Supreme Court based on the findings and reports submitted by the two departments." Environment minister Manjinder Singh Sirsa said, "The environment and transport departments are studying, separately, the guidelines, their impact on the public and the benefits and consequences on ground and air quality levels. Once they complete their studies and submit the report, govt will take further decisions on filing a petition in the court." The departments will also mention the other measures they took in the last five months to curb air pollution in the city and their results, said a govt official. A 2014 order of the National Green Tribunal also prohibits the parking of vehicles aged over 15 years in public places. Following the NGT and Supreme Court's order, in 2021-22, the transport department began de-registering petrol and diesel vehicles that had completed, respectively, 15 years and 10 years of life. Then in 2023, the transport department launched an enforcement drive against these overaged vehicles found parked in public places or running on the roads. However, several vehicle owners moved court, following which govt was asked to come up with proper guidelines to handle ELVs in Delhi. The current govt relaunched the enforcement drive in July and banned provision of fuel to ELVs, both cars, trucks and bikes. However, after facing public heat the drive was halted on grounds of "critical operational and infrastructural challenges". Sirsa also wrote to pollution watchdog Commission for Air Quality Management pleading the city authorities could not accommodate the panel's imposition of the anti-ELV measure. After this, lieutenant governor VK Saxena wrote to CM Rekha Gupta, asking Delhi govt to seek a review petition before the apex court against its 2018 order restricting petrol vehicles beyond 15 years and diesel vehicles beyond 10 years from plying in Delhi-NCR. "How can a vehicle banned as unfit in Delhi run lawfully in other cities? This is against equal treatment," LG queried in the letter. Citing equality and socio-economic reasons, Saxena underlined that such rules should be proportionate, non-arbitrary and not solely based on a rigid age-based classification. He also said that the ban should be put on hold unless it was implemented across NCR. He sought a comprehensive air pollution mitigation plan within three months. Talking on similar lines, Gupta said, "Just as we requested CAQM to review its decision on overage vehicles, we will approach the Supreme Court to give us a detailed overview of our preparation in the fight against pollution, and we will let the court know of public grievances. We will fight for the rights of people.">
