The Peshawar High Court (PHC) has suspended the imposition and recovery of the newly introduced levy on all industries generating electricity through gas-run generators.
A division bench comprising Justice Syed Arshad Ali and Justice Qazi Jawad issued the restraining order on Wednesday.
The federal government had imposed the levy through an ordinance promulgated in January 2025, requiring all captive power producers to pay a levy determined by the federal government.
However, the cement and textile industries, being among the captive power producers, challenged the ordinance in the PHC, requesting the court to restrain the federal government from notifying the levy rate.
The notification was subsequently issued on March 7, 2025, setting the levy at Rs791 per MMbTU. A formal application was moved for the suspension of the notification.

LAHORE: A devastating fire broke out in the early hours of Wednesday at the Gerry Dnata warehouse located at the Allama Iqbal International Airport in Lahore. At least eight fire brigade and rescue vehicles were deployed to the scene, and efforts were made to bring the blaze under control. Fortunately, no casualties were reported, but the fire resulted in significant damage to the consignments stored in the warehouse. According to sources, all the goods were destroyed in the fire. The incident has sparked a controversy, with Customs clearing agents expressing their frustration over the delay in processing Goods Declarations (GDs) by the Pakistan Customs appraisers. They claim that the pending GDs led to undue delays, resulting in demurrages and ultimately, the loss of billions of rupees. Talking to the Business Recorder, former senior vice chairman All Pakistan Customs Agents Association Syed Arshad Ali revealed that millions of rupees worth of samples were destroyed in the fire at the Gerry Dnata warehouse despite duties being paid and bank documents being released against the consignments. Customs clearing agents attribute the loss to the delayed release of goods by Customs appraisers, who often cite various pretexts such as requesting additional documents or referring cargo for examination, he added. Ali further stressed that air shipments are typically time-sensitive, but the non-cooperation of cargo handlers has become a persistent issue. 'The present incident has added insult to our injuries,' he said, highlighting the need for improved efficiency and cooperation in the Customs clearance process. According to him, the Association has demanded serious action against the responsible Customs staff for their negligence and requested a refund of duties already paid to the department. The Collector assured the Association that show-cause notices would be issued to the concerned staff and that the duties would be refunded after due confirmation. The Collector also assured that operations at the cargo site would resume from Wednesday evening onwards and that a strategy would be devised to proceed with payment against claims. The incident has highlighted the need for improved coordination and efficiency in the Customs clearance process to prevent such incidents in the future. Copyright Business Recorder, 2025

PHC de-notifies all company benches

PESHAWAR: The Peshawar High Court has issued a notification de-notifying all Company Benches previously constituted at all benches of the Court. According to the notification No. 244-3, dated July 4, 2025, the Chief Justice of the Peshawar High Court has exercised powers under Sub-Section 4 of Section 5 of the Companies Act, 2017 to implement the change. All matters falling under the Companies Act, 2017 pertaining to the whole province of Khyber Pakhtunkhwa shall be dealt with by the Honourable Company Bench at the Principal Seat of the Peshawar High Court, said the notification. Erstwhile tribal areas: PHC bars FBR from penalising 5 firms

ISLAMABAD: Peshawar High Court (PHC) has stopped Federal Board of Revenue (FBR) from penalising five companies within the jurisdiction of erstwhile tribal areas, which failed to conduct electronic sales tax integration with the FBR's system. In this regard, the PHC has issued an order against the FBR. These five companies are engaged in the manufacturing process and are covered under the jurisdiction of erstwhile tribal areas. According to the PHC order, comments are called from the FBR and others so as to reach this court within fortnight and thereafter the case shall be fixed for hearing. Petitioner companies have pleaded that the FBR is forcing the companies to purchase software and hardware for sales tax invoice generation and electronically integrate their hardware and software with the FBR's computerised system through licensed integrators. Notice has been issued to the FBR for July 15, 2025. In the meanwhile, no adverse action shall be taken against the petitioner companies, the PHC's order added. Copyright Business Recorder, 2025
