Kerala HC orders interim stay on proceedings against CM in Ernakulam CJM court

The Hindu5 days ago
The Kerala High Court has ordered an interim stay for three months on further proceedings before the Chief Judicial Magistrate (CJM) Court, Ernakulam, in a petition filed by Ernakulam District Congress Committee (DCC) president Mohammed Shiyas, who sought action against Chief Minister Pinarayi Vijayan. In the petition, Mr. Shiyas sought action against Mr. Vijayan for making a speech 'abetting violence' while referring to agitating Youth Congress activists reportedly coming under attack, mainly from alleged Democratic Youth Federation of India (DYFI) activists during the Nava Kerala Yatra led by Mr. Vijayan in November 2023.
In his petition, Mr. Vijayan had sought a stay on all further proceedings before the CJM Court, pending disposal of the case. In its order issued on Thursday, a Single Bench of Justice V.G. Arun said that there appeared to be prima facie substance in the contention of the counsel of Mr. Vijayan that the CJM exceeded his jurisdiction by entertaining the complaint, since the alleged incident (of violence against the protesters) took place outside the territorial limits of the court.
The contention that the contents of the speech does not attract the offence under Section 109 (that states the punishment for abetment) of the Indian Penal Code is also liable to be considered. Hence, the interim stay on further proceedings for three months in the petition that is pending before the CJM Court, the court added. The case has been posted for hearing on October 14.

IIT-BHU ‘gang-rape': Varanasi court rejects accused's plea to cancel proceedings

Government advocate Vinay Singh said the survivor was present in the court through video-conferencing. Accused Anand and Saksham Patel submitted that the proceedings in the fast-track court should be cancelled as the high court is hearing a plea that has raised an objection to the victim's presence in court through video-conferencing and the next date of hearing in the matter is July 28. Varanasi (UP), Jul 21 (PTI) An application filed by two accused in a fast-track court here on Monday to get the proceedings cancelled in the IIT-BHU gang-rape case was rejected by the judge, who has summoned the lone eyewitness for recording his statement on the next date of hearing on July 31. Singh said the court has summoned the lone eyewitness — the survivor's friend — for recording his statement on the next hearing on July 31. The incident took place on the night of November 1, 2023. Following the incident, hundreds of Banaras Hindu University (BHU) students had held a protest on the campus and demanded that the entry of outsiders to the institute be banned. According to the complainant, she had gone out of her hostel with a friend at night. They were near the Karman Baba temple when three men allegedly came there on a motorcycle, forcibly took her to a corner, gagged her after separating her from her friend and allegedly stripped her. They also allegedly made a video of her and clicked photos. They let her go after about 15 minutes and took her phone number, the complainant had further alleged. On the basis of the complaint, an FIR was registered under section 354 (assault or criminal force to a woman with intent to outrage her modesty) of the Indian Penal Code and under provisions of the Information Technology Act at the Lanka police station. Subsequently, the charge of gang-rape was added to the FIR, police said. Three people — Kunal Pandey, Anand alias Abhishek Chauhan and Saksham Patel — were arrested in connection with the matter on December 31, 2023. 2015 Bharuch double murder: Court orders NIA to attach 1.92 sq m property of accused

Ahmedabad: Nearly 10 years after the murder of two BJP workers in Bharuch, a special court has ordered the National Investigation Agency (NIA) to attach the share of one of the accused in his ancestral properties — a total measuring less than 2 sq m. Mohammed Yunus, alias Manjro, was among those arrested on charges of criminal conspiracy and the murder of BJP workers Shirish Bengali and Pragnesh Mistry. The killings took place in Nov 2015, and the investigation was later handed over to the NIA. The accused were charged under the Unlawful Activities (Prevention) Act (UAPA) and relevant sections of the Indian Penal Code (IPC). In Dec 2024, the NIA filed an application in the special court seeking permission to attach Manjro's properties under the provisions of Section 33(1) of the UAPA. His share in the two properties was calculated at 1.59 sq m and 0.33 sq m respectively, totalling just 1.92 sq m. The NIA submitted that these properties were liable to be seized for forfeiture proceedings in the case. Manjro's lawyer objected to the application, questioning the agency's move nearly a decade after the case began. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like This Could Be the Best Time to Trade Gold in 5 Years IC Markets Learn More Undo He argued that the 2013 amendment to the UAPA allows attachment only of properties intended to be used for terrorism-related activities. He opposed the seizure of what he described as a "very minimal" share in the ancestral properties. After hearing arguments, Special Judge M P Purohit rejected the defence's objections and stated in the order, "It is ordered that the share in the immovable properties of the accused Mohammad Yunus @ Manjro (A-4) — (i) Residential House, Ward No. 3, City Survey No. 3614, Bharuch City, having a total area of 143.96 sq m, and (ii) Residential House, Ward No. 3, City Survey No. 3615, Bharuch City, having a total area of 29.59 sq m — is hereby ordered to be attached till the final disposal of this case under the provisions of Section 33(1) of the UA(P) Act, 1967. " The court further directed: "The accused Mohammad Yunus @ Manjro shall not transfer his share in these properties to anyone by sale, mortgage, gift, or in any other manner until the trial is completed."

Notice to ex-SHO for bypassing Pocso provisions

Buxar: A special Pocso court in Buxar on Monday issued a show-cause notice to the then SHO of Dumraon police station, Shambhu Kumar Bhagat, over serious procedural lapses in a case of sexual assault of a minor girl in April. The court also rejected the bail plea of the accused, underlining the need for a thorough investigation. It was revealed that the FIR had been lodged solely under sections 74 and 76 of the Indian Penal Code, bypassing the more stringent and applicable provisions under the Protection of Children from Sexual Offences (Pocso) Act. Presiding judge Ajit Kumar Sharma noted that despite the clear involvement of a minor victim — confirmed in the court by additional public prosecutor Suresh Kumar Singh — police failed to invoke the relevant sections. The court also directed that the copies of the notice be forwarded to the deputy inspector general of Shahabad range and superintendent of police for departmental action.
