Remains of some British Air India crash victims wrongly identified, lawyer says

The London-bound Boeing 787 Dreamliner crashed into a medical college shortly after taking off from Ahmedabad Airport on June 12, killing 241 people on board.
Some 169 Indian passengers and 52 British nationals were killed, making it one of the deadliest plane crashes in terms of the number of British fatalities.
Aviation lawyer James Healy-Pratt, whose firm Keystone Law is representing more than 20 British families who lost loved ones in the disaster, said relatives of one victim found out a casket contained 'co-mingled' remains, while a different family were told a coffin contained the body of someone else entirely, not their loved one.
Mr Healy-Pratt, who is a partner at the firm, said the mistakes emerged after the 'sterling efforts' of senior coroner for Inner West London, Dr Fiona Wilcox, who 'picked up DNA anomalies' at the beginning of the repatriations.
'In the first two caskets that were repatriated, in one of the caskets, there was co-mingling of DNA which did not relate to the deceased in that casket or the casket that accompanied it and so that's what alerted her and her team to the fact there was a serious problem,' he told the PA news agency.
'My understanding was that the co-mingling was at the very beginning, which alerted Dr Wilcox to the fact that she had to be 100% assiduous about checking the identification of the incoming remains.
'She was then able to determine that one particular loved one was not at all who the family thought they were.'
The family of three British victims who were buried in India after the crash said there was a 'clear lack of transparency and accountability' in how the identification and repatriation of victims was handled.
Relatives of Akeel Nanabawa, his wife Hannaa Vorajee and their four-year-old daughter Sara Nanabawa said in a statement: 'Recent developments have only confirmed what many feared: that serious mistakes may have been made, and that the dignity and rights of victims and their families were not safeguarded as they should have been.
'In our case, we are confident that we received the correct bodies, based on the hospital's assurances, autopsy reports, their clothing and the personal belongings we recovered.
'But our concern now is not limited to ourselves. We are deeply troubled by what this means for other families who may still be searching for certainty and closure.
'This isn't just a personal tragedy; it is a collective one. And the mishandling of such a sensitive process speaks to a wider failure between the British and Indian authorities to act with care, co-ordination and respect.'
It is understood no blame is being put on any UK agency for the blunders, Mr Healy-Pratt told PA.
'We know that they were not allowed anywhere near the DNA identification chain of custody link to the caskets,' he said. 'That was the Indian authorities, that's what we understand.
'But nobody's actually laid that out formally for families to look at and review, and that's what we want – explanations by the Indian government about who was in charge of that chain of custody, why were there the massive mistakes that were made and, the important thing, how do the families know that there aren't other remains of their loved ones in a fridge in an Indian hospital?'
The lawyer said he believes the mistakes will be on the agenda for Prime Minister Sir Keir Starmer's talks with his Indian counterpart Narendra Modi on Wednesday and Thursday.
Mr Healy-Pratt added: 'Somebody has to take responsibility in India for this massive screw up and then they actually have to ensure that they can give proper assurances to the families that the job has been completed and done properly.
'The hierarchy of needs of these families in air crashes, it's always the same.
'The first thing they want is their loved ones back so they can say goodbye to them; the second thing is they want to know how their loved ones died; third thing, they want to prevent further deaths so that all depends on getting number two right; and then number four, it will be some form of financial justice.'
His firm has demanded a written explanation from Air India, including on the involvement of their contractors Kenyon International Emergency Services.
PA has approached Air India's parent company, the Tata Group, and Kenyon Emergency Services for comment, as well as No 10 and the Foreign Office.
Mr Healy-Pratt understands 12 bodies have been repatriated to the UK.
He is investigating the identification mistakes but is also tasked with representing families at inquests, investigating the causes of the accident, taking High Court legal action in England against Air India and taking action against Boeing in the US courts.
Besides those on board AI171, another 19 people also died and 67 were seriously injured.
The only surviving passenger on the plane was Briton Vishwash Kumar Ramesh, who previously told The Sun it was a 'miracle' he was alive but felt 'terrible' he could not save his brother Ajay.
A preliminary report into the incident from India's Aircraft Accident Investigation Bureau found both of the plane's fuel switches moved to the 'cut-off' position 'immediately' after take-off, stopping fuel supply to the engine.
It has sparked questions over whether the crash was deliberate.

The 'horrified' family told Metro they are hoping to raise awareness of how their dream holiday to England was turned upside-down. Brooke and Tory Brewer were en route to the UK from South Carolina with their two small children on July 19, 2023, when they handed one of their kids the Peppa Pig-themed iPad. However, at a stopover in JFK Airport, they left the device in a seat pocket. Once in London, Brooke began receiving random text messages about activity on the device. The family then used the 'Find My' app to track the iPad to Jamaica, Queens, where the New York airport is located. Photos then began syncing to Tory Brewer's iCloud, starting off with selfies taken by a man 'wearing a Delta uniform and name badge.' But a month later, the family discovered a string of porn videos on their iCloud. These videos show the man 'masturbating while in his Delta uniform and wearing his Delta name badge,' this is according to court filings from July 16 this year seen by Metro. The Delta employee allegedly wrecked havoc on the family's other accounts through the iPad. The man even allegedly accessed the Brewer's iTunes account and created his own personal profile. One of the young children also discovered that the iPad had been used to hack into the family's Amazon account and create a new profile called 'Gay'. The Brewer's claim they filed multiple reports to Delta which received only generic 'no-reply' emails. The devastated family told Metro in a statement they want to protect other families from going through something similar. They said: 'This experience has been horrifying and something we never could have anticipated. 'In the rush of de-boarding, our child simply left their device on the plane. We're sharing our story in hope we can help prevent this from happening to others. 'If speaking out can spare just one family from having to endure something like this, we would be grateful.' The family's attorney Tola Familoni said: 'What should have been a fun family getaway was riddled with confusion and anxiety over unauthorized access to their personal devices, a breach of privacy, and the transmission of highly inappropriate, explicit video recordings sent through their child's laptop, something they never would have expected. 'This was made worse due to the lack of response from Delta. Our firm, Motley Rice, seeks to hold Delta accountable for this. 'We hope this lawsuit can help stop something like this happening to any other families who fly with Delta — or any airline in the future.' Airbnb has apologised to a woman after an apartment host falsely claimed she had caused thousands of pounds' worth of damage and used images she says were digitally manipulated to back up his allegations. The London-based academic was refunded almost £4,300, and an internal review of how the case was dealt with has been launched at the short-term accommodation rental company. The incident highlights how cheap and easily available artificial intelligence software is now being used to manipulate images to give false evidence of what has happened in consumer complaints, according to one security expert. The woman, who is based in London, had booked the one-bedroom apartment in New York's Manhattan for two-and-a-half months earlier this year to stay in while she was studying, but she decided to leave early after feeling unsafe in the area. Shortly after she left, the host told Airbnb that she had caused more than £12,000 worth of damage, and submitted pictures of an apparently cracked coffee table as part of his case. His allegations included that she had stained a mattress with urine, and damaged a robot vacuum cleaner, a sofa, a microwave, a TV and an air conditioner. The woman denied any damage had been done to the apartment. She said she left it in good condition and had only two visitors during the seven weeks she stayed. A close examination of two pictures of the coffee table appears to show differences in the damage, leading the woman to believe they were digitally manipulated or generated by AI. She says the host was retaliating because she ended her tenancy early. Airbnb initially told her 'after careful review of the photos', she would have to reimburse the host a total of £5,314. She appealed against the decision. 'I informed them that I can provide testimony from an eyewitness who was with me during checkout and can attest under oath to the condition in which the property was left: clean, undamaged, and in good order,' she says. 'I also clearly demonstrated visual discrepancies in images of the same object (wooden table) provided by the host that show clear signs of fabrication.' She adds: 'These inconsistencies are simply not possible in genuine, unedited photographs of the same object. This should have immediately raised red flags and discredited the host's claims if the evidence had been reviewed with even basic scrutiny, but Airbnb not only failed to identify this obvious manipulation, they entirely ignored my explanations and clear evidence that the material was fabricated.' Five days after Guardian Money raised questions about the case with Airbnb, the woman was told it had accepted her appeal and credited her account with £500. When she then said she was not going to rebook with Airbnb again, the company offered an £854 refund – a fifth of the cost of her booking. She refused to accept this and was refunded the full cost (£4,269) of her booking, and a negative review that the host had placed on her profile was taken down. 'My concern is for future customers who may become victims of similar fraudulent claims and do not have the means to push back so much or give into paying out of fear of escalation,' the woman says. 'Given the ease with which such images can now be AI-generated and apparently accepted by Airbnb despite investigations, it should not be so easy for a host to get away with forging evidence in this way.' The man who complained about her is listed as a 'superhost' on Airbnb, which the site says is someone who is experienced and highly rated. He did not respond to a request for comment. Airbnb said he had been warned for violating its terms and told he would be removed if there was another similar report. The company told him that it could not verify the images he submitted as part of his complaint. Airbnb apologised and said there would be a review into how her case was handled. 'We take damage claims seriously – our specialist team reviews all available evidence to reach proportionate outcomes for both parties, and to help ensure a fair approach, decisions can be appealed.' Serpil Hall, the director of economic crime at the management consultants Baringa, said that manipulating images and videos was now 'easier than ever', and software to do so was cheap, widely available and required little skill to use. In one recent case an insurance company found there had been an increase in false claims on vehicles and home repairs using photos that had been manipulated. 'Recently, many companies have decided images can't be taken at face value any more [during disputes], and there is a need for forensic tools and fraud intelligence models to validate them.'
