'State denying children legal right to equal education'

Irish Examiner2 days ago
The State has been accused of denying thousands of children their legal right to an equal education by leaving students without proper support due to unduly long waiting lists.
It is predicted that as many as 25,000 children could be waiting for an overdue assessment of need by the end of the year.
Under the law, children are legally entitled to an assessment of need within six months of applying, and the process is intended to help children access relevant services and supports.
'When it comes to additional educational needs, a large cohort of students across the country do not have the same access to education as their friends, family members or classmates,' said Eoghan Kenny, Labour's education spokesperson.
'This is a breach of their rights, and of the Government's own legal obligations.
'Families are being left to fend for themselves, forced to wait months on end for diagnoses, then even longer for assessments.
These are children who need assistive technologies, tailored teaching support, and a school environment that fits their needs. Instead they're left in limbo.
Delays with the assessment of need process have serious consequences, Mr Kenny said.
'A child without the right diagnosis or assessment is left without the proper support.
Eoghan Kenny, Labour's education spokesperson, said 'families are being left to fend for themselves'. Picture: Larry Cummins
'That means falling behind in school, struggling in unsuitable classrooms, and missing out on key years of their education.
'The damage doesn't end there.
"These setbacks have knock-on effects on a child's confidence, their development, and their ability to succeed in later life.
"We are hearing of children spending years in mainstream settings without the tools they need to learn.
If more than 25,000 children are on the list by the end of this year, how can the State possibly plan for the number of school places, teachers, and technologies needed?
"Without timely assessment, there is no way to ensure children get the right start.
'Children are being denied their rights. Their education and social progress are being cast aside.
"How many more parents have to sleep out outside the Dáil before Government takes radical action?"
It was reported this week that outgoing HSE chief Bernard Gloster said he was 'hugely' concerned at growing waiting lists for children.
The HSE earlier this summer estimated the number of children waiting for an assessment of need for six months or longer will grow from 15,000 to 25,000 by the end of the year.
There is ongoing engagement between officials regarding the AON process, a spokesman for the Department of Education said.
"Department officials are working on a process to remove the need for a diagnosis to access specialist supports in our school system which would be the last remaining requirement for a diagnosis in the education system."

Jeremy Corbyn looking to start new party with MP who has quit Labour

FORMER BRITISH LABOUR leader Jeremy Corbyn has said he is looking to form a new UK political party. The party will be co-led by Corbyn and fellow MP Zarah Sultana, who quit Labour today after she was suspended from the party last year for voting against budget measures to cut social welfare payments. Posting to social media today , Corbyn and Sultana confirmed their plan to build an 'alternative' left-wing party to Labour. 'Discussions are ongoing,' Corbyn said today. 'And I am excited to work alongside all communities to fight for the future [that] people deserve. 'Together, we can create something that is desperately missing from our broken political system: hope,' he added. It comes amid a revolt within Labour's government benches in the UK over welfare cuts and disagreements over fiscal policies. The party is now rating lower than right Nigel Farage's Reform. Sultana said the project would also involve 'other independent MPs, campaigners and activists across the country'. Advertisement She said the current 'two-party system offers nothing but managed decline and broken promises'. Speaking to ITV News on Tuesday night , Corbyn explained the group will be made up of like-minded left-wing independents to contest the next general election. "That grouping [of Independents] will come together, there will be an alternative" Ex Labour Leader @jeremycorbyn says he is "here to serve the people" as he outlines plans for a new party #Peston — Peston (@itvpeston) July 2, 2025 After the general election last year, he formed the 'Independent Alliance' with other non-party MPs. Corbyn led Labour from 2015 to April 2020, stepping down after the party's loss at the 2019 general election. He was later suspended after he refused to fully accept findings by the UK human rights watchdog that the party broke equality law under his leadership. It also claimed that antisemitism had been 'dramatically overstated for political reasons'. Corbyn was then blocked from standing for Labour at last year's general election and expelled after announcing he would stand as an independent candidate. A Calleary explained: "My department currently has 83,241 children benefiting from One Parent Family Payment and 100,117 children benefiting from Working Family Parent. "However, there are an estimated 11,500 children where the claimant is in receipt of both One Parent Family Payment and Working Family Payment. Martin vows to do 'everything we can' to reduce pressure on families ahead of Budget 2026 "Doubling the monthly Child Benefit payment for a year for each of these children would increase the overall expenditure on Child Benefit by approximately €288million per year." Calleary warned that these figures are subject to change, with the estimates based on figures from May 2025. Child Benefit is currently paid at a rate of €140 per child monthly to over 650,000 families in respect of over 1.2 million children - but it has risen by less than €10 in the last 20 years. But Taoiseach €285 MONTHLY CASH The "second-tier" allowance worth an average of €285 per month would allow lower-income families to top up the existing €140-a-month benefit. And those who don't qualify for the extra cash will still receive the basic €140 payment. Advertisement Martin said: "I have a unit within the Department that is focusing on this issue and I've already spoken to Minister for Social Protection Dara Calleary on this. "Nothing is off the table. There is a wide menu of options to choose from to target resources to meaningfully impact on the child poverty situation." The would lift some 55,000 children out of income poverty and 25,000 from consistent poverty, according to a recent report from the Economic and Social Research Institute. It estimates that spending just under €800m a year on the scheme could halve the number of children experiencing consistent poverty. The form, which is sent out via post, must be completed and returned within 28 days of being received. The form requires parents or guardians receiving the universal Claimants are also required to confirm that both they and the child they are claiming for are resident in the State and detail any change in circumstances that could affect their Child Benefit claim. He explained: "The work of the Department is to help those who are struggling. "One of the considerations in the ESRI proposal was to amalgamate the working family payment with the child support payment but that would result in people losing out on what they are getting at the moment. "If we are to do this, people cannot lose out. We have to look at expanding the working family payment and the child support payment as part of targeted measures. Advertisement "Anything we do in this space needs to be targeted and focused on those on low incomes, particularly workers. "We have to ensure that people do not get a lower payment under a new system than they are currently getting. "That could be an unintended consequence of some of the work we have seen today." A policy paper is currently being worked on to set out the options ahead of the budget. Advertisement Other areas being examined to reduce child poverty levels are payments for children of primary-school age, lone parents, working families on low incomes and children with disabilities. Calleary vowed that any changes made to the social welfare system will be targeted and "focused on those most at risk" of poverty and those in consistent poverty.

Sean O'Grady: Kemi Badenoch's casual cruelty in the face of Rachel Reeves' tears may come back to bite her

Tory leader should be careful as Robert Jenrick waits in the wings and Labour rebels may be put off by her aggressive stance The trouble with Kemi Badenoch is that if she sees someone lying on the ground, she can't resist the temptation to kick them. She lacks empathy, to put it politely. There she was at Prime Minister's Questions (PMQs), facing an open goal for a change, and attacking the prime minister, who, even three days later, can look after himself.
