Kuwaiti Woman Found Not Guilty in Alleged Child Abuse Case
KUWAIT CITY, July 17: The Criminal Court (Domestic Violence) acquitted a Kuwaiti woman of abusing her two children. The court based its decision on the pleadings of the defense lawyer, Attorney Abdul Mohsen Al-Qattan, who pointed out the lack of incriminating evidence. Case files indicate that the ex-husband of the accused claimed she beat their two sons and caused them injuries. After examining the medical and psychological reports and the testimonies of the alleged victims, the court established the absence of conclusive evidence to support the accusation. Although the report of the Child Protection Office stated that the mother used 'disciplinary beating' as a parenting method, the same report confirmed the existence of positive feelings between the children and their mother.

Jail to acquittal for two peddlers
KUWAIT CITY, July 12: The Court of Appeals overturned a verdict of three years ' imprisonment with hard labor issued by a lower court against two individuals accused of trafficking imported liquor. The court instead acquitted them. Lawyer Abdul Mohsen Al-Qattan highlighted the weakness of the evidence and contradictions in the investigations. The case began in March 2024, when authorities raided the home of one defendant in Sabah Al-Salem and found quantities of imported liquor and cash. Four defendants were arrested in total, and searches of their apartments in Sabah Al-Salem and Salwa uncovered more alcoholic beverages as well as suspected narcotics. After a thorough review of the investigation and seizure records, the court found insufficient evidence to prove the intent to traffic against the first and third defendants. It noted that the defendants' confessions were obtained under conditions that did not meet legal standards for conviction, especially given the lack of direct investigation and absence of witnesses to support the mass trafficking allegations. Lawyer Al-Qattan emphasized procedural shortcomings, highlighting contradictions in the police officers' statements and stressing that the raid did not comply with the requirements of the Code of Criminal Procedure.

Capital and Hawally top in family disputes cases in Kuwait
KUWAIT CITY, July 8: Official statistics issued by the Ministry of Justice revealed that family courts handled 13,706 family cases in the first quarter of this year and adjudicated 9,243 of these cases; thereby, achieving 67.4 percent completion rate. The newspaper obtained a copy of the statistics, indicating that 3,233 sessions were postponed and 4,432 cases remained pending at the end of the first quarter. The cases under consideration included personal status, Ja'fari and civil status cases for non-Muslims; in addition to urgent cases and disputes related to alimony, custody, parentage and other family-related cases. The following are the completion rates by type of case: Personal status (general family): 4,665 out of 7,838 cases were resolved -- a completion rate of 59.5 percent Ja'fari: the resolution rate reached 73.5 percent, with 1,025 rulings issued out of 1,396 cases Urgent: 336 cases were registered and 285 of which were resolved – a completion rate of 84.8 percent, which is among the highest in terms of completion Personal status (non-Muslims): 56 out of 94 cases were resolved – a completion rate of 59.5 percent Custody, alimony and parentage: a completion rate of almost 100 percent, reflecting the courts' commitment to expedite adjudication. The following is the distribution of cases by court: Hawally Court recorded the highest number of rulings with 1,989 out of 2,886 cases -- a completion rate of 68.9 percent Farwaniya Court resolved 1,789 out of 2,495 cases -- a completion rate of 71.7 percent Jahra Court issued 1,468 rulings out of 2,125 cases -- a completion rate of 69.1 percent Capital Court resolved 1,783 out of 2,643 cases – a completion rate of 67.5 percent Ahmadi Court recorded 1,375 rulings out of 2,294 cases – a completion rate of 59.9 percent Mubarak Al-Kabeer Court was the least active, with 839 rulings out of 1,263 cases Meanwhile, data from the Electronic Advertisements Department of the family courts indicated that these courts received 11,507 electronic notifications in the first quarter and 11,230 of which were executed -- 97.6 percent completion rate. The Capital Court topped the list with 2,514 notifications, followed by the Hawally and Farwaniya courts. Moreover, Attorney Abdul Mohsen Al- Qattan said that these figures show increasing pressure on family courts, particularly in the Capital and Farwaniya, calling for an increase in the number of judicial circuits to expedite adjudication, especially in alimony and custody cases. He added that the Hawally Court's superiority in the number of rulings indicates 'procedural discipline and quality of organization.' He recommended the redistribution of cases to ease the burden on overcrowded courts. Attorney Enaam Haidar pointed out that 'adjudicating more than 9,000 cases within three months is an achievement credited to the Kuwaiti judiciary,' but she was quick to point out that 'the rate of postponement remains high, possibly due to a lack of staff or the absence of opponents from sessions.' She also stressed the need to review enforcement mechanisms after rulings are issued, specifically in custody and alimony cases, which are often not implemented as required. Attorney Ali Matar Al-Wawan praised the shift to online notifications, stressing that 'this development has contributed to reducing case delays.' ‘A Kuwaiti Citizen will get rent allowance'
KUWAIT CITY, May 10: The Court of First Instance has ordered the State Ministry of Housing to retroactively and continuously reimburse a rent allowance of KD11,300 to a citizen who previously replaced and waived his housing application multiple times. In a landmark ruling, the court clarified that the criterion for suspending the rent allowance is not merely the allocation of a housing plot, but rather the completion of the construction period or the connection of electricity. Details of a lawsuit filed by Attorney Abdul Mohsen Al-Qattan indicated that the plaintiff was allocated a new plot in Al-Mutlaa on May 4, 2023. However, as construction had not yet been completed and electricity was not connected (conditions required for halting the rent allowance ), he remained entitled to receive the allowance. The administrative authority's decision to stop the payments and demand repayment for that period was deemed erroneous. The court ruled that the ministry must return the deducted amount and resume payment, as the plaintiff submitted a new housing application and had not yet benefited from the allocated plot. The judgment further stated that rent allowances must be reinstated for all individuals whose payments were previously suspended due to substitution or waiver of alternative housing, starting from the month following the implementation of the relevant regulation.

Wife-killer detention to continue
KUWAIT CITY, May 5: The detention renewal judge decided to extend until May 18 the detention of the citizen accused of the premeditated murder of his wife in the Mutla'a desert. In the last hearing, the accused appeared at the court, facing charges of premeditated murder by deliberate running over, kidnapping the victim through deception, and possession of intoxicants. Lawyer Abdul Mohsen Al-Qattan, representing the victim's heirs, requested civil compensation of KD 5,001 from the accused and urged that his detention be continued without release. According to the Public Prosecution, the accused committed the premeditated murder of his wife on March 30, 2025, at the Mutlaa Police Station in Jahra Governorate. Investigations revealed that the accused forcibly entered the victim's vehicle, drove her to an unknown location, and deliberately ran her over with the intent to kill her.
