HC junks Rajasthan Rajya Vidyut Utpadan Nigam Limited's appeal on coal compensation cess
The Rajasthan High Court has dismissed an appeal by the Rajasthan Rajya Vidyut Utpadan Nigam Limited ( RVUNL ) in connection with a dispute with Adani Entreprises Limited on the issue of compensation cess. A bench of Justices Avneesh Jhingan and Bhuwan Goyal held that RVUNL is liable to reimburse the amount paid by Adani-owned joint venture company AEL under Clean Energy Cess for coal mining. Coal blocks were allotted by the Centre to RRVUNL which invited tenders to enter into a joint venture arrangement for the development and operation of coal blocks, transportation and delivery of coal to the thermal power stations of the Nigam. Adani Enterprises Limited (AEL) being the successful bidder formed a joint venture company and executed a Coal Mining and Development Agreement (CMDA) for 30 years with RVUNL. In 2010, the central government levied Clean Energy Cess (CEC) on the goods mentioned in the Tenth Schedule of the Finance Act,2010 in which coal was also one of the levied products.

Kozhikode DCC seeks judicial probe into ‘lapses' in NH construction
The Kozhikode District Congress Committee (DCC) has sought a judicial probe into the alleged lapses and contractual violations in the construction of the national highway in the district. DCC president K. Praveenkumar told the media on Saturday (May 24) that the Gautam Adani-owned company that won the contract for widening the 40.8-km stretch of the national highway from Azhiyur to Vengalam for ₹1,838.1 crore had sub-contracted it for ₹971 crore to another company. The Congress leader claimed that the Adani-owned company made ₹900 crore through the deal. He alleged that the national highway development had become a platform for generating profits for the Adani group. People were scared to travel on the newly built roads. The one constructed near Kunniyoramala in Koyilandy was on the verge of collapse. Cracks were noticed on the road at Thiruvangoor and Vengalam. Mr. Praveenkumar alleged that road development had become a symbol of corruption and loot. He demanded that cases be registered against contractors for lapses. The Congress would stage a protest outside the local office of the National Highways Authority of India (NHAI) at 10 a.m. on May 28 in support of this demand. Meanwhile, Mr. Praveenkumar said his party would approach the Kerala High Court against the alleged unscientific delimitation of local body wards in the district. He said tea shops were marked as boundaries of some wards, while avoiding natural boundaries. Some other wards had been merged in violation of the Panchayati Raj Act. This was evident in places such as Vanimel, Nadapuram, Maniyoor, and Thurayoor, he added.

Watch: Why workers at an Adani power plant in Jharkhand went on a strike
Play An Adani-owned thermal power plant in Godda, Jharkhand, supplies electricity to Bangladesh – the only private sector project in India which has been allowed to export power to another country. Last year, a change of regime in Dhaka brought the project under the spotlight – taking objection to the price at which Adani sold electricity, the Bangladesh government threatened to renegotiate the power purchase agreement with the company. While Dhaka's objections have made news, what has gone largely unreported is the disquiet in Godda district. In April, workers at the plant went on a strike over what they said were the company's unfulfilled promises. Many of these workers had given up more than two acres of land for the project. In addition to the regular compensation, the company had offered them either a one-time payment of Rs 5.5 lakh or a job at the plant. Many had chosen the job, hoping for steady work. But instead of being hired directly by Adani Power, most were taken on contract through outsourcing firms. On March 31, workers got emails saying they were being shifted to another contractor. Fearing job insecurity, they went on a hunger strike, demanding that they be hired directly by Adani Power. The company maintained that it had provided jobs in accordance with the central land acquisition law and the resettlement rules of Jharkhand. The strike ended on April 10 after Jharkhand's labour minister Sanjay Yadav intervened, visiting the protest site to meet the striking workers. At the meeting, the mukhiya of one of the project-affected villages said in the presence of the minister that Adani Power had failed to deliver on a wider set of promises made to local people. Scroll travelled to the villages where discontentment against the project was widespread. A spokesperson of Adani Power, however, claimed that the corporate social responsibility department of the company had 'actively worked in line with the commitments, focusing on holistic community development'.
