Allahabad HC relief for UPCC chief in violation of 144 CrPC order case

The Allahabad high court has stayed further proceedings of a case against former MLA Ajai Rai involving violation of a 2017 restraint order under section 144 of the CrPC. Justice Sameer Jain passed the order in a petition filed by Ajay Rai challenging summons issued against him as well as the charge sheet filed by the police. The Allahabad HC in its order dated July 28 fixed August 5 as the next date of hearing in the case. (For Representation) The court in its order dated July 28, after hearing parties concerned, fixed August 5 as the next date of hearing and observed, 'In the meantime, further proceedings pending against the applicant in the aforesaid case crime, shall remain stayed.' Rai, who is currently UP Congress chief, in his petition had sought quashing of summoning order dated September 9, 2019 and the charge sheet dated November 7, 2017, as well as the entire proceedings of case no. 2436 of 2019, (State Vs Surendra Patel and others) arising out of case crime no. 193 of 2017, under section 188 (disobedience to an order lawfully promulgated by a public servant) of Indian Penal Code lodged at Kotwali police station of Varanasi. As per the petitioner's counsel, charge sheet was filed against Rai under section 188 IPC but cognizance was taken by the court concerned on the charge sheet submitted for offence under section 188 CrPC. Therefore, the cognizance order passed by the court concerned was bad in the eyes of law and was liable to be quashed.

Prayagraj: The Allahabad High court has stayed further proceedings of a case against UP Pradesh Congress Committe chief and former MLA Ajai Rai involving violation of a 2017 prohibitory order under section 144 of criminal procedure code (CrPC). Justice Sameer Jain passed the order in a petition filed by Ajay Rai challenging summons issued against him as well as charge sheet filed by police. In his petition, Rai sought quashing of the summoning order dated Sep 9, 2019 and charge sheet dated Nov7, 2017 as well as entire proceedings of case no. 2436 of 2019, (state Vs. Surendra Patel and others) arising out of case crime no- 193 of 2017 under section 188 (Disobedience to an order lawfully promulgated by a public servant) of Indian Penal Code (IPC) lodged at police station- Kotwali police station of Varanasi. As per the petitioner's counsel, charge sheet was filed against Rai under section 188 IPC but cognizance was taken by court concerned on the charge sheet submitted for section - 188 of criminal procedure code (CrPC), therefore, cognizance order passed by the court concerned was bad in the eyes of law and was liable to be quashed. On the other hand, additional advocate general, representing state govt, Manish Goyal, submitted that although prima facie, cognizance order appeared to be bad, the entire proceeding could not be quashed. The court in its order dated Jul 28, after hearing parties concerned, fixed Aug 5 as next date of hearing and said, "Meanwhile, further proceedings pending against the applicant in the aforesaid case crime, remain stayed."

Uttar Pradesh Congress President Ajai Rai on Monday strongly criticised the BJP-led state government following the alleged suicide of a cloth merchant, his wife, and their teenage daughter in Lucknow. The family reportedly consumed poison, highlighting what Rai described as worsening economic despair under the current administration. Speaking to IANS, Ajai Rai expressed deep sorrow over the tragedy and pointed to a pattern of similar incidents since the BJP came to power in the state. "This is a very sad and condemnable incident. If I go to Lucknow, I will visit the family," Rai said. "In this government, no business is running well. People are feeling helpless, and this kind of helplessness is pushing the poor to such extremes — even taking their own lives and those of their loved ones." He added that such incidents are becoming alarmingly common. "When a person sees only darkness ahead, no way out, and no support, then tragedies like this occur. Ever since the BJP government came into power, especially in UP, there's been a rise in such heartbreaking events." Rai blamed the dire state of small businesses and economic stagnation for the growing sense of despair among citizens. "Nothing is selling, trade is dead, and banks are pressuring people for repayments. People can't pay rent. The government is only focused on its own agenda, not on public welfare. There's no accountability left," he said. Rai further responded to AIMIM chief Asaduddin Owaisi's recent statement expressing interest in joining the Mahagathbandhan alliance to contest the Bihar Assembly elections against the BJP-led NDA. "The people of the INDIA Bloc will collectively decide who to include. Right now, the alliance is strong in Bihar and gaining momentum daily," he noted. Rai further reacted to comments made by Samajwadi Party chief Akhilesh Yadav, who had directly criticised Acharya Dhirendra Shastri, also known as Bageshwar Baba, over alleged exorbitant fees charged by certain kathavachaks (religious storytellers). "I wouldn't say all kathavachaks are the same. Many are scholars who narrate stories without asking for money or making elaborate arrangements. Not everyone is like Dhirendra Shastri. Some individuals cast a shadow on the entire community, but most do their work with sincerity and devotion. People offer donations voluntarily, which is a different matter altogether," he said. Rai further reacted to the current relationship between the Congress and the Samajwadi Party, brushing aside any speculation of tension. "They have their work, and we have ours. Everything is fine between Congress and Samajwadi Party," he asserted.

Sticking to the social justice call by senior Congress leader Rahul Gandhi, the Uttar Pradesh Congress on Thursday released a list of its office-bearers from the newly constituted district and city committees made under the 'Sangathan Srijan' exercise—the first phase of which has been completed. A delegation of UP Congress led by state president Ajai Rai on June 26 met family members of astronaut Shubhanshu Shukla, the first Indian ever to enter the International Space Station. (Sourced) A total 38 committees were announced during the day out of the total 133 that will be announced by the month end. 'Out committees have at least 50% people from OBC, minority, Dalit communities apart from women representation. In several districts, this figure is over 70% depending on the size of the district and the committee,' said UP Congress Committee media cell chief CP Rai. 'The process of Sangathan Srijan focuses on all 403 assembly seats of the state and aims to strengthen organisation with inclusion of all communities and class,' said UP Congress chief Ajai Rai. During the review meetings, at least 90% of committees that were proposed before the state committee were rejected and office-bearers were asked to revise the list. The zonal review started on June 15 with the west zone, Braj zone on June 15, Bundelkhand zone on June 16, Purvanchal on June 17 and Prayag zone on June 18. Under the Awadh zone, lists have been declared for the district committees of Balrampur, Shravasti, Sitapur, Unnao and the city committee of Rae Bareilly. In the Braj zone, the district committee for Pilibhit and city committees for Aligarh, Bareilly have been declared. In the Bundelkhand zone, district committees for Etawah, Hamirpur, Kannauj, Kanpur, Lalitpur, Kanpur Dehat and Auraiya have been declared along with the city committee for Orai. Under Prayag zone, district units of Amethi, Chandauli, Jaunpur, Bhadohi, Pratapgarh, Prayagraj trans-Ganga, Prayagraj trans-Yamuna and Ghazipur have been declared along with city units of Mirzapur, Sultanpur and Mugalsarai. Under the Purvanchal zone, committees of Ayodhya, Ballia and Basti have been declared and in the west zone, committees of Bulandshahr, Ghaziabad, Hapur, Moradabad, Rampur and Shamli have been declared. Cong panel meets Shubhanshu's kin A delegation of UP Congress led by state president Ajai Rai on Thursday met family members of astronaut Shubhanshu Shukla, the first Indian ever to enter the International Space Station, in Lucknow. 'The country is proud of Shubhanshu who has made history,' Rai said. Other members in the delegation included vice chairman of Congress's media cell Manish Srivastava, former minister Naseemuddin Siddiqui among leaders.
