Landmark Ruling: Acquittal Must Be Followed by Complete Digital Erasure

KUWAIT CITY, July 16: The Court of Appeals overturned the decision of the ministries of Interior and Justice to refrain from deleting the data of a citizen acquitted of indecent assault from their automated systems despite the issuance of a final ruling on the acquittal of the accused and the restoration of his reputation. The court affirmed that the failure of the administrative authorities to take the necessary technical and legal measures to erase the case data is a negative decision that violates the law and causes material and moral harm to citizens, threatens their reputation, and disrupts their daily transactions. The court pointed out that judicial intervention is necessary to remove it. The case dates back to 2019, when the citizen was referred for trial on indecent assault charges. The court issued a final acquittal in 2020. The verdict was upheld on appeal and not appealed before the Court of Cassation, giving it final status. Despite this, the case data remained visible in the electronic systems of the ministries of Interior and Justice, prompting the citizen to submit a request for restoration of his reputation in 2024. This request was later rejected, so he filed a lawsuit, which was rejected as well. He then appealed the ruling before the Court of Appeals, which ruled in his favor. The Court of Appeals explained that keeping the case data in the systems of the two ministries despite the acquittal of the accused is an unlawful failure to take a necessary decision, under Article 244 of the Code of Criminal Procedure and Trials, stipulating that rehabilitation nullifies the conviction and all its effects, including the complete blocking of data from non-competent authorities. The court responded to the administrative authorities' arguments that the data was kept confidential within the systems, deeming this confidentiality 'formal' if the information was accessible to unauthorized employees and impacted the citizen's daily rights, even though the case did not appear in the criminal record. The court accepted the appeal in form and in substance, overturned the initial ruling, and rescinded the negative decision and all its consequences. It also ordered the ministries of Interior and Justice to delete the case data from their systems and to bear legal expenses, including attorneys' fees. The defense in the case was undertaken by Attorney Fahd Al-Shammari, who explained that the ruling is a victory for the proper application of the law. He asserted in a press statement that the ruling restores the dignity of his client and establishes the principle that acquittal must be followed by the erasure of effects, which could hinder a person's life, especially in daily dealings. Al-Shammari added that the court established an important legal rule, which balances the requirements of security and the rights of individuals to regain their legal and social status. 'We welcome this ruling, which does justice to the citizen and grants him the right to open a new page, free of legal restrictions. It is an actual application of the philosophy of restoring dignity as intended by the Kuwaiti legislator,' he concluded.

Branch chief Hussein al-Shammari told Shafaq News Agency on Sunday that the coverage spans news agencies, newspapers, satellite channels, professional photographers, and content creators from various countries. He confirmed that more than 30 fixed and mobile satellite news gathering (SNG) units are currently operating across the city, broadcasting live coverage of the religious ceremonies—from the flag-changing ritual at the Imam Hussein Shrine through to Ashura, the tenth day of Muharram. Al-Shammari added that over 800 journalists are participating in the coverage, representing local, regional, and international media—highlighting the religious, cultural, and journalistic significance of the occasion. He noted that the Imam Hussein and al-Abbas Shrines' authorities have provided extensive support for the media, including high-speed internet, meal services, designated press platforms, and official ID badges to facilitate journalist access within the heavily visited Old City. Al-Shammari also praised the security forces for ensuring a safe and efficient environment for reporters and media crews working in Karbala during this critical period. Ashura, one of the most sacred days in the Shiite Islamic calendar, commemorates the martyrdom of Imam Hussein ibn Ali, grandson of the Prophet Muhammad, who was killed in the Battle of Karbala in 680 CE. The day holds deep spiritual and political resonance for millions of Shiite Muslims worldwide.

US sanctions top Iraqi faction leaders

Shafaq News/ On Thursday, the US Treasury Department imposed new sanctions on Nasser al-Shammari, Deputy Secretary-General of Harakat Hezbollah al-Nujaba (HHN), as well as two other Iran-backed Iraqi paramilitary groups—Kataib al-Imam Ali and Kataib Ruh Allah Isa Ibn Maryam—as part of an ongoing campaign to curb destabilizing activities linked to Tehran's regional network. The sanctions, issued by the Treasury's Office of Foreign Assets Control (OFAC), will freeze any assets the designated individuals and entities hold under US jurisdiction and generally prohibit Americans from engaging in financial transactions with them. According to the Treasury, the sanctions aim to disrupt the financial and operational capabilities of these factions, which have been involved in attacks on US forces and continue to operate outside the control of the Iraqi state. Al-Shammari, a senior figure in HHN—a US-designated terrorist group and prominent member of the so-called "Axis of Resistance"—joins a list of sanctioned individuals already including the group's leader, Akram al-Kaabi. HHN has been accused of direct involvement in targeting US personnel in Iraq and Syria. The move also extends to Kataib al-Imam Ali, an armed group closely tied to Lebanese Hezbollah, and its offshoot, Kataib Ruh Allah Isa Ibn Maryam. Both groups have played roles in Syria and Iraq, with the latter notable for recruiting Christian fighters, particularly from the Syriac and Assyrian communities, according to the Washington Institute. US Congressman Joe Wilson welcomed the sanctions, but called for further steps—urging the Trump administration to add the Badr Organization to the sanctions list. Wilson described Badr as sharing 'the same DNA' with other sanctioned groups and warned of its entrenched influence in Iraq's political and security landscape. The Badr Organization is one of the most established Iran-backed factions in Iraq. Although it operates under the umbrella of the Popular Mobilization Forces (PMF), Badr also holds significant political power in the Iraqi parliament and government. Despite its longstanding ties to Iran's Islamic Revolutionary Guard Corps (IRGC), it has so far avoided direct US sanctions.

This event aligns with the Makin Club's goal to raise health literacy and promote the importance of continued care after the treatment journey. Dr Iman Al-Shammari, Secretary of the CAN campaign and Chairperson of the Makin Club Committee, emphasized the critical importance of rebuilding the body and strengthening the immune system after cancer recovery. She highlighted the need to enhance the quality of life for recovering women by providing accurate health information from trusted specialists. Dr Al-Shammari noted that misinformation can cause unnecessary anxiety and fear, negatively impacting psychological health. To address this, the Makin Club employs a strategic approach, organizing activities, events, and initiatives developed by experts and implemented according to a clear timetable. During the lecture, Dr Nada Al-Ibrahim, a specialist in obstetrics, gynecology, urogynecology, and pelvic reconstructive surgery, spoke on 'Enhancing Your Health During and After Treatment.' Dr Noura Al-Ibrahim, a gynecological oncology specialist, followed with a presentation on cancer prevention, emphasizing women's cancers and the crucial role of early screening, particularly for cervical cancer. The lectures focused on maintaining physical and psychological health throughout and after treatment stages, stressing that regular screenings can significantly reduce the incidence and mortality rates of cervical cancer. Key topics included boosting the immune system through balanced nutrition, evidence-based vitamin use, and adopting a healthy lifestyle. The doctors also addressed managing early menopause caused by certain cancer treatments, offering solutions to alleviate symptoms like hot flashes through appropriate therapies and lifestyle adjustments. The session was highly interactive, with many recovering women actively participating by asking questions about the health challenges they face during and after their treatment. Concluding the event, the Makin Club announced a special outing for recovering women as part of its Counseling and Psychological Support Program. Government Advisor: Iraq is determined to turn the resolutions of the Arab Summit into reality

Baghdad-INA Prime Minister's political advisor, Fadi Al-Shammari, affirmed on Sunday that Iraq is determined to transform the decisions of the Baghdad summit into reality, he noted that the Arab summit was exceptional thanks to Iraqi initiatives. Al-Shammari told the Iraqi News Agency (INA): "More than 18 initiatives were announced during the Arab summit in Baghdad yesterday." He added that "a large part of these initiatives came from Iraq, while the other part came from brotherly countries," noting that "what distinguishes these initiatives is that they are comprehensive and address the problems, issues, and political files some countries are facing." He pointed out that "the initiatives included relief, economic, and security issues, as well as touching on digital transformation and artificial intelligence," noting that "Iraq is capable of forming an executive system, especially with the Prime Minister's directive to work diligently and effectively to implement the summit's decisions, reflecting the image of the new Iraq and its commitment to implementing the summit's decisions." He explained that "if these decisions are implemented, it will be an exceptional summit compared to previous summits, whose decisions were not translated into practical implementation on the ground." He noted that "the initiatives launched by Baghdad, or those presented by participating countries, will all be within a specific work program with clear timelines and mechanisms, through specialized teams that will undertake the tasks of monitoring implementation." The 34th Arab League Summit concluded successfully in Baghdad on Saturday, drawing praise from Arab and international leaders for its organization, the summit's final statement included a categorical rejection of the displacement of the Palestinian people, the need to allow humanitarian aid into Gaza, and an appeal to the international community to exert pressure to halt the bloodshed in Gaza, condemn the Zionist attacks on Syria, and find a political solution to end the conflict in Sudan. Prime Minister Mohammed Shia al-Sudani, on behalf of Iraq, government and people, extended his sincere thanks to the Arab brothers who participated in the Baghdad Arab League and the Arab Development Summit, whose outcomes, he hopes, will contribute to achieving the aspirations of our peoples across the Arab world. He affirmed that "Baghdad will always remain an arena for joint Arab action, a source of strength and power, and a pillar of Arab decision-making, this is embodied in its hosting of our brothers and the initiatives and decisions that emerged from it, keeping pace with the scale of the challenges we face today." He concluded by saying, "The hearts and hands of Iraqis are always open to every effective step that shapes the future, and to every effort that supports stability and development, limits the spread of conflicts, and fulfills the hopes of our people."
