When does a citizen's arrest become assault? Pueblo case illustrates law's limitations
While Colorado law allows for citizen's arrests in certain cases, there are limitations, as illustrated by a recent Pueblo case in which a man was charged with two felonies after allegedly chasing down and assaulting a suspect accused of burglary. Pueblo police were called to the 1700 block of Joliet Ave on July 17 on a report that three men were "beating up another man who was allegedly caught burglarizing a home in the neighborhood," according to a Pueblo Police Department news release. When officers arrived, they found a man bound with black and yellow duct tape in the front yard of a home, according to the release. Officers learned that the burglary suspect, Joseph Mares, 21, and several other individuals had allegedly broken into a nearby home. Three males, including Cruz Alarcon, 26, allegedly chased the burglary suspects and caught one of them in a front yard on Joliet Avenue. A police officer was able to obtain video surveillance that allegedly provided evidence that Alarcon used excessive force in taking Mares into custody, according to the release. When does a citizen's arrest become assault or another crime? "In Colorado, a citizen's arrest is permitted under C.R.S. 16-3-201, but only when a crime is committed in the citizen's presence," Pueblo PD officials said in the release. "This means the citizen must personally witness the crime or have probable cause to believe it is ongoing or just completed. If these conditions are met, a private citizen can use reasonable force to make the arrest and prevent escape." "However, making an illegal citizen's arrest can lead to criminal charges like assault, false imprisonment, or even kidnapping," police stated. An important component of the law is the use of "reasonable force," which means an individual may use "non-deadly force appropriate to the situation," the Colorado Legal Defense Firm wrote in an article about citizen's arrests, citing Colorado statutes. The amount of force "cannot be more than what is reasonably necessary to make the arrest or prevent an escape," the defense firm wrote. That means that once a suspect is restrained, the continued use of force is illegal. "Unfortunately, in this case, the burglary suspect had already been caught, detained, and bound with duct tape by the citizens prior to being beaten," Pueblo police officials said on Facebook. "The legal actions leading up to the beating were within the law. What took place after he was detained and bound were not." Alarcon was arrested and charged with second-degree assault and felony menacing with a real or simulated weapon. Second-degree assault is a Class 4 felony in Colorado and generally carries a sentence between five and 16 years in prison upon conviction; felony menacing is a Class 5 felony, carrying potential penalties of one to three years in prison. Mares was transported to a local hospital with minor injuries and, upon release from the medical facility, was arrested and charged with second-degree burglary. Alarcon will appear in the court of District Judge Tim O'Shea on Aug. 14. Mares will appear in the court of County Judge Steve Fieldman on Aug. 29. Popeyes newest menu items were made for dipping. Chicken dippers arrived at participating restaurants Monday, July 14, alongside a new signature sauce inspired by Popeyes' New Orleans roots, according to the Miami-based chicken chain. Customers can dunk the dippers — thin strips of white meat chicken battered in Popeyes' signature spice blend — in a sauce that blends 'the bold flavors of the Louisiana 'holy trinity;' bell pepper, celery, and onion,' Popeyes said in a news release. Prices start at $4.99 but may vary by location, according to the restaurant's website. 'We took our time developing it over the last five years, ensuring we landed on something undeniably Popeyes,' Chef Amy Alarcon, vice president of culinary innovation at Popeyes, said of the signature sauce. This 'is a monumental moment for our brand, and one we approached with care, knowing it had the potential to become an iconic part of our menu,' she said. The chicken dippers are available for a limited time, but the signature sauce is here to stay, according to Popeyes. It'll join classic dipping sauces including barbecue, blackened ranch and honey mustard. The dippers' debut comes at the heels of Popeyes latest menu innovation: chicken wraps. A first for the chicken chain, each 'grab-and-go style' wrap features a full-sized chicken tender, lettuce, cheese, pickles and customers' choice of sauce. Popeyes beat rival McDonald's to the punch, launching its wraps a day before the Golden Arches teased the highly anticipated return of its snack wrap. Archbishop urges youth on NYD 2025: Be a close friend in discipleship
As the Roman Catholic Church in the Philippines formally begins the celebration of the National Youth Day (NYD), Caceres Archbishop Rex Andrew Alarcon urged the youth to become each other's 'katood,' a Bicol word which means close friend or kindred spirit. Alarcon commenced the 2025 NYD celebration with an outdoor Mass at the Naga Metropolitan Cathedral on Wednesday. 'Walk, not simply because we need to walk. Walk but because we would like to show our love for God and our neighbor,' Alarcon, who heads the Catholic Bishops' Conference of the Philippines (CBCP) Episcopal Commission on Youth, said during his homily. "Let us be katood to one another,' he added. Alarcon also said one can be a close friend by sharing one's dreams, aspirations, and experiences, and by being a companion during difficult times. 'Let your friendships not simply be based on enjoyment. But let your friendships one that is nurtured in that common sense of mission and sense of purpose. Hindi lang may pinagsamahan kung hindi may malalim na pinagsamahan (not just a simple friendship but a deep attachment),' he said. With the theme 'Rejoice in hope, endure in affliction, persevere in prayer,' this year's NYD runs from June 11 to 14. According to a CBCP News report, over 8,000 delegates from 84 of the country's 87 ecclesiastical territories are participating in the celebration. Make the first, succeeding steps Alarcon also called on the youth to embody three characteristics in being disciples of Jesus Christ: courage, undying hope and perseverance. 'In the journey of life, one has to make a step. This means to walk, to jump. Do not remain in the realm of wishes and dreams. Realize. Bring things to reality,' Alarcon said. As he acknowledged that becoming disciples comes with obstacles, Alarcon reminded the youth that the 'easiest way to fail is not to try.' 'Life's journey is not simply travel. It is a pilgrimage — a journey with Jesus. And that pilgrimage, we call discipleship,' Alarcon said. 'To become victorious over skepticism, we must always take the first step. It is to walk with hope so that we may reach our destination,' he added. In 1986, the CBCP declared December 16 as National Youth Day. Since 1998, national celebrations of NYD have been held every two or three years. The Archdiocese of Cebu hosted the 2019 NYD. Popeyes has added a flavorful new category to its menu. On Monday, the popular fried chicken chain announced the launch of its new Chicken Wraps, which boast the "same legendary Louisiana flavor with a whole new twist."
