German court rules Dubai chocolate must originate from Dubai
COLOGNE: A German court has ruled that Aldi Süd can no longer sell its 'Dubai chocolate' bars after confirming the product was manufactured in Turkey, not Dubai. The Higher Regional Court in Cologne delivered the final verdict on Friday, overturning previous lower court decisions. The legal dispute arose when a confectionery importer challenged Aldi Süd's sale of Alyan Dubai Handmade Chocolate, arguing the packaging clearly stated Turkish production. Aldi defended the product name, claiming consumers understood 'Dubai chocolate' as a style of pistachio kadayif-filled treat rather than an origin label. However, the court ruled that the name misleads buyers, as 15 to 20 per cent of consumers still associate it with Dubai. 'It is sufficient that around 15 to 20 per cent of the consumers addressed still associate the term with a specific geographical origin,' the senate stated. Aldi Süd has already pulled the product from shelves as a precaution. A company spokeswoman said they are reviewing the ruling but have not decided on further legal action. The judgment was issued in summary proceedings, leaving room for potential main proceedings if either party appeals.

German court flips on 'Dubai chocolate,' insists it come from Dubai
COLOGNE, Germany: German discounter Aldi Süd may no longer sell its popular "Dubai chocolate" candy, as it is originally made in Tukiye, German Press Agency (dpa) reported. The judgement by a Cologne court on Friday, which reverses decisions by lower courts, is final. However, it has only been issued in summary proceedings. A spokeswoman said it was not yet clear whether one of the parties will initiate main proceedings. Aldi Süd had been selling bars of Alyan Dubai Handmade Chocolate since December. But a confectionery importer initiated legal action in a bid to stop this, reasoning that the chocolate was produced in Tukiye as stated on the back of the packaging. Aldi argued that consumers had long been aware that the term "Dubai chocolate" referred to a type of product filled with pistachio kadayif - a crunchy noodle - rather than a designation of origin. But the Higher Regional Court ruled on Friday that anything called "Dubai chocolate" must indeed originate from Dubai, saying consumers would otherwise be misled. "It is sufficient that around 15 to 20 per cent of the consumers addressed still associate the term with a specific geographical origin," the senate argued. A spokeswoman for Aldi Süd said that the company would examine the grounds for the ruling.
