Karnataka high court: It's up to legislature to allow more time for appeals under Atrocities Act
Bengaluru: The Karnataka high court has observed that it is up to the legislature to amend the SC/ST (Prevention of Atrocities) Act if the govt seeks to allow more time for filing appeals against acquittals by special courts. The observation came from Justice V Srishananda while dismissing a criminal appeal filed by the state 381 days after a trial court in Yadgir had acquitted the accused on Sept 7, 2023. Under the current law, appeals against such acquittals must be filed within 180 days, as prescribed under Section 14-A(3) of the Act. The special court had acquitted them, citing insufficient evidence. Shahapur police filed an appeal in Oct 2024 after going through several administrative processes. The accused contested the maintainability of the appeal, pointing to the statutory deadline. The prosecution argued that the delay was not deliberate. However, Justice Srishananda held that the court was bound by the language of Section 14-A(3), which clearly bars entertaining appeals filed beyond 180 days. While acknowledging the public prosecutor's concerns, the judge said the remedy lies with the legislature, and not the court. The bench noted that in cases where delays are caused by genuine procedural hurdles rather than negligence, the state could consider legislative amendments. "The state public prosecutor may bring this order to the notice of the appropriate authority to consider suitable amendments," the court stated.

Karnataka high court quashes dowry harassment case against in-laws, but allows trial against husband
Bengaluru: The high court quashed the proceedings against parents and a relative of a 25-year-old Bengaluru resident in a dowry harassment case. Justice M Nagaprasanna noted the allegations against these individuals lacked merit, particularly as the complainant herself admitted to a secret marriage unknown to the family. The case involves two individuals who met in their college years. The complainant frequently visited the man's residence, occasionally threatening self-harm if marriage was refused. This led to the man's father filing a police complaint on Oct 23, 2021, at Subramanyanagar police station. Following police intervention, the woman provided a written assurance to cease troubling the family. Subsequently, the couple eloped to Hassan, marrying on Jan 12, 2023, with registration completed on Jan 13, 2023. They lived separately, with the family unaware of these developments. The relationship deteriorated shortly after, leading to woman filing a complaint alleging various offences, including forced sexual relations when she was underage, brutal assault post-marriage, and stalking with threats to expose private content which the man allegedly recorded on his mobile. The petitioners contested these allegations, arguing no prima facie case existed. They maintained the marriage was voluntary, and the complaint emerged as retaliation to divorce proceedings. Earlier complaints did not mention sexual assault claims, which were later added, citing incidents from Aug 4, 2019, Sept 4, 2019, and Sept 29, 2019. The court found allegations against petitioners 2 to 4 (parents and relative) lacking substantial evidence and legal basis. Justice Nagaprasanna also observed the requirements for offences under Sections 3(1)(r) and 3(1)(s) of the Atrocities Act, particularly regarding public humiliation based on caste, were absent. However, the judge maintained proceedings against the husband, citing serious allegations including Pocso Act violations and rape charges prior to marriage, which necessitate a complete trial.

Former sarpanch accused in rape case ends life
Rajkot: A former sarpanch of Vadod village in Jasdan taluka of Rajkot, allegedly died by suicide on Thursday, months after he was released on bail in a rape case. Malabhai Chava, 65, reportedly consumed poison at his house, police said. Three months ago, a married woman from the same village had filed a rape complaint against Chavda, following which he was arrested and spent a month in jail. After being released on bail, he had been living at his farm in Vadod. The deceased's daughter-in-law, 34-year-old Bharti, has now filed a complaint at Jasdan police station against the same woman, her husband, and two other villagers, for driving Chavda to take the drastic step. They have been booked for suicide abetment and other sections of the Bharatiya Nyaya Sanhita (BNS), along with sections of the Atrocities Act. In her complaint, Bharti alleged that Chavda was subjected to mental harassment by the accused, who allegedly recorded a video of him and threatened to falsely implicate him in other criminal cases. This prolonged psychological pressure is believed to have driven him to take the extreme step. On June 25, a day before the suicide, Chavda had informed his daughter-in-law that he had a scheduled court appearance at the Rajkot sessions court on June 26. Later that morning, the family received news that he had consumed poison. He was rushed to the Jasdan hospital, where doctors declared him dead on arrival. Family members told police that Chavda had confided in them about the rape allegation being a conspiracy, orchestrated jointly by the complainant, her husband, and the two other accused. They also alleged that the complainant had extorted nearly Rs 1 lakh from Chavda earlier. The police are investigating the allegations.

Land dispute case: Telangana HC reserves order on A Revanth's plea to quash 2016 FIR; order reserved till July 18
HYDERABAD: Justice Moushumi Bhattacharya of the Telangana high court on Friday reserved orders to July 18 on a plea filed by former Congress MP and chief minister A Revanth Reddy seeking quashing of a 2016 FIR registered against him at the Gachibowli police station. The case was filed based on a complaint by N Peddi Raju, president of the Razole Constituency SC Cooperative Housing Society, alleging trespass and caste-based abuse during a land dispute in Gopanapalli, Rangareddy district. The matter is pending before a special court under the SC/ST (Prevention of Atrocities) Act. According to the FIR, Peddi Raju claimed Revanth's brother Kondal Reddy and one E Laxmaiah forcibly entered around two acres of land claimed by the society, demolished a compound wall and other structures, and abused him in the name of caste-allegedly at Revanth's behest. The 2019 chargesheet noted that though Raju claimed purchase of land for the society, the sellers lacked clear title. Meanwhile, Kondal Reddy claimed to have purchased 31 acres in the same survey number in 2005, registered in his name. The chargesheet concluded that the accused trespassed into land in possession of the society and carried out the demolition. Counsel Nimma Narayana, appearing for Peddi Raju, argued: "Though the chargesheet was filed five years ago, charges have not been framed, and crucial provisions under the Atrocities Act were left out." He reiterated that Kondal Reddy used caste abuse, allegedly on Revanth's instructions. The judge reserved her orders and posted the case to July 18.

Head tonsured to ‘teach a lesson': Dalit man assaulted by 3 in Faridabad; police deny caste atrocity
The Faridabad police Wednesday arrested a 19-year-old man and apprehended his two minor accomplices for allegedly assaulting and holding a Dalit man hostage at Subhash Colony in the Ballabgarh area. Apart from assaulting the man, identified as Sahil, the accused also shaved his head, eyebrows, and moustache, and allegedly hurled casteist slurs against him on Monday evening, the police said. According to police, the main accused hatched a plan to attack Sahil, who was once his close friend, 'to teach him a lesson' due to the ongoing disputes between the two. Preliminary investigations revealed that the two had known each other for eight years. The police have, however, ruled out any casteist angle in the attack, though they have registered a case under relevant provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The accused allegedly called Sahil, aged between 25-30, to a dispensary near his residence and assaulted him along with his accomplices, a police spokesperson said. After shaving his head, the assailants allegedly stole Rs 3,000 from Sahil's pocket and allegedly hurled casteist abuses at him. He was later abandoned outside his residence, the officer said. 'The fight was over a change in friends' groups, and no caste angle has been found yet. The Atrocities Act has been invoked since he belongs to a Scheduled Caste. He (victim) has not been in a state to give a statement yet, but we are expecting to get one today,' said the spokesperson. The police registered a case based on the complaint of Suraj, Sahil's cousin, a resident of Subhash Colony at the Adarsh Nagar police station. They also dismissed reports that the victim was made to drink urine or hung upside down. The main accused was produced before a court on Wednesday and sent to judicial custody, while the two minors were presented before the Juvenile Justice Board for further action. Inspector Nafe Singh of Adarsh Nagar police station said that the man has sustained minor injuries.
