Medical Act amendments come into force from July 1, says Dzulkefly
PETALING JAYA: The amendments to the Medical Act, which aims to resolve the issue of parallel pathway programmes and streamline the recognition of qualifications and specialised training, will come into effect on July 1, says Datuk Seri Dr Dzulkefly Ahmad. The Health Minister said he had signed the order to enforce the amendments to the Act, which will be resubmitted to the Attorney General's Chambers (AGC) for the gazettement process. "God willing, these amendments will come into effect on July 1," he said in a social medai post Thursday (June 26) night. Dzulkefly said the move was not just a matter of amending the law, but also improving the future of healthcare in the country. "As I have emphasised in Parliament and during various engagement sessions previously, the implementation of this amended Act would not be delayed for long, and today, the Health Ministry fulfils that responsibility. "This is not merely a legal amendment, but a decision that concerns the future of our national healthcare system. "Through this amendment, both pathways can be executed in a more structured, transparent, and consistent manner within the framework of existing legislation," he added. He added that the demand for specialists continues to rise in tandem with the growing burden of diseases and the evolution of our healthcare system. "Therefore, we must ensure that access to quality specialist training is expanded, without compromising patient safety and the standard of care. "Thank you all for your support and attention," said Dzulkefly.

AGC appeals Syed Saddiq's acquittal in Armada funds case
KUALA LUMPUR: The Attorney General's Chambers (AGC) has officially filed a notice of appeal against the Court of Appeal's decision to acquit Muar MP Syed Saddiq Syed Abdul Rahman of criminal breach of trust, misappropriation, and money laundering charges linked to Armada funds. The AGC confirmed the appeal in a statement today, emphasizing that the move follows a thorough review of the appellate court's judgment delivered yesterday. The appeal process, it clarified, is a standard legal procedure allowing higher courts to reassess rulings and does not imply bias against any party. 'The appeal ensures legal issues from the Court of Appeal's decision are conclusively resolved by the Federal Court, upholding justice and transparent governance,' the statement read. Yesterday, a three-judge panel comprising Justices Datuk Ahmad Zaidi Ibrahim, Datuk Azman Abdullah, and Datuk Noorin Badaruddin unanimously overturned Syed Saddiq's conviction, citing insufficient evidence for the abetment and misappropriation charges. Justice Noorin also ruled the money laundering charge unsustainable. In November 2023, the Kuala Lumpur High Court had sentenced Syed Saddiq to seven years' jail, two strokes of the cane, and a RM10 million fine.

AGC files notice of appeal against Syed Saddiq's acquittal
KUALA LUMPUR — The Attorney General's Chambers (AGC) has filed a notice of appeal against the Court of Appeal's decision to acquit Muar member of parliament Syed Saddiq Syed Abdul Rahman of four criminal breach of trust, misappropriation of property, and money laundering charges in connection with Angkatan Bersatu Anak Muda's (ARMADA) funds. In a statement today, the AGC said the notice of appeal was filed after reviewing and considering the Court of Appeal's judgment delivered yesterday. It said the appeal process is a routine part of the justice system that allows higher courts to review lower court decisions and does not signify any prejudice against any party. 'The filing of this appeal aims to ensure that legal issues arising from the Court of Appeal's decision are thoroughly examined and conclusively determined by the Federal Court, in line with the principles of justice and transparent legal governance,' the statement read. Yesterday, a three-member Court of Appeal panel comprising Justices Datuk Ahmad Zaidi Ibrahim, Datuk Azman Abdullah and Datuk Noorin Badaruddin allowed Syed Saddiq's appeal to set aside his conviction and sentence on all four charges. Delivering the unanimous judgment, Justice Noorin held that the prosecution had failed to establish the charge of abetment and that the misappropriation charge was not supported by sufficient evidence or a credible factual foundation. She further ruled that the money laundering charge was unsustainable. On Nov 9, 2023, he was sentenced to seven years' imprisonment, two strokes of the cane and a RM10 million fine by the Kuala Lumpur High Court. — BERNAMA

MACC Chief Commissioner Tan Sri Azam Baki said the investigation papers have been submitted to the Attorney General's Chambers, and the Deputy Public Prosecutor has agreed to proceed with the application for forfeiture of the cash. The investigation followed a directive for Ismail Sabri to declare his assets under Section 36(1) of the MACC Act 2009. The declaration was made on Feb 10, and the MACC is now analysing the sources of the declared assets. - Bernama file photo "The affidavit application and related documents are being prepared. It is up to Ismail Sabri to challenge our application,' he said at a press conference at the MACC headquarters here today. However, Azam clarified that no decision has been made yet regarding criminal charges against the country's ninth prime minister. Ismail Sabri had previously appeared at the MACC headquarters several times to assist in investigations into alleged corruption and money laundering involving the use and procurement of funds for promotion and publicity of the Keluarga Malaysia programme during his administration from August 2021 to November 2022. Azam said the MACC had also recorded a statement from Ismail Sabri's former son-in-law, Datuk Jovian Mandagie, in relation to the investigation into the former prime minister's asset ownership. The investigation followed a directive for Ismail Sabri to declare his assets under Section 36(1) of the MACC Act 2009. The declaration was made on Feb 10, and the MACC is now analysing the sources of the declared assets. Following that, the MACC seized RM170 million in cash in various foreign currencies - including Baht, Riyal, Pound Sterling, Won, Euro, Swiss Franc and Yuan - and confiscated 16 kilogrammes of pure gold bars estimated to be worth RM7 million, as part of the corruption and money laundering probe against the former prime minister. The seizures were made during raids at a residence and office believed to have been used as a "safehouse', based on investigations into four of Ismail Sabri's former senior officers who were detained in February. - BERNAMA

'Inexcusable': AGC must answer for repeated DNAAs in high-profile corruption cases, says C4
PETALING JAYA: The Attorney General's Chambers (AGC) must be held accountable for its repeated failures in a number of high-profile court cases that have ended in a discharge not amounting to an acquittal (DNAA), says the Centre to Combat Corruption and Cronyism (C4). It said the recent pattern of flawed prosecutions involving political figures that ended in a DNAA showcased a possible significant deep-rooted institutional incompetence within the prosecutorial office. 'These are not normal criminal cases; they implicate corruption involving some of the most powerful political figures in the country, and as such, should be treated with the highest priority. 'It is inexcusable that DNAAs keep being granted on the basis that the AGC had failed to adhere to basic procedures, which are part of any criminal prosecution. 'Not only were they simply not prepared for this case that has been in progress for 6 years, they did not even object to the DNAA,' it said in a press statement on Friday (June 20). This comes after former prime minister Datuk Seri Najib Razak was granted a DNAA for three counts of money laundering involving RM27mil linked to SRC International Sdn Bhd by the High Court on Friday (June 20). C4 said Najib's newest DNAA joins a long list of recent similar failures by the AGC in court, including Najib and former treasury secretary-general Tan Sri Mohd Irwan Serigar Abdullah being granted a DNAA in the RM6.6bil criminal breach of trust case linked to payments to the International Petroleum Investment Company (Ipic) in November last year. Another recent high-profile case involved Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi, who was granted a DNAA for all 47 graft charges involving Yayasan Akalbudi funds on Sept 4, 2023. C4 also questioned the lack of any attempts by the AGC to publicly address its repeated failures in high-profile court cases, adding that it was sowing public distrust in the government and judiciary. 'Why have there been no public attempts to remedy this or address these prosecutorial failures? 'This lack of accountability only serves to deepen public distrust, erode confidence in the rule of law, and reinforce the perception that justice in Malaysia is neither independent nor equal,' it added. It also called on the AGC to publicly commit to refiling the charges for all cases where political figures have received a DNAA as soon as possible.
