SP MP Ziaur Rahman Barqs illegal construction case deferred to July 28
Sambhal (UP), Jul 22 (PTI) The hearing in the case related to alleged illegal construction by Samajwadi Party MP Ziaur Rahman Barq was deferred on Tuesday to July 28, as lawyers abstained from judicial work. The case pertains to the construction of a house in Deepa Sarai in Sambhal district without obtaining an approved map. A notice was issued to the Barq by the sub-divisional magistrate (SDM) on December 5 last year, followed by several reminders, officials said. According to SDM Vikas Chandra, the Sambhal MP was given multiple opportunities to submit a revised building map after objections were raised. On July 8, Barq was provided with the map containing necessary corrections. However, he claimed he had not received it — a response the court found unsatisfactory. Taking cognisance of the matter, the SDM court had imposed a penalty of Rs 1,000 on the MP. The amount has since been deposited. Talking to reporters, SDM Chandra said that although a hearing was scheduled for Tuesday, it could not be held due to a call by the local bar association to abstain from judicial work. As a result, the next hearing was rescheduled to July 28. view comments First Published: July 22, 2025, 21:30 IST Disclaimer: Comments reflect users' views, not News18's. MP Barq fined Rs 1k for ‘failing to submit revised house plan'
Dehradun: Samajwadi Party MP Ziaur Rahman Barq, who represents the Sambhal Lok Sabha constituency, has been fined Rs 1,000 by the sub-divisional magistrate (SDM) court for "repeatedly failing" to submit a revised building plan for his house, which was allegedly constructed "without proper approval". SDM Vikas Chandra said on Wednesday, "Barq was directed to submit the revised map by July 8 after the court had identified specific rectifications in its previous hearing in June. However, he didn't comply and claimed he had not received any notice. This is objectionable, as the court has issued multiple reminders. Despite repeated extensions and missed deadlines, his team has not submitted the revised plan." The next hearing is scheduled for July 15, with Barq's legal team seeking another extension to initiate the formal approval process. This is the second fine imposed on Barq in connection with the case. In June, he was fined Rs 500 for the same infraction. Earlier, on Dec 20, 2024, the Sambhal administration used a bulldozer to demolish "unauthorised" stairs at his under-construction house during an "anti-encroachment drive" in the Deepa Sarai area. Officials said the stairs were built over a public drain and that the construction exceeded permissible limits and lacked municipal clearance. The action followed a formal notice issued by the then SDM Vandana Mishra on Dec 5, 2024, under section 10 of the Uttar Pradesh Regulation of Building Operations Act, 1958, directing Barq to submit approved building plans — a directive he allegedly failed to comply with. Around the same time, the administration imposed a Rs 1.91 crore fine for alleged electricity theft at the site and disconnected power supply. However, in a June 4 order, a division bench of Justices Saumitra Dayal Singh and Sandeep Jain called the electricity penalty "wholly unnatural and arbitrary", and stayed the demand pending further hearings. The court also ordered immediate restoration of the electricity connection, subject to an interim deposit of Rs 6 lakh and timely payment of future bills. Barq was named in an FIR that was filed after the Nov 24 riots that broke out in Sambhal city following a court-ordered survey of the 500-year-old Jama Masjid. The timing of the FIR and the administrative actions led to allegations of "political targeting" by Barq's supporters. However, local authorities insisted the actions were based "solely on legal grounds".

Next hearing on July 15 in illegal construction case against Sambhal MP Barq
On December 5, a notice was issued to Barq by the Sub-Divisional Magistrate (SDM) in Sambhal. He was granted multiple opportunities to present the map, with the latest deadline set for July 8. Barq is accused of constructing a house in Deepa Sarai neighbourhood without getting a map approved by the competent authority. Sambhal (UP), Jul 8 (PTI) The case regarding the alleged unauthorized construction of a house by Samajwadi Party MP from Sambhal, Ziaur Rahman Barq, has been listed for hearing on July 15 after he failed to submit a revised building plan in the SDM court despite repeated notices, officials said here on Tuesday. However, even on Tuesday, no map was submitted on behalf of the MP. Taking note of this, the SDM has now granted a fresh date of July 15 for compliance, a senior officer said. SDM Vikas Chandra, responding to media queries, said, 'Barq is facing proceedings under relevant provisions of the law. The previous hearing took place on June 26, and the MP was directed to submit a revised map by July 8. The discrepancies in the earlier submission were communicated to him in detail.' Barq has claimed that he did not receive a copy of the objections, which the SDM termed as unsatisfactory. As a result, a penalty of Rs 1,000 was imposed on him for non-compliance, the SDM said. The matter will now be heard on July 15, 2025, SDM Chandra added. PTI COR KIS KVK KVK This report is auto-generated from PTI news service. ThePrint holds no responsibility for its content.

Sambhal violence case: Chargesheet filed against SP MP Zia Ur Rehman Barq, 22 others
The Uttar Pradesh Police have filed a chargesheet against Samajwadi Party MP Zia Ur Rehman Barq and 22 others in a case relating to the violence that erupted in Sambhal district in November, The Indian Express reported on Friday. Barq has been accused of inciting the crowd by giving allegedly provocative speeches, said a statement issued by the police in Sambhal on Wednesday. The statement said that 'some anti-social elements, criminals and certain political people to claim political relevance incited violence at the Shahi Jama Masjid' on November 24. The police claimed that they had found that allegedly inflammatory speeches and incitement to violence led to the clashes, which resulted in arson, the throwing of stones and damage to public and private property, The Indian Express reported. 'We have sent 92 people into judicial custody and are collecting evidence,' the newspaper quoted the statement as having said. 'The investigation is still ongoing, and soon, others involved will be arrested.' On November 24, violence broke out in Sambhal after a group of Muslims objected to a court-ordered survey of the Shahi Jama Masjid in Chandausi town. A trial court had ordered the survey in a suit claiming that the mosque had been built in 1526 by Mughal ruler Babar on the site of the 'centuries-old Shri Hari Har Temple dedicated to Lord Kalki'. Five persons were killed in the violence during the survey. The police said that the chargesheet was submitted in the special MP/MLA court of the civil judge (senior division) at the Sambhal district and sessions court in Chandausi in connection with a first information report filed at the Kotwali Sambhal police station, the newspaper reported. The Uttar Pradesh Police had accused Barq of inciting a mob for political gain which led to violent clashes. They alleged in an FIR that Barq visited the Shahi Jama Masjid days before the incident without permission, offered prayers and delivered provocative speeches. Twelve FIRs were filed after the violence and a Special Investigation Team was formed to look into the matter. Barq has denied the allegations, stating he was in Bengaluru at the time of the clashes. 'I was not even in the state, let alone Sambhal,' he had said after the violence. 'This is a conspiracy by the police and administration.' He had earlier criticised the court-ordered survey, stating that the mosque is a historic site. 'The Supreme Court had ruled that religious places as they existed in 1947 must remain unchanged as per the Places of Worship Act, 1991,' he said. On March 25, the Sambhal Police had served a notice to Barq over his alleged involvement in the matter. In April, the Samajwadi Party MP was questioned for about four hours by the SIT. On Thursday, Superintendent of Police Krishan Kumar Vishnoi confirmed that Barq had been charged in the case, The Hindu reported. 'The charge sheet details that late-night conversations took place between Barq and Zafar Ali, the president of Shahi Jama Masjid,' the newspaper quoted him as having said. 'They were responsible for gathering the crowd on November 22, two days prior to the widespread violence.' The chargesheet was based on 'extensive evidence' gathered during the investigation, he added. On January 3, the Allahabad High Court had stayed Barq's arrest but declined to quash the FIR filed against him and others at Kotwali police station. The court ruled that the investigation would proceed and ordered Barq to cooperate with authorities.

Next hearing on June 26 in illegal construction case against SP's Sambhal MP Barq
In connection with the matter, a notice was first issued to him by the Sub-Divisional Magistrate (SDM), Sambhal, on December 5 last year. Barq is accused of constructing a house in the Deepa Sarai area of Sambhal without obtaining approval for the building plan. Sambhal (UP), Jun 19 (PTI) The court of SDM Sambhal, after hearing arguments in a case of alleged illegal construction by Samajwadi Party MP Zia-ur Rahman Barq, on Thursday scheduled the next hearing for June 26, officials said. Several subsequent notices have followed, the most recent hearing having been held on June 12. According to the officials, a hearing was scheduled on Thursday at the court of SDM Sambhal, Vikas Chandra. While Barq did not appear in person, his legal counsel submitted his arguments. Talking to reporters, SDM Chandra said the case is being heard under Section 10 of the Uttar Pradesh Regulation of Buildings Act, 1958. He stated that a building plan was submitted by another party, Mamlukur Rahman, during a previous hearing. A technical assessment of the plan was to be conducted by the assistant town planner from Moradabad, whose report has now been received by the court, he said. The court has decided to issue a reminder and a formal letter to acquire the final technical report. The next hearing in the matter will be held on June 26, Chandra added.
