Calcutta HC directs Bengal govt to submit report on rape case progress

The Calcutta HC on Thursday directed the West Bengal government to submit a progress report along with the case diary on the investigation into the law student rape case within seven days. A division bench headed by Justice Soumen Sen also directed the state education department to shut down union rooms in all colleges and universities. The court issued the directions while hearing three PILs on the alleged rape of a 24-year-old student on the campus of a South Kolkata law college by an alumnus and two seniors on June 25. The next hearing is scheduled for July 10. The college has also been asked to file a report on its probe into the alleged crime. Kolkata: Senior counsel Anindya Mitra challenged the 2023 Calcutta High Court order by Justice Abhijit Gangopadhyay annulling services of 32,000 primary school teachers and argued that a court of law cannot cancel appointments of people not made parties in a case because that would constitute a violation of the principles of natural justice. Arguing before a division bench of the Calcutta HC on Thursday, Mitra said, "The petitioners who moved the single bench didn't even make such a prayer." The senior counsel restricted his arguments to the 2016 selection of primary teachers that concluded in 2017 and distinguished it from the 2014 Teacher Eligibility Test (TET). Mitra argued that the writ petition was moved five years after the selection process had concluded and pointed out that the petitioners did not make any allegations of illegality. "The basis of the illegality recorded in the judgement was the judge's own, based on irrelevant considerations. He submitted that the judge made these observations in relation to the 2014 TET and not the 2016 selection process by the Board. The senior counsel drew the division bench's attention to the part of the single bench judgement stating: "the sense of justice is above the sense of law" and argued that such a conclusion goes against the basic framework of the Constitution and rule of law. The counsel pointed out that the judge, while taking on an investigation on his own, had questioned candidates from only four of 20 districts and made a generalised observation on aptitude tests, when nine among those questioned had said that aptitude tests were held. Indian pacer Mohammed Shami's estranged wife, Hasin Jahan's lawyer, on Wednesday confirmed that the cricketer will pay a monthly alimony of ₹ 4 lakh to Jahan and her daughter and added that she had been running from pillar to post since 2018. Jahan's lawyer told ANI that the Calcutta high court has also directed the trial court to dispose of the main application of the interim order within six months. "There is a high chance that when they return to the trial court to conclude the hearing on maintenance, it might be upgraded to ₹ 6 lakh because the claim of Hasin Jahan in her maintenance application was for ₹ 7 lakh and ₹ 3 lakh," Ahmed said. The case Hasin Jahan worked as a model and cheerleader for the Kolkata Knight Riders before marrying Shami in 2014. The couple gave birth to their daughter in 2015. In 2018, Jahan accused Shami of domestic violence, dowry harassment and match-fixing. She claimed that the pacer had received money from a Pakistani woman. Jahan had also alleged that her husband stopped payments to her to cover her family expenses. The allegation resulted in BCCI putting the pacer's central contract on hold. The board later cleared Shami of match-fixing allegations after a probe.

Padma Shri awardee monk Kartik Maharaj, who has been accused by a woman recently of allegedly raping her, has approached the Calcutta HC, seeking cancellation of the FIR registered against him. A single-judge bench of Justice Jay Sengupta has admitted the petition, which is likely to be heard on Wednesday. Kartik Maharaj was served a notice by the Nabagram police station on Monday and summoned to the police station on Tuesday morning for interrogation in connection with a complaint by a victim, who was allegedly raped by the monk from January and June of 2013. Kartik Maharaj has denied the allegations and claimed that the police actions were made to harass a monk. Slamming the BJP over the issue, AITC posted on X, "...Today, the women of Nabagram, Murshidabad, took to the streets demanding his arrest for repeatedly raping a helpless woman, blackmailing her, and forcing her to undergo an abortion. BJP will bend backwards to bury the case because shielding sexual predators runs in their blood. But, let it be known: he will not escape. Kolkata: The Calcutta HC on Tuesday increased the interim maintenance amount to be provided by cricketer to his estranged wife (pic left) and their daughter from Rs 50,000 and Rs 80,000 to Rs 1,50,000 and Rs 2,50,000 per month, respectively. "Therefore, while it is true that the question of awarding an excessive amount of monetary relief does not arise, awarding a very low amount also cannot be accepted," the judge held. Hasin Jahan had asked for Rs 7 lakh per month for herself and Rs 3 lakh for her daughter. Her counsel, Imtiaz Ahmed, submitted that Shami's total income is around Rs 7,19,54,010. They challenged the lower court's mechanical granting of interim relief of Rs 50,000 and Rs 80,000. Ahmed stated Hasin Jahan's income to be Rs 16,000, whereas her monthly expenditure is around Rs 6,12,905. However, Shami's counsel, Sandipan Ganguly, submitted that the petitioner had falsely depicted herself to be a destitute person. "I have lost almost everything while fighting for my rights in the last seven years. I couldn't admit my daughter to a better school. I am thankful to the court," Jahan told TOI.
